Ordinance Amending Santa Monica Municipal Code
section 6601A to Inerease the Transient
Oceupancy Tax
At its meeting on May 30, 1989, the Clty Councll dlreeted
the City Attorney to prepare an ordinance increasing the
transient occupancy tax from 10% to 12%.
In response to thlS
direction, the accompanying has been prepared and is presented to
the city council for its consideration.
Currently, the City's 10% transient occupancy tax is
established by Santa Monica Municipal Code sections 6601 and
6601A.
section 6601 establishes a tax of 6% and section 6601A
establishes an additional tax of 4%.
The accompanying ordinance amends section 6601A to increase
the additional transient occupancy tax from 4% to

bringing
the total tranSlent oecupancy tax to 12%.
The amendment is
effeetive on October 1, 1989.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordinance be introduced for first reading.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING MUNICIPAL CODE
SECTION 6601A TO INCREASE THE TRANSIENT
OCCUPANCY TAX EFFECTIVE ON OCTOBER 1, 1989
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1.
Effective on October 1, 1989, Municipal Code
Section 6601A is amended to read as follows:
SECTION 6601A.
Addi tional Tax.
In
additlon to the tax imposed and levied by
Section 6601, there is hereby imposed and
lev~ed on each and every transient a tax
for general revenue purposes equivalent to
six percent (6%) of the total amount paid
for room rental by or for any such
transient to any hotel, which tax shall be
lmposed and 1 ev ied ln the same manner as
the tax ~mposed and levied by section
6601.
SECTION 2.
Any provision of the Santa Monica Munieipal
Code or appendices thereto inconsistent with the provisions of
this Ordinance, to the extent of such inconslstencies and no

further, are hereby repealed or modlfied to that extent necessary
to affect the provisions of this ordinance.
SECTION 3.
If any section, subsection, sentence, clause,
or phrase of thlS Ordinance is for any reason held to be invalid
or unconstitutional by a declslon of any court of any competent
jurisdietlon, such decision shall not affect the validity of the
remaining portions of this Ordinance.
The city Council hereby
declares that it would have passed this Ordinance, and each and
every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether
any portion of the Ordinance would be subsequently declared
invalid or unconstitutional.
SECTION 4.
The Mayor shall sign and the City Clerk shall
attest to the passage of this Ordinance.
The City Clerk shall
cause the same to be published once in the official newspaper
within 15 days after its adoptlon.
This Ordinance shall beeome
effective after 30 days from its adoption.
