BACKGROUND
The PIer drd the Carousel are attractive locatic~s for commerCial
fllmlrg such as mOVIes, teleVISlor, co~merclal ads, photographIc
stIlls and studert and educatlopal fIlmIng proJects. Sarta
MO~lca IS close to major studIOS, so travel expenses for fIlm
crewsare relatIvely low. SInce the Carousel bUIldIng'S major
rerovatlcr, many people have contacted the PIer Manager
requestIng to rert the Carousel for purposes other thar fIlmIng.
Requests Include chlldrer-'s birthday parties, toy conventions,
fund-ralslrg everts for organlzatlors of all types, weddlrg
receptlor:s, product promotlor-s, ard book autOgraphIng seSSIor:s.
Rertlr-g the Carousel for fIlmIng and for prIvate everts would be
a good source of Income durIng the PIer's "slow" mor-ths; It Will
also prOVIde free publiCIty wh1ch car. Improve general P1er
buslr:ess, ar.d therefore gererate addlt10nal PIer rever-ue.
Resolutlor Number 4740 (CCS) adopted AprIl 27, 1976 (attached as

(see ExhIbIt C). Based upor. the Ir.formatlon provIded, Includlf-g
the locatIon, tIme, date ar.d scene, the appllcar-t is dIrected to
other approprIate departmerts for any required approvals. All
applicants must obtain approvals from the Police and Fire
Departmer-ts and the Parklrg a~d TraffiC DIVlSIOr:.
Ir addltlor, the applicant must secure approval from the PIer
Mar.ager for ar-y fIlmIng or: the Pier Ircludlr-g the Carousel
BUIldIng. The PIer Manager requests addItIonal Informatlor: such

lOgIStIcs of the fIlmIng dnd the rules and regulatlors regardIng
PIer use for fIlmIng. Some cordltlors for use are lIsted on the
reverse Side of the CIty-wIde CommercIal FIlm PermIt but they are
rot specIfIc to the PIer ard the Carousel. After all approvals
are secured the applicant returr.s to Gereral SerVIces With the
reqUIred lrsurar-ce pellCY documerts ard the reqUIred fee.
As ~oted prevIously, the PIer Mar.ager and other CIty staff
regularly receIve requests to rent the Carousel or other areas or-
the Pier for prIvate parties. At thIS tIme each request is
evaluated lr-dlvldually and there IS fO establIshed fee schedule.

CALCULATING A PIER FILMING AND USE PERMIT FEE SCHEDULE
To determIr-e a reasonable fee for PIer fll~lr:g ar:d use permIts
City staff analyzed two prlCIrg concepts: 1) the actual City
cost to process permIts ar-d morltor actIvItIes or everts; ard 2)
the currert permIt "marketplace", or what ether CItIes charge for
fllmlrg or USIng comparable faCIlItIes.

fees are comparable. The results of thIS revIew are displayed lr
ExhlbltF. ThIS analysIs reveals that the $400 baSIC fIlmlrg
permIt fee IS roughly comparable to what these other CItIes
charge for gereral CIty locatlOf-S, but IS substartIally below the
fees caarged fer specIal locatIors comparable to the PIer ard
Carousel (for example, Greystone Marslor, L.A. Observatory, ard
S tea r f- s Wh a r f) .
ANALYSIS
The preVIOUS sect lor of thIS report suggests that the P1er
fllmlrg ard use permIt fees should be l~creased to at least
offset direct PIer perserrel costs. PermIt fees at two or three
tImes dIrect cost would r.ot put the Pler at a competItIve
dlsadvartage relatIve to other Southerr Callforrla locatlors and
would help gererate new PIer operatIng revenue. A compreherSlve
PIer fee structure would COf-Slst of a baSIC dally fllmlrg or use

$1,000.00 per day or ar:y portier thereof
1,500.00 use depOSIt per day (personrel and ma1rtenance)
250.00 securIty depOSIt per day
$2,758.00 per day
The appllcart would receIve credIt agalr-st the $1,500 per day use
depOSIt at the rate of $100.00 per hour or ary portlor: thereof
(mIr-lffium 2 hours). Fer example, If the fIlm crew worked r-lre (9)
hours 1~ the Carousel BUlldlr-g they would be charged $900.00

total and would be refunded $600.00. The $1,000.00 Pier Use Fee
would be non-refur-dable and covers the prOCeSSIf-g of the
appllcatlo~ and the permIt fee. The security deposIt would be
refur,ded after ar lrspectlor- of the premIses. If malnter:a~ce or
repaIrs are requIred, these costs would be deducted and the
remaInder, If any, returr~ed. The appllcart would wIll be
requIred to hIre the Carousel operators at a rate of $20.00 per
hour, the rate requested by the Carousel operators who are
lrdeperder:t contractors to the CIty.
Nor-profIt crgarlzatlor.s or students requestlf:g the use of the
Carousel bUlldlrg for fIlmIng or other events, such as fur-d
raisers or partIes would rot be charged the processlrg ar:d permIt
fees. However) they would be required to pay the actual cost for
perso~nel ($9 per hour per operator) ar-d bUIlding operatIon cost
($20 per hour, or $14 per hour If Carousel IS r:ot In motIon). A
$250.00 securIty depOSIt WIll be reqUIred per day or a~y portlor
thereof. Proof of ron-profit or student status would be
reqUIred. Nor-profIt groups or studerts who do rot have
approprIate publIC lIabilIty Ir:surance polICIes, may utilIze the
CIty'S Insurance at a rate based upor the type ar.d SIze of the
function. Everts would cnly be scheduled durIng the "slow morths"
of the year, September through l'-1ay. The Carousel's rormal
operating days for thIS period are Saturdays, Sundays and
holIdays. Everts WIll orly be scheduled dUflrg the week ard
after surset on the weekerds. No everts would be permItted to
lrterfere WIth ror~al Carousel operatlo~s.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA PERTAINING TO
PICTURES FOR COMMERCIAL PURPOSES
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOL~~OWS :
SECTION 1. PIct~res For Commercial Purposes.
A. The Department of General Services shall issue all
permIts for the use of any CIty property for any purposes.
AppllC a tIon s for such. perm I ts shall be mad e upon forms prov ided
by the Departmef1t of General Services.
Such permits shall
SpeCify the locatIon to be used, the date(s) and time(s) for
WhlCh such permit is desired and shall set forth such special
conditIons regarding the use of such permIts as the Director of
Ger:eral SerVIces shall, in hIS or her discretion, determine.
Such permIts shall also set forth the fee or charge WhICh is to
be paId to the CIty at the time the permIt is issued.
Each permIt shall specify that no reference shall be
~ade by dIalouge or pIcture to the Santa Monica PolIce
8epartme~t, lts offIcers or personnel, or to the CIty of Santa

Fees.
The schedule of fees to be charged for the
Issuance of a permit for the filming of commercial motion
plC't.urest commercial teleVIsion f11ms, or commercial still
photography on CIty property, for each day or portion thereof are
hereby establIshed as follows:

c. Fees for use of C1ty personnel. For any locatIon or
area the use of which occasion special dIfficUlty or expense to
the CIty, thereby requirIng the use of City personnel In any
capaCIty In connectio~ WIth such commercial filming or
photography, and faT the use of City personnel for general
aSslstarcet superVISIon, or other purposes for such filming or
photography, an additIonal charge shall be made against and
payable by the permittee at the rate of FIfteen Dollars ($15) per
hour per employee.
D. Per.alty fees. Notwithstanding any other provision in
thIS resolutIon, no filmIng of commercial motior. pictures,
commercIal teleViSIon fllmst or commercIal still photography on
Clty property shall be InstItuted by any permit holder in any
resldertlal neIghborhood of the CIty after 10:00 O'clock p.m.
In addltlor to any other penalties provided by law, 1n the event

Each permit shall contaIn a statement that
tne permIttee holds the CIty harmless from any and all liabIlIty

lrsureds1 In amourts of not less thar. a combined sIngle-limit
POlICY WIth aggregate lImits 1n the amount of $1,000,000. Such
certlflcate of lnsura~C'e shall be furnIshed to the Director of
General SerVIces and shall further contain a provision that
notIce If wr~tlng IS to be provIded to the Director of General
SerVIces WIthin thIrty (30) days prior to cancellation of such
POllCY.
F. The DIrector of General Services, upon application for
a permlt, shall review the same, and may seek the advice of such
other CIty departmer.ts as may be affected by the requested

permIt. If the Director of General Services finds that the
issuance of such a permit would constitute a hazard to the
welfare of the community or its citIzens or, pose a threat to
publIC safety, or endanger lIves or property, he or she may
refuse to Issue the permIt applied for.
G. Students and non-profit orgar.lzations. A permit, as
prOVIded for hereIn, must be obtained by students or rlon-prOfI t
orgar-Izatlons prior to engagIng In the activities described
herelr, but no fee shall be requIred of the same therefore.
Studer.ts shall supply a wrItten certificate from the schoel of
theIr attendance WhlCh shall state that they are bona fide and
currertly erorolled students of such school. Non-profit
organlzat~ons shall supply a certificate stating that they are
exempt and ClaSSIfIed as non-profIt under federal and state
tax 1 rg 5 ta tutes.
H. Educatior-al fIlms. For the purposes of this Resolution
ar- educatIonal fIlm shall be one which provides instruction,
especlaJly for students, ultImately limited to classroom use, and
a fIlm for which no admIssIon charges WIll be made. However, any
educatIonal film as defi~ed above, Wh1Ch 15 not made for the
poJrpose of sale, lease or rental, and not so sold, leased or
rerted~ shall ~e exempt from the $100 educatlonal fee. The
Dlre~tor cf Ger:eral SerVIces shall have dlscre>tIon hereunder to
deter m 1 r e, pur suan t to thl S sub sec t Ion 1 whether the object of a
permlt appllcatlor IS for commerCIaL or for educational fllming.

CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. That Section 5 of Resolution Number
28l2(CCS) be and hereby is amended to read as follows:

issue all permits for the use of any City property for any

Fees for educat~onal films
c. Fees for use of C~ty personnel. For
any location or area the use of which occasion special
difficulty or expense to the City, thereby requiring the use
of City personnel in any capacity in connection with such
commercial filming or photography, and for the ~se of City
personnel for general assistance, supervision, or other
purposes for such filming or photography, an additional
charge shall be made against and payable by the permittee
. ,
at the. rate of Fifteen Dollars ($lS) per hour per employee.
D. Penalty fees. Notwithstanding any
other provision in this resolution, no f11ming of commercial
motion pictures, commercial television f11ms, or commercial
still photography on City property shall be instituted by
any permit holder in any res~dential neighborhood of the
City after 10:00 o'clock p.m. In addition to any other
pe~alties provided by law, in the event that a permittee
or other person violates the prov~sions of this subsection,
an additional fee shall be charged as follows:

E. Insurance. Each permit shall cont~in
a statement that the permittee holds the City harmless from
any and all liability for personal ~njury and property damage
arising out of the use of the permit and the use of City
property and facilities. In addition, each permitted, as
a cond1tion of the issuance of a permit, shall first prov1de
public liability ~nsurance naming the City of Santa Monica,
its agents, servants and employees as co-insureds, in amounts
of not less than One Hundred Thou~and Dollars (SlOO,OOO)
bodily injury insurance for anyone person, Three Hundred
.~housand Dollars ($300,000) bodLly injury insurance for any
one accident, and property damage insurance in an amount not
less than Fifty Thousand Dollars (SSO,OOO) per occurrence.
Such certificate of insurance shall be furnished to the
Director af Publ1c Works and shall further contain ~ provi5~o~
that notice in writing is to be provided to the Director of
Public Works within thirty (30) days prior to cancellatlon
of such policy.
F. The DIrector of Public Works, upon
appl~cation for a permIt, shall reVlew the same, and may seek
the advice of such other City departments as may be affected
. ~by the requested filming or photgraphy activities prior to
issuance of such a permIt. If the Dlrector of Pub11c Harks
finds that the issuance of such a permit would constitute

ties described herein, but no fee shall be required of.the
same therefore. Students shall supply a written certificate
from the school of their attendance which shall state that
they are bona f~de and currently enrolled students of such
school. Non-profit organ~zations shall supply a certificate
stating that they are exempt and class~fied as non-prof~t
under federa~ and state taxing statutes.
H. Educational f~lms. For the purposes
of this resolut1on an educational f~lm shall be one which
provides instruct~on, especially for students, ultimately
. limited to classroom use, and a film for which no admission
charges will be made. The D1rector of PubllC Works shall
have discret10n hereunder to determ1ne, pursuant to this sub-
section, wheth~r the obJect of a permit application is for
conunercial or for educational fllrnln~s.u... ~.fiOSI ~

I. The prov~sions of th~s resolution shall
not apply to the Santa Mon~ca C~V1C Auditor~um, and fees for
the use thereof shall otherw~se be set.
SECTION 2, The City Clerk shall certIfy to the
adopt1on of th~s resolut1on, and thenceforth and thereafter
the same shall be in full force and effect.
