Background
After publlC hear1ng and careful reVlew of the record and staff recomwendatlons,
the C1ty Planning Commlsslon aporoved the Tentatlve Map for the above project.
The action of the Plann1ng Commisslon was based on 1tS find1ng trat the ~rc-
posed subdiviSlon should cause ~o substantlal e~v1ronmental damage and 1S i~
conformance wlth all state and local laws and regulatlons and appl1cab1e Ge~eral
Plan Elements. The F,nal Map conforms to the Tentat1ve Map. The License D1vlSlon
reports that the developer has e,ther pald or agreed to pay the concomlnlum tax.
T1e BUlld1ng and Safety and Fire Departments lndlcate that the project ~eets
present f1re safety requ1rements. Aoproval by the County E~gineerJs office nas
been recelved for the proJect.
The subdlviders purchased the property June 18. 1980. Exemptlon from reg1stration
had been granted for the sln91e-fa~11y home on the property ~ay 17, 198Q. The
house was moved from the property 1n June 1980. A building DenM1t has not been
issued for the slx-unlt proJect.

Alternatives
1. Approve the final subdivision map if the Clty Council finds that the final
subdivision map is in substantial compliance with the tentative subdivision
map.
2. Disapprove the fina1 subdivision map if the City Counci1 finds that the
final subdivision map is not in substantial compliance with the tentative
subdivision map or if the Clty Council makes any of the findings set forth in
Government Code Section 66474,
Recommendation
It is respectfully recommended that the final map be approved unless the
Council makes the required findings for denlal set forth in Section 66474 of
the Government Code,

RESOLUTION NO. 6277
(CITY COUNCIL SERIES)
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA CONFIRMING
THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING GUTTER DISTRICT
NO. 4 ON MAIN STREET BETWEEN PIca
BOULEVARD AND HOLLISTER AVENUE AND
GUTTER DISTRICT NO. 5 ON BROADWAY
BETWEEN LINCOLN BOULEVARD AND
ELEVENTH STREET
WHEREAS, the City Council of the City of Santa Monica,
pursuant to Section 5870 et sea. of the Streets and Highways
Code. commenced proceedings to cause the construction of concrete
gutters on Main Street between Pica Boulevard and Hollister
Avenue and on Broadway between Lincoln Boulevard and Eleventh
Street in the City of Santa Monica; and
WHEREAS. the Superintendent of Streets served the
notice required by Section 5876 of the Streets and Highways Code
and the City Council of the City of Santa Monica held the hearing
required by Section 5878.1 of the Streets and Highways Code; and
WHEREAS, sixty (60) days after the notice was served,
the work had not been completed by the owners or persons in
possession of the affected properties, and the Superintendent of
Streets caused the work to be done; and
WHEREAS, the Superintendent of Streets gave the notice
required by Section 5881 of the Streets and Highways Code; and
WHEREAS, the Superintendent of Streets did file with the
Clty Council of the City of Santa ~onica his report of

construction and cost as required by Section 5882 of the Streets
and Highways Code; and
WHEREAS, upon the day and hour fixed for hearlng by
Resolution Number 6252 (CCS) the City Council of the City of
Santa Monica heard and passed upon the report of the
Superintendent of Streets together with all objections and
protests as required by Section 5883 of the Streets and Highways
Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF S~NTA
MONICA DOES RESOLVE AS FOllOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore filed and above-described be and the same is
hereby confirmed.
SECTION 2. That all protests and objections of every
kind and nature to the report of the Superintendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the construction, as set
forth in the report of the Superintendent of Streets, shall be
assessed against the properties therein described, WhlCh
properties front upon the gutters so constructed.
SECTION 4. That if such assessment is not paid within
the time permitted by law, the same shall constitute a special
assessment against and lien on the properties therein described,
in the amount set forth in the report of the Superintendent of

Streets~ which 1 ien shall continue until the assessment and al1
interest thereon is paid or until it is discharged of record.
SECTION 5. That if the assessment is not paid within
the time perm1tted by law, the Superintendent of Streets, in
accordance with Section 5893 of the Streets and Highways Code,
shall deliver a Notice of Lien, prepared in the manner required
by Section 5891 of the Streets and Highways Code, to the County
Auditor who shall collect the assessment together with all other
taxes against the property.
SECTION 6.
That the City Clerk shall certify to the
adoption of this resolution and thenceforth and thereafter the
same shall be in full force and effect.
