Introductlon
ThIS report transmlts a request to CIty CouncIl from General Telephone Company
of California to waive fees for instructional films and video tapes produced
by the General Telephone Company In Santa MonIca,
Background
ResolutIon 4740 eCCS) states that the fee charged for the issuance of a per~1t
for the fllmlng of commercIal motIon plctures, commerclal teleVISIon fIlms,
or commercIal StIll photography on City property IS $100 per day for educatIonal
f11ms. An educational f11m IS defined by the resolutlon as ..."one WhICh
provldes Instruct1on, especlally for students, ult1mately IIm1ted to class-
room use, and a fIlm for wh1ch no adm1ss1on charges wlll be made"
The purpose of the resolutIon was to collect a fee from educat10nal f11ms
for which there IS to be a proflt.
The General Telephone Company of Cal1fornia produces approxlmate1y 100 VIdeo
tapes (114 In 1977) and four f1lms each year. Of these, approxImately th1rty
vldeo tapes and f11ms are used for educational purposes. They are used solely
for the 1nstruction of General Telephone's employees; no flnanc1al prof1t 1S
made by the showing of these f1lms and vldeo tapes.
The General Telephone Company of Cal1fornla w1shes to be made exempt from
paying the $100 permIt fee on f1lms and video tapes made only for trainIng

purposes of thelr own employees. These fl1ms and vldeo tapes would
be produced entlrely ln the C1ty of Santa Mon1ca and would be shown
only ln the C1ty of Santa ~on1ca to employees of General Telephone.
The General Telephone Company 1S wlll1ng to sign an agreement stat1ng
that they would not sell, lease or rent any of these educatlonal fllms.
TIns statement would read "This f21m 1S and shall not be made for the
purpose of sale, lease or rental, and shall not be sold, leased or
rented hereafter.1I It should be noted that 1f this walver was granted
there would be an approX1mate revenue loss to the City of $3,000 per
year.
Recommendatlon
The current resolution does not provlde for the exempt10n of fees for
educational f1lms
Staff recommends that the Clty Council exempt
General Telephone Company from the mandatory $100 fee; and that an
approval of a speclal exemptlon be drawn up by the Clty Attorney.
