TO: SUBJECT: Certification of Santa Monica Environmental Protection Initiative Attached is the verification I received on August 30, 1989, from the Registrar-Recorder regarding the validation of the petition entitled: "Initiative establishing a three year citywide moratorium on hotel development, establishing a beach overlay district in the area bounded by the Pacific Ocean on the west, by the city boundary on the north, by the centerline of Ocean Avenue and Nielson Way on the east, and by the city boundary on the south (with certain exceptions), and restricting fifty percent of the transient occupancy tax generated from hotels in the beach overlay district and at 415 Pacific Coast Highway for Clean-up of the Santa Monica Bay and for park improvements.1I The petition contained 9,530 signatures, 6,813 of the signatures qualified, 2,717 did not. The number of registered voters on file with the Secretary of State on the date of publication of IIIntent to Circu1atell was 56,133. The petition, therefore, contains signatures representing more than 10%, but less than 15% of the registered voters. Election Code Section 4011 provides the following options upon certification of less than 10%: If the ordinance petitioned for is not required to be, or for any reason is not, submitted to the voters at a special election, and is not passed without change by the legislative body, then the ordinance, without alteration, shall be submitted by the legislative body to the voters at the next regular municipal election occurring not less than 88 days after the order of the legislative body, or after the 11- L - 1 - SEP - 5 1989 e e legislative body is presented with a report prepared pursuant to Section 4009.5 The petition contained the following instructions to the City Council: We, the undersigned, are registered and qualified voters of the City of Santa Monica, County of Los Angeles, State of California, constituting not less than 15% of the voters of the City of Santa Monica. We present to the city Council of the City of Santa Monica this petition and respectfully request that the above proposed ordinance for the City of Santa Monica be submitted immediately to a vote of the people at a special election or, if we constitute not less than 10% of the voters of the city of Santa Monica, and the above ordinance is not required to be, or for any reason is not, submitted to the voters at a special election, then we request that it be submitted to a vote of the people at the next regular municipal election. It is the intent of the undersigned that the above proposed ordinance is an alternative to an initiative ordinance proposed by the Save Our Beach Committee and that the proposed initiative be submitted to a vote of the people at the same election held to consider the initiative ordinance proposed by the Save Our Beach committee.
