Increase of Rates for Temporary Use of Publ1C Property
Introduct1on
Th1S report recommends the C1ty Counc1l 1nstruct the C1ty Attorney to prepare
an ordlnance revlsing the fees charged for use of publ1C property as set forth
1n Sectlon 7151 of the Mun1c1pal Code. It also recommends the Council approve
add1tlonal personnel for the enforcement of regulations governing use of publlC
property.

Fees
Sectlon 7151 of the Mun1c1pal Code sets fees for perm1ts allowing the use of
publ1C property The fees are now set at 10~ per sq. ft. for a 60-day period
with a 525.00 mlnlmum charge. Section 7151 has not been revlsed since 1973 and
1S now out of date. The fees have no relatlon to elther the admlnlstrat1ve cost
involved ln wrlting and pollcing thlS permlt or the value of the land which is
rented.
The average value of land ln Santa Monlca is approximately ~55.00 per sq. ft.
Based on this figure the use of public property has a monthly rental value of
1% of land value or approx1mately 50€ per sq. ft. ThlS rate of 50~/sq. ft. per
month 15 proposed for 60-day permlt period wlth a S50.00 mlnimum charge. In
cons1derlng the value of a street use permlt to the contractor, the lnconvenience to
the citizens, the value of the land being used and the cost to the City for admlnlstering
and pollclng the permlt, staff belleves a fee increase 1S called for.

Personnel
Staff has been recelvlng an lncreaslng number of complalnts concernlng
problems wlth the many large development projects currently under constructlon
ln the City. These complalnts lnclude constructlon beglnning before 7:00 a.m.,
spll1age of dlrt on the publlC streets, exceSSlve noise from excavating and
drllling equlpment, blocking of traffic by excavatlng trucks and the blocking
of pedestrlan access.
Currently there are three Street Inspector positlons (one vacancy to be fl1led
wlthin 3 weeks). The inspectlon tlme avallable to these lnspectors is presently
lnsufflclent to properly enforce vlolatlons of ordinances affecting public and
prlvate property, Examples of the current backlog are ln the areas of sldewalk
repairs, lltter vlo1atlons, abandoned cars, publlC rlght-of-way obstructions
and weed abatement. Adequate enforcement of street use permits wll1 requlre elther
additlonal lnspectlon personnel or a cutback of other lnspectlon serVlces. Staff
strongly recommends not to reduce inspectlon in other areas.
Staff believes the addltlon of one full tlme street lnspector and funding for
the equivalent of one other inspector on an as-needed basls is requlred to properly
enforce street use permlts, ThlS lncrease ln personnel would requlre approximately
$40,000 ln addltlonal funds annually. Although the level of building actlvlty
cannot be accurately predlcted, staff belleves thlS level of lncreased lnspectlon
capablllty wlll be required for at least flve years. It is estlmated that the
amount of money recelved from street use permlts at the proposed rate wlll be
approxlmately $40,000 to S50,OOO and wlll pay for the lncreased personnel.

Recommendat1on
It 1S recommended the City Council 1nstruct the Clty Attorney to prepare an
Ord1nance amendlng Sect10n 7151 and a Resolution settlng a fee of 50~ per
sq. ft. per montn for the temporary use of public property for building materials,
equipment, debrlS and fences w1th a mlnlmum cost of 550.00.
It is also recommended the City Coune1l approprlate S40.000 from the Unappropriated
General Funds to hire one add1tlona1 street lnspector and fund1ng for one as-needed
inspector to be used during peak act1vity levels.
