STAFF REPORT

SUBJECT: Resolution DeclarIng Intention to Amend
Ordinance Number 725 (CCS) To Increase Amount
of Revenues Allocable to Collection Expenses
The City of Santa MonIca has created by ordInance
varlous business promotion districts under the Parking and
BUSlness Improvement Area Law of 1965, Streets and Highways
Code Sectlon 36000 et seq. Under these ordInances, revenue
is raIsed by increaslng the amount of the bUSlness lIcense
taxes paid by merchants. The addItional revenue, less costs
of collectIon, is turned over to the Chamber of Commerce for
business promotIon activitIes.
The DIrector of Finance has reported that the CIty'S
actual cost of collection exceeds the collectIon expenses
allocated by the ordinances. Under the ordinance creatIng
the downtown promotIon area, one percent (1%) is allocated
for collectIon expenses. Under the ordInance creatIng the
Montana Avenue promotIon area, fIve percent (5%) IS allocated
for collectIon expenses.
The Director of FInance has determIned that the City's
collection costs can be recovered by Increaslng the
collection allocation for the downtown promotIon area from

one percent (l%) to five percent (5%). The accompanying
resolution sets in motion the statutory procedure to amend
the ordinance to increase the collection allocation.
RECOMMENDATION
It 1S respectfully recommended that the accompanying
resolution be adopted.

Dear Interested Person:
Enclosed please find a copy of Resolution Number 6361
(CCS) adopted by the City Council on September 23, 1981. The
resolution g~ves you notice of the lntention of the City
Council to amend the Downtown Park~ng and Business Improve-
ment Ordinance relatlng to Retail Trade Promotion (Ordinance
Number 725 (CCS)).
Under the ex~sting ordinance, an additional business
l~cense tax ~s collected by the City. The money, less 1% to
the City for collection costs, lS turned over to the Santa
Monica Area Chamber of Commerce for retail trade promotion.
Because the C~tyls collection costs exceed 1%, the City
intends to increase the amount allocated to collection costs
to 5%. The City does not intend to increase the rate of the
additional business license tax paid by bUSLnesses.
The hearing on the proposed change lS scheduled for
October 13, 1981, at 7:30 P.M., ~n the City Cauncll Chambers
in City Hall, 1685 Maln Street, Santa Monlca, California.
Any obJections should be flIed with the Clty Clerk in writing
before the hour set for the hearlng.

WHEREAS, on Noverooer 22, 1966, the C~ty Counc~l adopted

WHEREAS, the purpose of the Dlstrlct was to generate
revenue for the genera] pro~otlon of retall trade act~v~tes
ln the area; and
t~EREAS, Sectlon 3 of Ordinance Number 725 (CCSl pro-
vldes that the r~venues generated by the additional buslness
llcense tax shall be put to the payroent of contract fees to
the Santa Monlca Chamber of Commerce less one percent (1%)
thereof as the cost of collectlon; and
WHEREAS, the City's cost of collectlon exceeds one
percent (1%); and
WHEREAS, the City seeks to increase the amount alloc-
able to collection without 1ncreasing the amount of the
business l1cense tax imposed upon merchants;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1.
The City council hereby declares its
intention to amend Section 3 of Ordinance Number 725 (CCS) to
read as follows:
Section 3. That the use to
which the proceeds of the additional
business license tax, less five per-
cent (5%) thereof as the cost of col-
lection, shall be put is the payment
of contract fees to the Santa Mon~ca
Chamber of Commerce for general promo-
tion of retail trade activltes ln the
area as ?rescribed by contrac~
between the Clty and said Chamber of
Commerce.
SECTION 2. Notice is hereby gIven that on the 11th day
of October, 1981, at the hour of 7:30 P.M., in the City Coun-
cil Chambers in City Hall, 1685 MaIn Street, Santa Monica,
California, a hearlng Will he held by the CIty Council to
conslder the change of use herein proposed. Any interested
person havlng any objection to the change of use herein pro-
posed may file a written protest with the City Clerk not
later than the hour so fixed for hearing.
SECTION 3. The City Clerk shall cause this resolution
to published once in a newspaper of general circulation in
the City of Santa MonIca and shall cause a complete copy of

th1S resolut1on to be mailed, postage prepaid, to each busi-
ness in the Downtown Parking and Business Improvement Area.
Such publication and rnail1ng shall be completed at least ten
days pr10r to the time of the hearing.
SECTION 4. The City Clerk shall certify to the
adoption of this resolut1on and thenceforth and thereafter
the same shall be in full force and effect.
