Introductlon
On July 12, 1977 the Clty Counc~l, by vlrtue of Ord~nance No. 1063 (CCS)
prescrlbed the sum of twenty ($20) dollars per person as the fee to be
charged by the pollce Department each tlme flngerprlntlng serv~ces are
performed for any person, exceptlng a Clty employee In connectlon wlth
off~clal dutles. The Pollce Department states that a two month comparl-
son has lndlcated a decllne In revenues.
Background
Under the provlslons of Sect~on 11105 of the Penal Code, the Department
of Justlce charges pollee agencles submlttlng non-crlmlnal flngerprlnts
SlX dollars and ten cents ($6.10) each. The Pollce Department requested
that flngerprlnt fees be ~ncreased to twenty dollars ($20) for the flnger-
prlntlng of appllcants for pollce permlts. The ordlnance was passed but
the Clty Attorney has ruled that the resolutlon lncludes "any person
deslrlng to use the flngerprlntlng serVlces of the Pollce Department."
ThlS would lnclude cltlzens who are not seeklng a pollce perrnlt but merely
need thelr flngerprlnts taken for other reasons, 1.e., naturallzatlon
papers, real estate llcense, etc. In those cases the lndlvldual sends
the flngerprlnt card to the respectlve agency and the t1me expended by
the Pollce Department lS only a few mlnutes. A thlrd category of cllentele
lS a Job appllcant for the Santa Monlca Unlfled Seiool Dlstrlct. IVhl1e

It would appear that the $20 fee for appllcants other than pollce Permlts
has reduced a serVlce to the cltlzens and reduced revenue collected.
Cltlzens are now gOlng to nelghborlng pollce departments or prlvate
bUSlnesses for tile serVlce. Fees charged by other faCl11tles range from
$2 to $3.50.

Addltlonally, there lS attached the proposed

THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
ORDAIN AS FOLLOWS:
SECTION 1. In addltlon to the fees required
by Section 6122, the Clty Council may establlsh, by resolutlon,
a fee for the fingerprintlng of applicants for pollce permlts
requlred by any provlsion of this Code, or for any person
desiring to use the fingerprlntlng servlces of the Pollce
Department, which services mayor may not lDclude processing
of sald fingerprLnts. The City Councll may review the fee
so established annualJy.
SECTION 2. Any provisions of the Santa Monlca
Municlpal Code, or appendlces thereto lnCOnSJstent herewith,
to the extent of ~:;uch lnconslstencles and no further, are
h2reby repealed or modified to that extent necessary to effect
the provlsions of this ordinance.
SECTION 3. If any section, subsection, sentence,
clause or phrase of thlS ordlnance lS for any reason held to
be lnvalld or unconstltutlonal by a decision of any court of
competent )uTlsdiction, such declslon shall not affect the
valldlty of the remainlng portlons of the ordinance. Th~ Clty
Council hereby declares that lt would have passed thlS ordlnance
and each and every section, subsectlon, sentence, clause or
phrase not declared lnvalid or unconstitutlonal without regard
to whether any portlon of the ordinance would be subsequently
declared lnvalid or unconstltutional.
SECTION 4.

This report dlscusses establlshlng a fee to cover costs for flngerprint2ng,
pollce permlt applicants.
Background
The Santa Monica Municlpal Code requlres that all applicants for designated buslness
and activity llcenses obtain a pollee permlt. In processlng these permlts, the
Pollce Department flngerprlnts the appllcants ln order to check thelr background
for any past crlminal actlvlty WhlCh would warrant denlal of their perMit to operate.
The fingerprlnt cards are then sent to Sacra~ento for proper verlflcation. ThlS
service, WhlCh at one tlme was provided by the State Crlffiinal Investigatlon and
Ident1flcatlon Bureau at no charge, now-cost the Clty $5.75 per person. Over the
past 3 years, the number of persons flngerprlnted has lncredsed from 240 in 1974 to
599 in 1976, an lhcrease of 150%. The comb~natlon of thlS ~ncrease and the number
of persons fingerprlnted along with the $5.75 serVlce charge, plus the Clty'S
aQ~inistratlve costs, has requlred development of alternatlves for recovering some
of these costs.
Staff has determined that the current costs for processlng the flngerprlnts and
personal data ranges from ~l5 to $20 dep2nd~ng or. the ~ature of the bUSlness or
actlvity. For many of these activltles, the pe~lt fee 15 so nO~lnal that lt does
not bf'g1-n to cover ~the Cl ty I 5 expeYlses _ For example, every tune a taxlcab COf'Ipany
employs a new driver (410 drlvers were flngerprlnted last year) the drlver is reqUlred
to fill out a pollce permlt form and depos1t $1.50 for an operators badge. If the

drlver returns the badge after terrnlnatlo~, the Cl~Y re~urns $1 of their deposlt.
lIenee, the Clty absorbs approxl~ately $15 fo~ every taXlcab drlv~r processed. On
a yearly basls then, the Clty lS absorblng a cost of approxlmatley $10,000 for these
background lnvestlgatlons. Because of the magnltude of these expenses and the
antlclpated future lncreases in both the n~~~er of persons flngerprlnted and the
C.I.I. serVlce charge. Staff recOFmends the fol1o~lng procedure whereby the Clty
can recover at least a portion of these costs from the appllcants.
Alternatlves
1. Adopt an ord1nance which would allow the Clty Coune~l to establ1sh a fee
on a yearly baS1S by resolutlon beginnlng w1th $10.00 for the flrst
year and belng subJect to annual evaluatlon thereafter. The $10.00 charge
15 not viewed as particularly hurdenso~e to the ~ndkvldual and would
recover approx~mately 60% of the CLty's current expenses.
2.
Adopt an ord1nance wh~ch allows the c~ty Counell to establ1sh a fee
by resolutlon WblCh provldes for annualr fla~ dollar lncreases.
3. Adopt an ordlnance Wh1Ch allows the City Council to establlsh a fee
by resolution WhlCh would lnerease yearly in accord~nce wlth the
ConSQ~er Pr1ce Index.
4. Adopt an ordlnance Wh1Ch allows the C1ty CO~DCll to establ1sh a fee
by resolut2on at $20.0D. The S20.00 charse would provlde for escalatlon
costs over the next 5 years and ~herefore wo~ld not reqUlre any changes
w~thln that t1~e per~od.
5. Adopt an ordkn~nce WhlCh would allow the Clty Counell to establlsh a
fee by resolutlon WhlCh could be revlewed each year to determlne whether
or not lt needs to be raLsed or lowered.
