ThlS report presents b3ckground lnformatlon about the current CIty POlICY of protestlng all llquor license applIcatlons on Maln S~reet; descrIbes the Callfornla AlcohollC Beverage Control Department llcenslng and protest procedures; descrIbes the 0ur- rent status of licenses on Maln Street and the Clty'S p~otest actlons taken SInce November 1979; dlscusses Clty Council actlons subsequent to staff's fIling of official protests; outllnes alternative Maln Street llcense pollcles; and recommends a speCIfIc MaIn Street lIcense policy for the near future. Because the Issue of llquor llcenses on Maln Street is part of the larger Issue of controlllng alcohol outlets throughout the CIty, thIS report also recommends that a CityWide POllCY on alcohol o~tlets be prepared and that future polICIes for Main Street be compatlble wlth that CItywlde POlICY. II-E NOV 2 2 1983 1 Mayor and Clty CO~~l ~ember 22. 1983 BACKGROUND On November 27, 1979, the Clty Coun~ll approved a motlon lnstructlng staff to protest to the Alcohollc Beverage Control Department (ABC), 10 the name of the City, the issuance of any on-sale or off-sale 11quor llcenses (lncludlng the transfer of lIcenses) 1n the Main Street area pendlng the completlon of the MaIn Street Plan and adoptlon of a zonIng ordInance to gUIde development on MaIn Street. The ~aln Street Plan was prepared and approved by the ~aln Street PlannIng Group, WhlCh Included Ocea'1 Park resldents and ~aln S~reet mCich3nts, on June 6, 1930. Based O~ the Malo Street Plan, staff prepared recommended zonIng st.andards for the "eM" Maln Street Sp~clal Commerclal Dlstrlct for the area WhlCh were adopted by the Clty Councll on September 10, 1930 {see Attachment A: SectIon 9119 of the Munlclpal Code). Pendlng further instructIons from Clty Council, Clty staff has contlnued to protest all ap~llcatlO:1S In toe area. NeIther the Maln Street Plan nor the current "CM>> MaIn Street Speclal Comm~rclal Dlstrict regulatlO~S dIrectly address the 1ssuance of llquor llcenses per se 1n the Maln Street area. The Plan and the "CM,>> zonIng regulatlons focus o.'11y on the number atJd locatIon of bars and restaurants In tDe nelghbor~ood. These regulatlons were p~lrn3rlly Intended to mInlmize the nOIse and congestlon resultlng from too great a denSIty of these uses. The Plan and "CM>> zonlng regulatlons reqUIre a condltlonal use permit (CUP) for all bars and restaura~ts wlth 50 or more seats. 2 Ie Mayor and Clty coultll e November 22, 1983 The "eMu zonlng regulatlons permlt only two restaurants per block along Maln Street from PlCO Boulevard to the southern Clty llmlt thus llmltlng the total number of restaurants to 22. On 1 y 1 2 bars are permltted to be located 1n the area, wlth 7 perm1tted south of Ocean Park Boulevard and 5 permitted north of Ocean Park Boulevard. Th1S llmIt on the number of bars was lntended to permIt eXlstlng bars to remain but to llmlt the number of new bars allowed to locate In the nelghborhood. There are currently 19 restaurants and 5 bars on Maln Street. Because they ~ere eXlstIng at the tIme the "CM~ zonIng regulatlons were adopted, all of these establlshments are perm1tted to remaln on Maln Street. However, 6 of the these restaurants would not be permltted to locate on Maln Street today SInce they are located on blocks wlth more than two restaurants LIquor stores in Wh1Ch more tha'l 50S of the dlsplay area (Shelf space) is devoted to alco~ollC beverages are permitted only upon the Issuance of a CUP but no denSity or locatlon llmitatlons are stated In the "CM" zonIng regulatlons. The "CtJI" zoning re3ulatlons do not state any speciflC regulatlons or llmltatlons for retall stores or food markets that sell alcohollC beverages. ALCOHOLIC BEVERAGE CONTROL PERMITS AND PROTEST PROCEDURES Artlcle XX, Sect10n 22 of the Callfornla Constltutlon glves the California Department of Alcohollc Beverage Control (ABC) the exclUSlve power to license and regulate the sale of alcohollc beverages 1n the State for consumptlon elther on or off the premIses belng llcensed (on-sale and off-sale respectIvely). The 3 I Mayor and CIty COU~l .ember 22, 1983 seven categorIes of on-sale and off-sale lIcenses most relevant to Santa MonIca are: o on-sale general for publIC premIses (bar) authorlzes the sale of all types of alcohollC beverages on the premIses, o on-sale beer and WIne for pUblIC premIses (beer and Wlne bar) authorIzes the sale of only beer and WIne on the premIses, o on-sale beer for pUblIC pre~lses (beer bar) authorIzes the sale of only beer on the premIses, o on-sale g~~ral for bona fIde pUblIC eatIng place (a restaurant) authorIzes the sale of all types of al'~ohollC beverages in the restaurant, on-sale beer authorIzes restaurant. o off-sale 6eneral (lIquor store) authorlzes the sale of all types of alcohollc beverages for consumptIon off the and WIne for bona fIde the sale of only beer eating and place o WIne 1n the premIses In orIgInal, sealed contaIners, o off-sale beer and wine (lIquor store) authorIzes the sale of only beer and Wlne for consump"-lon off the premIses In orlglnal, sealed contaIners. The ABC can eIther approve, condItIonally ap~rove, deny, suspend, or revoke any lIcense for good cause. In addltlon to denYIng a lIcense based o~ the actIons or crImInal re~orj of the applIcant, the ABC ~~ also deny a lIcense when any of the follOWIng condItIons or characterIstICS occur at a partICUlar 10catIO~; 4 e Mayor and CIty CouncIl . November 22, 1983 o the premlses IS located In a high crime area (20% more reported cr1me per populatIon than the cIty average) and there IS an overconcentration of alcohol outlets. Th e ABC IS cautlOUS 1n uSIng thIS reason. (Overconcentratlon is generally, more than lIcense per 800 resIdents In a census tract for on-sale lIcenses and 1 lIcense per 1040 res1dents In a census tract for off-sale licenses. Based on these ABC densIty standards, each census tract WhICh COmprISeS the OceaD Park ne1ghborhood, tracts 7020 and 7021, cculd conta1n 7 on-sale and 5 off-sale alcohol outlets based on theIr 1980 Census populatIon. Census tract 7020 north of Ocean Park Boulevard currently has about 6 on-sale and 5 off-sale alcohol outlets on Main Street and on the west side of LIncoln Boulevard WhICh IS the boundary for the census tract and census tract 7021 south of Ocean Park Boulevard currently has 22 on-sale and 3 off-sale alcohol outlets.); o the premIses IS located WIthIn 200' (for an off-sale llcense) and WIthIn 600' (for an on-sale lIcense) of a school, public playground, church, or hOspItal ~~ it can be shown that the Issuance of a permlt would be contrary to publlC welfare and morals; o the premIses are wIthln 100' of a residence and the appl1cant IS unable to establIsh that the operatlon of the premIses Wlll not Interfere with the qUiet enjoyment of the property by res1dents; or 5 + Mayor and Clty COU~l ~ember 22, 1983 o the lIcensIng of the premIses would be contrary to a valid zonIng ordInance that regulates the locatIon or denSIty of alcohol outlet s. Any person may protest the Issuance of a lIquor lIcense. Local agencIes may protest the Issuance of lIcenses but must state reasons for requestIng a denIal such as a possIble Increase In crIme or an aggravatIon of a parkIng shortage that would result from Issuance of tne liquor lIcense. A protest must be made within 30 days from t.he first date that a notIce of application to sell alcoholIC beverages (or notIce of applIcatIon fo~ o~ner- ShIP change) IS posted on the premIses. The applIcant may wIthdraw hIS or her applIcatIon In WhIch case he or S!1e may not fIle a new applIcatIon for the same premIses for one year and all protests remaIn valId for one year agaInst subsequent applications for the premises filej by other persons. The ap~llcant may also requast a hearIng before an Aj~lnlst~atlve Law Judge of the OffIce of AdmInIstratIve HearIngs who wlll fIle a proposed declslon wIth the ABC for Its conSIderatIon and fInal actIon. The ABC also has the authorIty to monltor and enforce code prOVIsIons and lIcense condItIons. Local JurIsdIctIons have the rIght to InItIate lIcense reVQC2tlon hearIngs by shOWIng vIolatIons of speCIfIc ABC codes a~d standards. However. the ABC has had staff and budget cutba~k5 and has placed lo~est prIorIty on lIcensee '1l0nItorIng and code enforc~mentt leaVIng thIS functIon prImarIly up to local Jurlsdlctlons. 6 Mayor and CIty COU~Il ~ember 22, 1983 MAIN STREET ALCOHOL OUTLETS AND PERMIT PROTESTS AccordIng to the ABC there are currently 29 alcohol permits for businesses on MaIn Street. These include: o 5 on-sale general for publIC premIses (bar) o 0 on-sale beer and Wine for public premises (bar) o 9 on-sale general for bona fide eatIng place (restaurant) o 9 on-sale beer and Wine for bona fIde eating place (restaurant) o 3 off-sale general (lIquor or retaIl store sellIng alcoool) o 3 off-sale beer and WIne (lIquor or retaIl store selling alcohol) (See Attachment B: MaIn Street LIquor LIcenses) SInce November 1979 when the Council dIrected staff to protest all new and transferred liquor llcensest the Pla'1nlng DIrector has protested approxImately 16 applIcatIons for licenses on MaIn Street on behalf of the CIty. Attachment C lIsts the premIses and bUSInesses for WhICh liquor llcenses were protested. FIve of the appllcatlons were wlthdrawn by the appllcant as a result of the protest. Two appllcants requested and receIved hearIngs before Ad~lnlStratlve Law Judges. One protest was sustalned by the Judge and the ABC denied the lIcense appllcatlon. The other CIty protest was denIed by the Judge and the ABC awarded the lIcense WIth several conditlons regardIng the 7 e e ~ayor and Clty Councll November 22, 1983 hours of operatlon and the transferabillty of the type of permlt approved for the premIses. One appllcatlon was protested by the CIty and the lIquor license was not Issued by the ABC. Three protests were wlthdrawn by staff and the ABC approved the llcenses. (Two of the protests were wlthdrawn In 1980 and the reason for wlthdrawlng the protests is not clear from Clty records. One of the bUSlnesses has closed. The third protest was wlthdrawn because the llquor llcense was for a business that was slm1lar to a bUSlness for wh1ch the C1ty Council had recently wlthdrawn the C1ty'S protest.) Act10n on the remaIning fIve appl1cat1ons IS ou~llned below. CITY COUNCIL ACTIONS ON PERMIT PROTESTS The rema1nIng fIve of the 16 appllcants for llquor llcenses requested that the CIty Councll reVIew the C1ty's protests of the1r appllcat1ons. In all fIve cases, the C1ty CouncIl requested that staff wlthdraw the C1ty'S protest for one or more of the followIng reasons: o the off-sale of the W1ne was InCIdental to a food market's operatlon, o the off-sale of WIne was to be 1n gIft packages and not for sale as separate bottles, o the two on-sale licenses were for two restaurants that occupled space WhlCh at one tIme contaIned a SIngle restaurant connected by a rear patIo, and o the on-sale general license was for a restaurant WhICh was 8 e e Mayor and Clty CouncIl November 22, 1983 belng taken over by a new owner. It would appear from these actIons taken by the Councll that a llquor Ilcense POllCY dIrectlon has been set for Maln Street. ThlS POlICY dlrectlon IndIcates that the Clty does not oppose llquor lIcenses for restaurants currently permltted by the Maln Street Plan and "CM" zonIng regulatlons and the Councll also does not appear to oppose llcenses for retaIl and food stores that are clearly not llquor stores. (The CouncIl's POllCY on bars IS already stated by lts approval of the llCV,lT zonlng regulatlO'-"S WhICh Ilmlt thelr number to 12.) GENERAL PLAN REVISIONS The Clty IS currently preparIng a revIsed Land Use Element of the Santa Monlca General Plan. In response to some communlty concerns about a prollferatlon of bars and llquor stores, the draft Land use Element wlll contaIn recommended pollcles tha~ state that these and other potentlally ObjectIonable uses be lImIted. Future studIes and ZonIng Code amendments would be requlred to Implement thls general p0l1CY. ALTERNATIVE MAIN STREET ALCOHOL OUTLET POLICIES There appear to be three alternatlve llquor llcense policles for Maln Street: 1) Malnt.aln the current POllCY and request that staff contInue to protest all appllcatlons for ne'.. and transferred liquor llcenses for busulesses on MalD StreeT... The appl1.cant would 9 e e Mayor and City Council November 22, 1983 either withdraw hIS or her applIcation or request the CIty CouncIl to withdraw the CIty'S protest. ThIS POlICY alternative does not appear to achieve the POlICY objectives Indlcated In the Maln Street Plan or implIed by recent CIty CouncIl actIons. 2) DIrect staff to discontinue protests of applicatIon for new or transferred lIquor licenses for buslnesses on Main Street and rely on the ABC's Judgement. ThlS alternatIve could result In exceSSive alcohol outlets on Main Street. The number of bars and restaurants servlng alcohol would be lImited by the prOVisions lr, the "C~" zoning regulatIons (22 restaurants and 12 bars) and the number of lIquor stores could be controlled by CIty actIons SInce liquor stores on Main Street reqUire a condltlonal use permlt. However, other types of retail stores that mIght apply for llquor licenses would be unregulated by the CIty as to location and denSity and the CIty would not protest the lIcense applIcatIons. The ABC would use Its own crIterIa In apprOVIng or denYIng the llcense;but, because the ABC usually reqUIres that at least two condltlons be present before conSidering to deny a lIquor lIcense} It gener all y approve s rather than den les lIcense s (see p. 5 for the condltlons under WhlCh the ABC may deny a lIcense). 3} Dlrect staff not to protest those license applications for bars and restaurants that comply With the current "CM" Maln Street SpeCial Commercial District zoning regulations or for llquor stores that have recelved a CUP, but contlnue to protest all other retail llquor outlets untIl a CitYWide POlICY for these types of outlets can be adopted. ThIS POlICY alternative 10 e e Mayor and CIty Council November 22, 1983 would be compatIble wIth community concerns regarding bars, restaurants, and lIqUOr stores and would help to prevent a prolIferatIon of alcohol outlets on MaIn Street before adoptIon of a CItywIde POlICY on alcohol outlets that would also apply to Main Street. BUDGET/FISCAL IMPACT The recommended actIon presented In thIS report does not have a budget/fIscal Impact. R E C 0 r~ MEN r; A T I G N It IS respectfully recommended that the CIty CounCIl approve POllCY alternatIve 3 and take the followl~g actIons: 1) DIrect staff not to protest any new or transferred on-sale general or beer and Wine lIcense for busInesses on MaIn Street If: a) the lIcense IS for an eXIstIng bar or restaurant that has operated legally Since the Main Street zonIng regulatIons were adopted or b) the lIcense IS for a new bar or restaurant that meets the denSItIes Included In the MaIn Street zonIng regulations or has been approved by the City to exceed those denSItIes; 2) DIrect staff not to protest a~y off-sale general or beer and WIne lIcense for a liquor store that has receIved a condltlonal use permIt and request the ABC to attach any CIty CUP condltlons to ltS approval of the lIquor lIcense. These condltlons could Include restrlctlons on hours of operation, provislon for 1 1 e e Mayor and CIty CouncIl November 22, 1983 securIty and polIcIng of the premIses, and other measures to reduce the potentIal for alcohol related problems at the sIte. 3) Direct staff to continue to protest all other applIcations for liquor lIcenses on MaIn Street untIl clear CitywIde standards for other types of alcohol outlets (such as retaIl stores and markets) can be developed. 4) DIrect staff to reVIew and recommend, immedIately followlng adoptIon of the Land Use Element In April 1984, appropriate denSIty or location standards for lIquor stores and other retaIl stores that sell alcoholIC beverages 10 all commercIal areas of the CIty IncludIng Main Street and the appropriate methods to reVIew and/or approve these stores.
