The report reVlews C1ty and County regulation of vendors and summar1zes how a number of other clt1es approach this issue. The report recoID~ends that a carefully structured demonstrat1on vendor program for Santa Monica P1er be implemented for one year and evaluated. If this evaluatlon concludes that the vendor program produces clear beneflts to the City, it 1S further recommended that Councll conslder approvlng vendor programs for other locatlons. The purpose of this demonstratlon vendor program lS to determ1ne the value of vendors 1n provldlng lmproved shopplng opportunit1es through expand1ng the varlety of avallable goods. Other potentlal beneflts lnclude 1ncreased Clty revenue and an enhanced pedestrlan envlronment. The trlal perlod wlll also allow evaluatlon of Clty'S ablllty to enforce vendor requlrements deslgned to m1tigate problems frequently clted by opponents of vendors. Back9round Street vendors sell1ng food and commerc1al products from mob1le AUG 2:1 1'983 and statlonary displays, and pushcarts (hereafter "vendors") I/-A are 1ncreaslngly a feature of urban areas throughout the United States. In recent years vendors have been a prominant part Mayor and C~ty C4ItC~1 -2- ~Ugust 23, 1983 of publ~c and private central city rev~tal~zat~on proJects and urban waterfront restorat~on efforts. Advocates suggest that vendors add an ~mportant sense of v~tal~ty to the pedestr~an envlronment, foster small bUSlness enterprise, prov~de outlets for local artlsts, lmprove the mix of goods available to consumers, and return sales tax dollars to the clty (see Exh~blts A & B). Others argue that vendors present licenslng, health and garbage problems (see Exhiblt C), and unfalrly compete w~th local buslnesses. In Santa Mon~ca, vendor actlvlty 15 regulated by numerous, overlapplng and sometlmes confus~ng prov~s~ons of the Munlcipal Code, County Department of Health SerVlces and State Department of Health SerVlces requirements, Pol~ce Department perm~t pol~cy and City Counc~l policy. Among the Municlpal Code prov~s~ons appllcable to this issue are the followlng: o Sect~on 3335 proh~blts anyone from leav~ng property or materlal on publlC sldewalks for longer than ten minutes. o Section 3376 limits the amount of time a "peddlern or "vendorn may occupy a part~cular locatlon on publ~c property to ten mlnutes, spec~f~es certain food items that may be sold from pushcarts located on publlC property lf a Pollce permlt lS obta~ned, and specifles that "lunch, meal or eating cart or vehicles" may occupy fixed locatlons on Clty Streets as asslgned by the Pollce Department exceptlng locatlons near intersect~ons, publlC schools, establlshed restaurants, cafeterlas, lunch counters, or "eat~ng places". Under thlS authority the Pollee Department currently prohlblts "lunch trucks" from operating on Ocean Avenue, west of Ocean Avenue and on City and County property. :1i5._'Or ane Ci t.! eWc:.1 o Section 5104 defines -3- . vendor of food or I_e.r; 1.:::; t 22, ':91;$3 a "hawker" as a food products operatlng on the street, a vehlcle, or by carry~ng the food ~tems. o Sect10n 5120 requlres all hawkers to obtain a City permlt and meet County Health Department regulatlons. There are currently no actlve hawker permlts In the Clty. o Section 5121 requlres all hawkers and "peddlers" vendlng food from fixed locatlons to comply w1th regulatlons pertaining to "food establishments" (e.g. food market) . o Section 6220 deflnes an "ltinerant vendor" as a vendor who lntends to do bUSlness in the Clty for not more than 120 days. ThlS def~nltion does not include hawkers, peddlers from vehlcles or persons selllng frult, vegetables, butter, eggs, or other farm or ranch products, This Section also establlshes a $50.00 per month business license fee. There are currently SlX active it~nerant vendor permlts In the Clty, two at the Pler and four for lndivlduals selling ltems In hotels. o Sectlon 6233 deflnes several klnds of "peddlers" and establishes annual buslness llcense fees. There are approximately 80 active perm~ts, most of which are lunch, catering, frult and lce cream trucks. o Sectlon 6234 prohlblts peddllng of goods, wares, merchandlse and food stuffs on publlC beaches. o Sectlon 6235 waives peddler and hawker bUSlness license fees for certaln veterans except those who sell frult or vegetables. o Sectlons 6330 through 6335 permit the Department of Recreatlon and Parks and the Chamber of Commerce to conduct up to six Cultural Arts and Crafts shows on City parks and Santa Monlca Mall, subJect to certain condltlons. ~ayor and City C1IJC11 -4- t1fUgust 23, 1983 o Sectlon 10231(e) prohlbits peddllng on Santa Monlca Pler wlthout authorlzatlon of the City Councll. Desplte the enabllng provlsions of the above Munlclpal Code Sectlons lt has been C~ty pol~cy for more than twenty years not to permlt food sales ln C~ty parks. Durlng the summer of 1982 permits were lssued to two lce cream vendors (ChipW1Ch and Klondlke) for a month experlmental perlod to allow sales in palisades Park. A hot dog vendor subsequently persuaded staff to issue permlts as part of th~s same one month experlment. At the City Councll meetlng of August 31, 1982, Councllmember Reed requested discuss~on of the vendor experiment ln llght of complalnts she had received about the vendors. A motlon dlrectlng staff not to lssue new vendor permlts or renewals and to lnvestlgate the matter and report back to Councll was passed by all s~x Councilmembers present. AnalYS1S In addltion to revlewing City, County and State pol1cles and regulatlons governlng vendor operation, staff contacted representatlves of other cltles to lnvestlgate alternative approaches to thlS lssue. The results of thlS lnvestlgation are brlefly summarlzed below: o Sacramento food and flower vendors are permltted only wlthin the Central Business Dlstrlct and Old Sacramento durlng the annual Thlrd of July celebratlon. Permlts are granted by the City Manager subject to speclflc criterla, lncludlng flxed locatlons. Business llcense tax and Downtown Business Improvement Area tax are assessed. A fee cover1ng the costs of addltlonal Clty serVlces provlded Mayor and City C~Cll -5- ~UgUst 23, 1983 ln conJunctlon wlth vendor operatlons may also be assessed. Llabllity lnsurance, a pollce check and flngerprintlng are requlred. o San Franclsco'S street vendors ~n the Wharf area are world reknown. Permits are granted for three-month lntervals for a very low fee. Clty staff reports exceSSlve enforcement problems and a llkely fee lncrease to finance addltional enforcement personnel. o Santa Barbara features a well-known arts and crafts show each Sunday along Cabrlllo Boulevard adJacent to the beach. Permlts for flxed locat~ons are lssued on a flrst-come, flrst-served basls. BUSlness Llcense Taxes are walved, but artlsts wlshlng to sell their work must pay an annual permit fee of $225.00 and obtaln a Board of Equalizatlon Permlt. Categorles of arts and crafts are approved by the Arts and Crafts Show Advisory Cornmlttee. o Los Angeles requlres vendors to obtaln a Conditlonal Use Permit (usually denled) and a Coastal Permlt, if appllcable. Earller thlS year a graduated penalty ordinance was enacted ln response to frequent vlolatlons by vendors and property owners In the Venlce Boardwalk area. o San Diego generally permits pushcart vendors only on private property. The City's Department of Parks and Recreatlon has lnltiated an experimental vendor program thlS summer that wlll lnclude six hot dog and lce cream vendors at the beach. For the three-month program, vendors wlll be charged a $225.00 processing fee plus 15% of gross sales. Mayor and C~ty~uncil -6- ~gust 23, 1983 o At both Redondo P~er and Stearn's Wharf (Santa Barbara) vendors must be sponsored by ex~stlng lessees, w~th the City rece~v~ng a small percent of gross sales. o M~aml, Florida 15 propos1ng to revise 1ts sidewalk and street vendors ord~nance to perm~t vendors ln the Central Buslness Dlstr~ct and Flagler Promenade area. Standard Permlts, insurance and Health Department lnspectlons w~ll be requlred. Farmers and growers selllng thelr own products would be exempt from requlred perm~ts. o Orlando, Florlda permlts vendors w1th a "sol~c~torls" perm~t to operate only on prlvate property ln commerclal areas. An annual perm~t, character references, flngerprints and photographs are requlred. In rev~ew~ng the vendor issue wlth representat~ves of these Jur~sdlct~ons lt became clear that a successful vendor program must address the followlng issues: o Locat~on. Most Jur~sd1ct~ons restr~ct vendors to actlve publ~c and tour1st areas, prec1sely those areas Wh1Ch vendors themselves prefer. Candidate locat~ons 1n Santa Monlca 1nclude the P1er, the Third Street Mall, Ocean Front Promenade and pal1sades Park. Spec1f1c space allocatlons tend to reduce conflicts between vendors. o Food vs. Products. Both would seem appropr1ate 1f properly regulated. Current City and County reqUlrements for food vendors appear to be adequate as measured agalDst other Jurisdictions. With respect to products, the C1ty may w1sh to glve preference to or1g1nal or handcrafted versus mass-produced ltems. Consideratlon should also Mayor and CltY~UnCll -7- .ust 23, 1983 be glven to how the proposed products contrlbute to the varlety of goods avallable to the publlC, wlth the intent of avoldlng dupllcatlon of ltems already avallable ln adJacent established bUSlnesses. o Permlts, llcenses and lnsurance. EXlstlng Clty and County permlts appear to be the mlnlmum necessary to ensure that the publlC health, safety and welfare are protected. A minimum level of product and llability lnsurance would seem a reasonable addltlonal requlrement, along wlth a State Board of Equallzatlon seller's permit. o Fees. In addltion to permit fees, many cltles collect rent from vendors for the privilege of dOlng business on public property. These fees range from token sums to percentages of gross sales to flxed monthly rents. The San Diego Pushcart Vendors Assoclatlon recommends that 15-18% of gross sales is a reasonable fee that legltlmate vendors can afford to pay. In settlng any fees, consideration should be glven to at least three factors: 1) abl11ty to pay (lndlvldual artlsts may not be able to afford the same fees as vendors of mass-produced items); 2) comparable per square foot costs of area leased to established buslnessesi and 3) City's costs to administer and enforce all aspects of vendor operatlons. o Enforcement. Most ]urlsdlctlons have been reluctant to permlt vendors because of difficultles pollclng thelr operatlon and adherence to establlshed rules. Careful monltorlng of permltted products, asslgned locatlon, and level of sales were the most frequently clted problems. Mayor and Cit4IJouncll -8- ~gust 23, 1983 Proposal for an Experlmental Pler Vendor Program Wlth these lssues in mlnd, lt would seem approprlate for Santa Monlca to experlment wlth a carefully designed vendor program to obJectively determine what level of regulatlon may be necessary to permlt vendors ln the City and to assess the publlC beneflts resulting from thelr activltles. Santa Monlca Pler would be an ideal location for such an experlmental program ln that lt 1S physlcally contalned, under close Clty management and Santa Monlca Pler Lessees Assoclatlon supports vendors at the Pler as long as goods or food sold does not dupllcate ltems already avallable from eXlstlng Pler lessees. A prellmlnary vendor program was developed durlng Pler Week, WhlCh proved generally successful. Approximately flfty vendors leased space at the Pier for fees WhlCh totaled $4,477. Today there are flve vendors already located at the Pler: a churros (Mexlcan pastry) pushcart vendor, a pretzel pushcart vendor, a photographer, the owner of the former Porthole cafe who lost hlS buslness to the winter storms, and the owner of the former Rock Shop whose business met the same fate. The City regularly recelves requests from prospectlve vendors to locate on the Pler, lndlcatlng strong market demand for such a program. An experimental year-long Pler vendor program designed to test vendor procedures ln general, to promote lncreased pier revenues and to lncrease the mlX of goods available to Pler visltors could lnclude the following features: o Deslgnatlon of thlrty 9 foot x 12 foot spaces ln the area between Moby's Dock and the Bumper Cars for vendor dlsplays. Vendors would be screened and selected by the Pler Manager after public advertls1ng of avallable space. Mayor and Clt~uncll -9- 4ItUgust 23, 1983 Flrst priorlty would be glven to artists and crafts people: second prlorlty to those selllng unusual mass- produced ~tems. Flve addltlonal pushcart vendors would also be chosen. o Vendors would be requlred to obtain a non-transferable City ltlnerant vendors license and Pollce permit, State Board of Equallzatlon permlt and approprlate llability lnsurance. A llcense tag bearlng all requlred informatlon would be affixed to each dlsplay or cart. Operations would be monltored regularly by a one quarter-tlme admlnlstratlve asslstant under the supervislon of the Pler Manager. Salary and expenses would be more than offset by fees charged to vendors. Rent flgures wlll be establlshed after further study, but may range from $200 - $400 per month, ~ncludlng permlt fees. The term will equal three tlmes advance rent pald up to a maximum of elghteen months. o Other conditions as outlined ln the draft Pler Vendlng Program Condltlons attached as Exhlbit D. ThlS experlmental program would be evaluated throughout a one-year perlod. Among the lssues to be studled would be attltude of vendors and Pler lessees toward the program and lts admlnlstration, whether the vendor program contrlbuted to a general lncrease ln gross sales at the Pier, attltude of Pler users toward the vendor program, costjbeneflt to the Clty, and reVlew of any speclflc problems related to malntenance, enforcement, storage, parklng and other related issues. Mayor and ClttljounCll -10- tlfgust 23, 1983 Budget/Flnancial Impact Assum~ng all th~rty stat~onary product vendors and seven pushcart vendors operated on a twelve month bas~s, estlmated gross revenue to the City would total $133,200 at $300/month/ vendor. Dlrect Costs for salary ($8.52/hr. x 500 hrs.), office 5upplles ($250.00), telephone and maillng ($150.00) and offlce furn~ture plus other supplles ($1,000.00) are est~mated to total $5,660. ThlS would leave a posltlve net revenue to the Clty of $127,540. Each vendor will pay an amount equal to four percent (4%) of base rent into the Pler Promotlon fund Just as all Pier lessees are requ1red to do. If the pend1ng proposal to assess P1er lessees a common area charge lS eventually approved by Clty Counc~l, a percent of vendor lncome could also be contrlbuted to thlS cost. Recommendation It 15 respectfully recommended that the City Councll: I} Dlrect the Clty Attorney to reVlew sectlons of the Munlc~pal Code appllcable to vendors, pushcart vendors, hawkers and peddlers and determlne whether any changes, clarlflcatlons or consolidaltons may be appropriate. 2} Dlrect C~ty staff, after consultatlon with the Clty Attorney and Chlef of Police, to implement a vendor program at Santa MaUlca pier as descr~bed ln this staff report for one year. 3) Withln Slxty days after conclusion of that one year P~er vendor program, present to Councll an evaluation of the program together wlth any recommendatlons for vendor programs at addltlonal Clty locat1ons lncludlng the Third Street Mall, Ocean Front Promenade and palisades Park.
