Amendments to the Memorandums of Understanding with the
Management Team Associates, the supervisory Team
Associates, the Administrative Team Associates and the
Santa Monica FireFighters, Local 1109, lAFF; and a
Resolution Adopting Salary Rates for certain
Classifications
INTRODUCTION
This report requests that Council adopt the attached Resolutions
authorizing the city Manager to execute amendments to the
Memorandums of Understanding with the Management Team Associates
(MTA), the Supervisory Team Associates (STA), the Administrative
Team Associates (ATA) and the Santa Monica Firefighters, Local
1109, IAFF.
This report also requests that council adopt the attached
Resolution setting the salary rates of Assistant Domestic Violence
Counselor, Domestic Violence Counselor, Systems Administrator and
Youth services Counselor.
BACKGROUND
A review of the job classes represented by the Management Team
Associates eMTA) revealed certain job classes that would be better
represented by the Supervisory Team Associates (STA) bargaining
unit. One of those job classes, Fleet Maintenance Superintendent,

became vacant. MTA agreed to open their MOU and allow the transfer
of that job class from their bargaining unit to STA. In addition,
as a part of the 1991 MOU negotiations between the city and MTA,
MTA agreed to release the job class of Recreation Supervisor, with
STA being designated as the appropriate bargaining unit for said
job class. The attached amendments to the MTA and STA memorandums
of understanding effect the transfer of those job classes from MTA
to STA.
The Memorandum of Understanding for the Library bargaining unit,
the Library Guild & Library Non-Professionals, AFSCME, Local 1634,
expired as of June 30, 1992. On September 9, 1992, the members of
that bargaining unit voted to decertify. As a result of the
decertification of the Library bargaining unit, each of the Library
job classes must be transferred to an existing City bargaining unit
which would most appropriately represent that job class based on a
community of interest between the job class being transferred and
the job classes already represented by that bargaining unit.
The supervisory Library job classes are being transferred to the
Supervisory Team Associates (STA) bargaining unit. STA agreed to
open their MOU, and negotiations commenced to amend the STA MOU in
such a way to accommodate some unique working conditions (e.g.,
split shift differential) of the supervisory Library employees.
The result of these negotiations is the attached amendment to the
STA MOU.
The professional Library job classifications are being transferred

to the Administrative Team Associates (ATA) bargaining unit. ATA
agreed to open their MOU, and negotiations commenced to amend the
ATA MOU in such a way to accommodate some unique working conditions
(e.g. split shift differential and overtime for regular work hours
scheduled on Sunday) of the professional Library employees. The
result of these negotiations is the attached amendment to the ATA
MOU.
In addition, as a part of the most recent MOU negotiations between
the city and the Santa Monica Municipal Employees Association
(MEA), MEA agreed to certain jOb classes being transferred from the
MEA bargaining unit to the bargaining unit represented by the
Administrative Team Associates (ATA).
In addition, an equity
adjustment was negotiated for four of the ten jOb classes being
transferred to ATA.
The four job classes for which an equity
adjustment was negotiated are:
Assistant Domestic Violence
Counselor, Domestic Violence counselor, Systems Administrator and
Youth Services Counselor.
The attached salary Resolution
establishes the adjusted salary rates for said jOb classes. The
attached amendment to the ATA MOU transfers all of the affected job
classes from MEA to ATA.
The Santa Monica Firefighters, Local 1109, IAFF (hereafter referred
to as Local 1109), petitioned to represent the jOb classifications
of Fire Prevention Inspector and Fire Prevention Engineer. At the
time of the petitions, these job classifications were represented
by the Santa Monica Municipal Employees Association (MEA). It was
the determination of the city Manager, as the Municipal Employee
Relations Officer for the City of Santa Monica, that there was
sufficient community of interest among the Fire Prevention
Inspector and Fire Prevention Engineer classes and the classes
currently represented by Local 1109, and the petition was thereby
granted. The incumbents in the affected classes of Fire Prevention
Inspector and Fire Prevention Engineer provided the Ci ty wi th
written notification that they wished to be represented by Local
1109. The attached Resolution amending the MOU between the city
and Local 1109 effects the transfer of the Fire Prevention
Inspector and Fire Prevention Engineer classes from MEA to Local
1109.
BUDGET/FINANCIAL IMPACT
Funds are included in the budget for fiscal year 1992-93 to cover
all salary costs related to adoption of the attached Resolutions.
RECOMMENDATIONS
It is recommended that city council adopt the attached resolutions
amending the Management Team Associates (MTA), the supervisory Team
Associates (STA), the Administrative Team Associates (ATA) and the
Santa Monica Firefighters, Local 1109, IAFF memorandums of
understanding. It is also recommended that city Council adopt the
attached resolution setting the adjusted salary rates for Assistant
Domestic Violence Counselor, Domestic Violence Counselor, systems
Administrator and Youth Services Counselor.

CITY OF SANTA MONICA AUTHORIZING THE CITY MANAGER.
TO EXECUTE AN AMENDMENT TO THE

WHEREAS, the City administration and representatives of
the Administrative Team Associates have met and conferred under the
terms of Ordinance No. 801 (CCS) and have reached agreement on an
amendment to the current Memorandum of Understanding covering the
wages, hours and other terms and conditions of employment; and
WHEREAS, Section 2.06 of Ordinance No. 801 (CCS) of the
City of Santa Monica requires preparation of a written Memorandum
of Understanding, including any amendments to said Memorandum of
Understanding, between the administration and employees if an
agreement can be reached; and
WHEREAS, Section 2.06 of Ordinance No. 801 (CCS) further
provides that any such Memorandum of Understanding, and any
amendments to said Memorandum. of Understanding, shalL not be
binding unless and untiL presented to the governing body for
determination; and
WHEREAS, the purpose of the Memorandum. of Understanding,
and any amendments to said Memorandum. of Understanding, is to
promote and provide harmonious relations, cooperation, and
understanding between the the city and the Administrative Team
Associates;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FO~~~WS:
section 1. The City Council of the city of santa Monica
does hereby approve and authorize the city Manager to execute the
amendment to the Memorandum of Understanding executed by the
Administrati ve Team Associates, a copy of which is attached hereto.
Section 2. The City Clerk shall certify to the adoption

be in full force and effect.

The term of the current Memorandum of Understanding (MOU) between
the city of santa Monica and the Administrative Team Associates is
from July 1, 1991 through June 30, 1993. Both parties to said MOU
agreed to reopen the MOU for the purpose of meeting and conferring
to modify certain sections of the MOU. The modifications to the
MOU which have been agreed to by both parties are set forth herein.
Said modifications to the MOO shall be effective as of July 1,
1992. Except as specified below, the remainder of the Memorandum
of Understanding remains unchanged.

2.06 Shift Differential
Current MOU language remains unchanged. Add the following
paragraph.
For employees covered hereunder who hold permanent
positions at the Library, the following MOU language shall
apply in lieu of the shift differential provisions listed
above:
4.01
A. A night shift differential of forty (40) cents per
hour shall be paid to any line-item employee whose
regular schedule requires the employee to work between
the hours of 5:30 p.m. and 9:00 p.m., provided that
such differential shall be paid only for such hours
worked between 5:30 p.m. and 9:00 p.m.
B. A differential of forty (40) cents per hour shall be
paid to line-item employees covered herein for all
regular hours worked in a shift which is divided into
two (2) parts by three (3) or more hours of non-
working time as a part of the scheduled shift. Such
differential shall not be paid in addition to night
shift differential or for overtime hours beyond the
scheduled shift.
Paid Holidays
Current MOU language to remain unchanged. The following
sentence is to be added following the listing of paid
holidays.
In addition, the Library shall close by no later than 5:30
p.m. on the day before the Thanksgiving holiday and the day
before the New Year's Day holiday.

1109, IAFF 1 is from July 1, 1992 through June 30, 1994. Both
parties to said MOU agreed to reopen the MOU for the purpose of
meeting and conferring to modify certain sections of the MOU. The
modifications to the MOU which have been agreed to by both parties
are set forth herein. Said modifications the the MOU shall be
effective as of July 1, 1992. Except as specified below, the

A. Recoanition - The city recognizes Local 1109 of the
International Association of Firefighters (IAFF) as
the recognized bargaining agent for the employees in
the following job classifications:
Battalion Chief
Fire captain
Fire Engineer
Fire Fighter
Fire Prevention Engineer
Fire Prevention Inspector
It is the mutual understanding of the parties that
acknowledgement of Local 1109 as the recognized
employee organization:
(1) Current MOU language remains unchanged
(2) eurrent MOU language remains unchanged
As a result of a petition of accretion of the Fire
Prevention Inspector filed by Local 1109 and a written

requesting that they be represented by Local 1109, the
City recognizes Local 1109 as the recognized
bargaining agent for employees in the Fire Prevention
Inspector job classification as of July 1, 1992.
Incumbents in the Fire Prevention Inspector job
classification as of July 1, 1992 shall be
"grandfatheredll as Fire Prevention Inspectors and
shall be covered by the terms and conditions of this
Agreement. However, all vacancies in what would have
been the Fire Prevention Inspector job classification
shall be filled by Firefighters, with the Fire
Prevention Inspector job classification being
eliminated once all of the employees who have been
tlgrandfatheredu as Fire Prevention Inspectors have
vacated those Fire Prevention Inspector positions. In
addition, all incumbents in the Fire Prevention
Inspector job classification who are Ugrandfathered"
must obtain a Fire Prevention Officer III
certification from the state Fire Marshall by no later
than June 30, 1994. Any Fire Prevention Inspector who
fails to meet this position requirement by that date
shall have his/her employment with the city
terminated. Said termination shall not be considered
disciplinary in nature but shall be based on the
employee's failure to meet minimum job requirements.
As a result of a petition of accretion of the Fire
Prevention Engineer filed by Local 1109 and a written
statement signed by the current incumbent in the Fire
Prevention Engineer job classification requesting that
he be represented by Local 1109, the City recognizes

employees in the Fire Prevention Engineer job
classification as of July 1, 1992. Incumbents in the
Fire Prevention Engineer jOb classification as of July

COUNSELOR, SYSTEMS ADMINISTRATOR, AND YOUTH
SERVICES COUNSELOR
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. The following monthly salary levels are hereby
established for the indicated permanent classifications, effective
July 1, 1992:
ASSISTANT DOMESTIC $3,573/Month E-Step
VIOLENCE COUNSELOR ($3,823/Month with PERS)
