From: C1ty Staff
subject: Recommendatlon to Approve a Resolutlon Establlshlng

This report recommends approval of the attached resolutlon,
which establishes the City's Gann appropriation limlt for FY

~t
The SUbMlss10n of the attached resolut1on for FY 1983-84 was
delayed to
procedures
resolution
permlt time to review the various calculation
prevlously employed by City staff and to awalt State
of the Gann status of the Clty'S PERS contr1but1ons
as 1mpacted by the prov1slons of Proposition 13. Staff have
completed their reVlew and have appropriately revised the various
calculation procedures. Act10n on the ~mpact of Propos1tion 13
on the C~ty's PERS contrlbution and therefore the Gann status of
this contribution rema1ns unclear at this time. In light of these
factors, the Gann limit presented here1n has been calculated
consistent with conservatlve assumptions histor1cally followed by
the Clty.
DiscuSSlon
Based upon the instructions prov1ded by the State of
California Department of F1nance and var10US clarifying
gUldellnes, the Gann appropriation llmit of $32.0 m1ll1on for FY
1983-84 was computed and made available to the publlC for flfteen
days prlor to thlS meeting. The calculatlon of the llffilt 1S
detailed at Attachment A.
On June 21, 1983, the City Councll adopted the FY 1983-84
budget Wh1Ch 1nc1uded appropriations total1ng $97.0 million. Of
th1S amount, $30.8 IDllllon are approprlat1ons subject to
limitat1on. The calculat10n of the appropriatlons subJect to
llmltation 18 detailed at Attachment B ln tabular and chart
forms.
'..J -
Based on the calculations presented 1n Attachments A and B,
the C1ty 15 $1.3 m~llion below the Gann appropr1at~on limit.
It should be noted, however, that on April l4, 1981 the
Clty'S Gann appropriat1on lim1t was increased by voter approval
of Propos~tion A. The amount of the 1ncrease was $3.0 milllon
for FY 1981-82 through FY 1984-85 (as appropr1ately adJusted each
flscal year for changes ln the Consumer Price Index or Personal
Income,
and population) for the prov~s~on of addit10nal pollce
and other protective services necessary to reduce maJor cr1me 1n
the Clty. Hence, the City's total FY 1983-84 Gann appropriat10n
limit of $32.0 milllon 1ncludes $3.4 m1ll1on for overrlde
authorized services. The following table compares the overrlde
and regular, ongoing components of the total FY 1983-84 Gann
appropriation limit to correspond1ng components of the City's FY
1983-84 approprlations subJect to limitation:
Proposltion A Regular,Ongolng Total

SubJect to
Limit
Amount Under $ 1,041,962 $ 212,974 $ l,254,936
(Over) L1m1t
ThlS data indicates that durlng FY 1984-85, the City w1ll
have to deal with the override 1n one of three possible ways: a)
seek voter approval to contlnue the override, b) allow the
, ~
overrlde to terminate and elim1nate all appllcable appropriations
from the budget, or c) cont~nue the override programs w1th1n the
Clty'S regular, ongo1ng limit Wh1Ch may requ1re ellminating other
programs of up to equlvalent value.

The
determinat10n of the appropr1at1on limit 18 a
leg~slative act.
II-A
OCT 11 1963

The submission of the attached reso1ut1on for FY 1983-84 was
delayed to permit t1me to review the various calculation
procedures previously employed by C~ty staff and to awa1t State
resolut1on of the Gann status of the City's PERS contributions
as 1mpacted by the provis1ons of Proposit1on 13. Staff have
completed the1r review and have appropriately rev1sed the various
calculation procedures. Act10n on the impact of Proposit1on 13
on the City's PERS contr~but~on and therefore the Gann status of
this contribution rema1ns unclear at th~s t1me. In light of these
factors, the Gann lim1t presented herein has been calculated
consistent with conservat1ve assumptions historically followed by
the C1ty.
Discussion
Based upon the instructions provided by the State of
Cal1forn~a Department of F~nance and various clar~fy~ng
gU1delines. the Gann approprlatlon lim~t of $32.0 million for FY
1983-84 was computed and made ava11able to the public for fifteen
days pr10r to th1S meeting. The calculatlon of the lim~t ~s
detailed at Attachment A.
On June 21, 1983, the City Counc1l adopted the FY 1983-84
budget which 1ncluded appropriations total1ng $97.0 m1ll1on. Of
this amount. $30.8 million are appropr1at~ons subJect to
limitat1on. The calculation of the appropriations subject to
llmitation ~s detailed at Attachment B 1n tabular and chart
forms.
e
.
Based on the calculations presented ~n Attachments A and B,
the City is $1.8 mLllion below the Gann appropr1atlon lim1t.
It should be noted, however, that on April l4, 1981 the
City's Gann appropriation l~mit was ~ncreased by voter approval
of Propos~tion A. The amount of the increase was $3.0 milllon
for FY 1981-82 through FY 1984-85 (as appropriately adJusted each
fiscal year for changes in the Consumer Pr1ce Index or Personal
Income, and population) for the provis1on of additlonal pollce
and other protectlve services necessary to reduce maJor crime 10
the Clty. Hence, the City's total FY 1983-84 Gann appropriation
limlt of $32.0 m1llion 1ncludes $3.4 mill~on for overrlde
author1zed serV1ces. The following table compares the overr1de
and regular, ongo1ng components of the total FY 1983-84 Gann
appropr~at~on Ilmit to correspond1ng components of the C1ty'S FY
1983-84 approprlations subJect to lim1tatlon:

(Over) Llm1t
This data indicates that during FY 1984-85, the Clty will
have to deal with the overr1de in one of three posslble ways: a)
seek voter approval to continue the override, b) allow the
e
e
override to terffilnate and ellffi1nate all appllcable appropriations
from the budget, or c) continue the override programs wlthin the
C~ty's regular, ongo1ng llffi1t which may requlre el~mlnating other
programs of up to equivalent value.
