a Purchasing Divlsion Withl.n the Fl.nance
Department
At its meetlng On December 13, 1983, the City Council
directed the Clty Attorney to prepare an ordinance to establish
the purchasing functlon of the Clty within the Finance
Department.
In response to thls direction, the accompanying
ordinance has been prepared and is presented for Cl ty Council
consideration.
In order to 1mplement the City Counc11' s dl.rectl.on, the
accompanYl.ng ordinance does the fol1owlng;
1. Re~eal of Municipal Code Sectlons 2224 and 2225.
These sectlons establ1sh the Purchasing Department as a separate
department of Cl.ty government headed by a Director of Purchasing.
In order to make the purchasing function a dlvislon of the
Flnance Department, these sectlons should be repealed.
2. Amendment of Munlcl~al Code Sectlon 2234. This sectl.on
estbl1shed the Finance Department as a department of Cl.ty
government.
The proposed amendment provides that the Purchasing
DivlSlon lS within the Fl.nance Department.

3. Amendment of Mun~cipal Code Section 2501. This section
has been amended to provide that the Purchasing Dlvislon is
headed by the Purchas~ng Agent and that the Purchas~ng Agent is
appointed by the Director of Finance in accordance wlth CiVll
service regulatlons.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordinance be introduced for first readlng.

AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
AMENDING SECTIONS 2234 AND 2501
OF THE SA~~A MONICA MUNICIPAL CODE
AND REPEALING SECTIONS 2224 AND 2225
OF THE SANTA MONICA MUNICIPAL CODE
IN ORDER TO ESTABLISH A PURCHASING
DIVISION WITHIN THE FINANCE DEPARTMENT
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1.
Sect10n 2234 of the Santa Monica Municlpal
Code is amended to read as follows:
Section 2234.
Finance Department.
Pursuant to Section 702 of the City Charter,
there is hereby created a department in the
City government to be known as the Flnance
Department.
Within the Finance Department
shall be the City Controller, the Clty
Treasurer, and the Purchasing Div1s10n.
SECTION 2.
Section 2501 of the Santa Monica Municipal
Code 16 amended to read as follows:

shall be adm1nistered by the Purchasing
Agent. The Purchas1ng Agent shall be
appointed by the Director of F1nance 1n
accordance with CiV1l serVlce regulations.
SECTION 3. Sections 2224 and 2225 of the Santa Monlca
Munic1pal Code are repealed.
SECTION 4. Any provis1on of the Santa Monica Munlcipal
Code or appendices thereto inconsistent with the prov1sions of
thlS ord1nance, to the extent of such inconsistencies and no
further, are hereby repealed or mod1fied to that extent necessary
to affect the provislons of this ordinance.
SECTION 5. If any section, subsection, sentence, clause,
or phrase of thlS ord1nance lS for any reason held to be invalid
or unconst1tutional by a deC1S1on of any court of any competent
]urisdict1on, such decls10n shall not affect the valid1ty of the
rema1ning portions of the ordinance. The Clty Councl1 hereby
declares that it would have passed this ordinance and each and
every sectlon, subsectlon, sentence, clause or phrase not
declared invalld or unconstitutional wlthout regard to whether
any portion of the ordinance would be subsequently declared
1nvalid or unconstitutlonal.

SECTION 6.
The Mayor shall sign and the Clty Clerk shall
attest to the passage of th~s ord~nance.
The City Clerk shall
cause the same to be published once ~n the off~c~al newspaper
with1n 15 days after its adoptlon.
The ordinance shall become
effectlve after 30 days from ~ts adoption.
