SUBJECT: BALLOT ORDER ORDINANCE
Introductlon
ThlS report transMlts an ordlnance establishlng
a totally random procedure for deternlDlng the ballot order
of candidates and ballot measures ln Santa Monlca Munlclpal
Elections.
Background
On December 12, 1978, the Clty Counell approved
several a~endments to Artlcle XI of the Santa Monica Municlpal
Code, relatlng to electlon practlces.
Among the changes was an aMendment to Sectlon 11214,
WhlCh establlshes ballot order procedures. The amendMent
requlres the Clty Clerk to choose the order of candldates
and measures at a regular meetlng of the Clty Cauncll not
later than the seventy-flfth (75th) day before an elect1on.
~~re this schedule followed, a pure random select10n method
could not be employed, as the nonlnatlon period does not close
untll after the required drawlng date. Therefore,lt 1S suggested
that the amended language be deleted fron the ordlnance, so
that our preV10us practlce of determinlng the ballot order by

random selectlon at the close of the nOffi1natlon period may
be followed. In thlS way, the const1tutlonallty of our pro-
cedure wll1 be insured.
Alternative Solutlons
The Clty Councll may adopt the proposed ordlnance
or may retaln the present procedure. ThlS would lnvolve the
drawlng by the Clty Clerk of letters representlng the f1rst
letter of the last name of cand1dates, and ass1gnlng the can-
dldates 1n the order that the1r representative letters are
chosen.
Recommendatlons
It 1S respectfully reco~~ended that the Clty Counc1l
adopt the proposed ordlnance, and restore ballot order pro-
cedures to the1r previous state. The City Clerk should be In-
structed to set a date for the drawlng of lots, and conduct the
draw1ng after nomlnatlons close. As the ordinance relates
to an electlon, lt lS effective 1mmedlately upon adoptlon under
Sect10n 619 (a) of the Santa Monlca C1ty Charter.

A change to Santa ;.10nlca Municlpal Code Sect ion 11214
was recently enacted WhICh would provide for a random
alphabetIcal drawing 75 days prior to an election. Th1S
change is an unnecessary departure from the method preVI-
ously used to determIne the order 1n whlch the candidates
and measures appear on the ballot. I, therefore, request
the adopt1on of an emergency ordinance to repeal the
aflendment to Code Section 11214 and a return to the procedure
which reqUired that the nafles of each candidate be drawn.

SECTION 1. Sectlon 11214 of the Santa Monlca
MunlClpal Code lS amended to read as follows:
SLCTIO~ 11214. BALLOT ORDER.
In any electlon for Clty Counc1l, School Board
of the Santa ~lonlca Unl fled School Dlstrlct or Board of
Trustees of the Comffiunlty College, the order ln WhlCh the
na~e shall appear on the ballot, shall be detern1ned by a
castlng of lots. The ballot order of all candidates, propo-
slt10ns and ballot measures shall be the sane as the order
Wh1Ch 15 drawn from sald lots.
SECTION 2. The Mayor shall slgn and the C1ty
Clerk shall attest to the passage of thlS ordlnance. The
Clty Clerk shall cause the same to be publlshed once lD the
offlc1al newspaper w1thln f1fteen (15) days after lts adoptlon.
~hlS ordlnance shall beco~e effect1ve ln~edlately upon adoptlon,
pursuant to Sectlon 619 (a) of the Santa Monlca Clty Charter,
as lt relates to an elect~on.
