SUBJECT: Appeal, Interlm Development Permit No. 146, 2222

Introductlon
On August 9, 1983, the appeal of the Planning Commlsslon's denlal
of DR 146 was presented to the Clty Council. The applicant was
not present and the appeal was denied. At the request of
Councilmember Dav1d Epstein, the Councl1 agreed to reconslder the
ltem with the appllcant present.
Background
The proposed project 1S the same as was presented to the Councll
on August 9, 1983. The staff report prepared for that meet1ng is
attached. Also attached 1S a letter from the appllcant's attorney
Wh1Ch reiterates the terms__and condit1ons to WhlCh the applicant
lS will1ng to agree. This department has been unable to confirm
support for th1S agreement from the Seventh and Strand
ne1ghborhood organ1zat10n.
The Plann1ng Commission, in denying the project indicated to the
appl1cant that if he wished to pursue the matter further, he
should meet wlth concerned residents of the area to address the
lssues raised and resubmit a revised project to the Planning
COInmlssion.

The proJect has been modif1ed to specify uses wh1ch w111 not be
lncluded, but reV1S1ons have not addressed plann1ng questions
of site design and conformance to the proposed Land Use Element
pol1cies, spec1f1cally the Land Use Element des1gn issue of the
build-to line with parking ln the rear, or the provision of a
broad landscape buffer along Lincoln Boulevard.
Budget/Financlal Impact
The recommendations presented 1n th1S report do not have a budget/
f1nancial impact.
Recommendatlon
It 1S respectfully recommended that this appeal be denied and
that the appl1cant be encouraged to submit a rev1sed proJect to
the Planning Commiss1on for cons1deration.
