SUBJECT: Recommendation to Award Bid to Furnish and Deliver
Miscellaneous Paints and Paint Supplies, Bid #2195
INTRODUCTION
This report concerns award of bid to furnish and deliver
miscellaneous paints and paint supplies at specified unit prices,
plus applicable sales tax.
BACKGROUND
In response to published Notices Inviting Bids (published
October 27 and 28, 1988) to furnish and deliver miscellaneous
paints and paint supplies in accordance with City specifications,
bids were received and publicly opened and read on November 11,
1988.
Proposal forms were mailed to eight vendors and notices
were advertised in accordance with City Charter and Municipal
Code provisions. Two proposals were received as follows:

staff requested Council to reject the previous bids on
November I, 1988, due to both bids being non-responsive. Even
though the bid list was expanded and reissued, only two bids were
received. Federal restrictions issued to all suppliers of paint
concerning chemicals utilized in paint production have caused
some manufacturing problems resulting in a shortage of supply.
In addition, many manufacturers were unwilling to guarantee
prices for a one-year period of time.
The bid submitted by Dunn Edwards is non-responsive because the
prices were only guaranteed for four months and not twelve months
as specified. Staff has evaluated the bid from Sinclair Paint
Company and finds that it meets city specifications.
BUDGETARY/FINANCIAL IMPACT
Fiscal Year 1988/89 appropriation authority for this purchase is
in the maintenance accounts of various departments. As the
materials are drawn out of inventory, they will be expensed
against available FY 1988/89 appropriation authority.

RECOMMENDATION
It is recommended that the bid of Dunn Edwards be rejected as it
is non-responsive to city specifications, and that the award of
Bid #2195 be made to Sinclair Paint Company at specified unit
prices, plus sales tax, as the lowest and best bidder.
