establishing a fee for processing business license applications and
Resolution Setting Business License Processing Fees
Introduction
At its meeting on May 13, 2003 the City Council introduced for first reading an ordinance
amending section 6.04.030 of the Municipal Code relating to business license application
processing fees. The ordinance is now presented to the City Council for adoption. A
resolution setting the fee amount at $10 for new business license applications and $19 for
renewals, as conceptually approved by Council on May 13, 2003, is also attached.
Recommendation
It is respectfully recommended that Council adopt the accompanying ordinance and fee
resolution.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA ESTABLISHING A FEE FOR
PROCESSING BUSINESS LICENSE APPLICATIONS
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION 1. Section 6.04.030 is hereby added to the Santa Monica Municipal
Code to read as follows:
Section 6.04.030. Business license application processing fee.
Business license applicants shall pay a fee to cover costs related to
processing business license applications. The amount of the fee may be
set, and from time to time amended, by Resolution of the City Council.
SECTION 2. Any provision of the Santa Monica Municipal Code or appendices
thereto inconsistent with the provisions of this Ordinance, to the extent of such
inconsistencies and no further, is hereby repealed or modified to that extent necessary to
effect the provisions of this Ordinance.
SECTION 3. If any section, subsection, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court
of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Ordinance. The City Council hereby declares that it would have passed
this Ordinance and each and every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether any portion of the ordinance
would be subsequently declared invalid or unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of
this Ordinance. The City Clerk shall cause the same to be published once in the official
newspaper within 15 days after its adoption. This Ordinance shall become effective 30
days from its adoption.

RESOLUTION NO. _____(CCS)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA SETTING BUSINESS LICENSE PROCESSING FEES
WHEREAS, it is the policy of the City of Santa Monica to charge for the full
costs of services provided by City staff when such services benefit individual users rather
than members of the community as a whole; and
WHEREAS, Ordinance No. 1754 (CCS) (the Ordinance), adopted July 12,
1994, governs the setting of the amount of user fees or fees for services provided to or for
the benefit of particular individuals rather than the general public, and
WHEREAS, the Ordinance allows such user fees or fees for services to be
set by ordinance, by a resolution adopted by the City Council, or by any other
means authorized by law; and
WHEREAS, the City desires to recover the cost of processing Business
License Tax Applications,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. At the time an application is made for a new business license,
the applicant shall pay a processing fee of Ten Dollars ($10.00). At the time a business
renews an existing license, the applicant shall pay a processing fee of Nineteen Dollars
($19.00).
SECTION 2. The fee described in Section 1 will take effect July 1, 2003.
SECTION 3. Commencing upon July 1, 2004 and on July 1 of each fiscal
year thereafter, all fees established by this resolution shall be administratively revised
annually by a factor equal to the difference in the Los Angeles-Orange-Riverside
Consumer Price Index for Wage Earners and Clerical Workers for the twelve month period
February through February of the prior fiscal year. The fee will be examined as part of
comprehensive City-Wide fee studies in the future to determine if the fee is adequately
recovering City costs for these services.
SECTION 4. The City Clerk shall certify to the adoption of this Resolution,
and thenceforth and thereafter the same shall be in full force and effect.
