Certification of "Save the Beach" Initiative
Attached is the letter which I received on August 15, 1989, from
the Registrar-Recorder. This letter refers to the "initiative
establishing a beach overlay district in the area bounded by the
Pacific Ocean on the west, by the city boundary on the North, by
the centerline of Ocean Avenue and Neilson Way on the East, and
by the City boundary on the South and prohibiting hotel, motel
and certain restaurant development in that district.1I
The petition contained signature representing 10% but less that
15% of the registered voters of the City of Santa Monica. Since
the 10% was met, according to Section 4011 of the Election Code
the Council has the following options:
"The Council may introduce the ordinance at that meeting and
adopt it within 10 days or call a special election for any
date at least 88 days after the order.
Call a special election for any date at least 88 days after
the order.
If it does neither, it must submit the ordinance to the
voters at the next regular municipal election occurring not
less than 88 days after the order, i.e., the next regular
Council election date, or after the legislative body is
presented with a report prepared pursuant to Section 4009.5"
of the Election Code.

Dear Mr. Patterson:
Attached are 1,110 booklets containing approximately 10,045
signatures for an initiative petition circulated in the City of
Santa Monica, entitled: !tAn Initiative Establishing a Beach
Overlay District in the area bounded by the Pacific Ocean on the
west, by the city boundary on the north, by the centerline of
Ocean Avenue and Neilson Way on the east, and by the City
boundary on the south and prohibiting hotel, motel and certain
restaurant development in that district," which were accepted by
me on July 19, 1989.
Please verify these signatures as soon as possible.
On May 13, 1989, the Notice of Intention to Circulate the
Petition was published. No signatures should be counted if the
petition was circulated before May 18, 1989.
The Registrar-Recorder has informed me that the number of
registered voters in Santa Monica as of May 13, 1989, was 56,133.
In order to meet the 15% requirement there would need to be 8,419
valid signatures.
