Recommendation to ReJect BIds on Bid # 2046 for
Brake Retarders for the TransportatIon Department
IntroductIon
This report recommends the CIty CouncIl reJect the only bid
receIved, adopt a resolutIon to waIve further bIdding requIre-
ments on Bid H 2046 for bus brake retarders for the Transporta-
tlon Department, and authorIze the CIty Manager to negotIate on
the open market for the purchase of the brake retarders.

In response to published NotIces InVItIng B1ds (published January
28 and 29, 1986) to furnish, delIver and 1nstall brake retarders
1.n accordance WI th CIty spec ifIcations f bIds were recel ved and
pUblICly opened and read on February 20, 1986.
Proposal forms
were mailed to four vendors and notIces were advertised ~n accor-
dance wlth CIty Charter and Munic~pal Code provisions. One pro-
posal was rece1.ved as follows:

Staff has analyzed the bId received from the Charles W. Carter
Company, and recommends that the bId be reJected as It substan-
tially exceeds the amount prov1ded 1n the FY 1985-86 budget.
Staff wIshes to explore other opt1ons for purchase and Installa-
tIon at pr1ces lower than the recent bId (e.g. buy material and
contract separately for Installation and/or contact Manufacturer
dIrectly and attempt to negotIate price conceSSIons on the
materIals). Therefore, staff recommends that the bId be rejected
and that the CIty CouncIl authorize the CIty Manager to negotIate
the purchase and InstallatIon of the Telma Brake Retarders ~n the
open market.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
WAIVING FURTHER FORMAL BID PROCEDURE AND AUTHORIZING DIRECT
NEGOTIATION FOR PURCHASE OF BRAKE RETARDERS INCLUDING
INSTALLATION FOR THE BUS FLEET OF THE TRANSPORTATION DEPARTMENT.
WHEREAS, Formal Bid No. 2046 for purchase of brake
retarders including installation for the Transportation
Department has produced one bid that should be rejected; and
WHEREAS, the purchase of the brake retarders including
installation may be purchased under more favorable circumstances
in the open market,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Santa Monica
does hereby reject Bid No. 2046 and authorizes the purchase of
brake retarders, including installation, in the open market
without further compliance with Municipal Code Section 250B.
SECTION 2. The City council of the City of Santa Monica
does hereby authorize the city Manager to negotiate in the open
market to execute the procurement of brake retarders, including
installation, for the Transportation Department Bus Fleet.
SECTION 3. The city Clerk shall certify to the adoption
of this ReSOlution, and thenceforth and thereafter the same shall
be in full force and effect.
