SUBJECT: Supplemental Recommendation Regarding the Expanded
Industrial Wastewater program
Introduction
Agenda Item llA, "Recommendation to Approve Expanded Industrial
Wastwater Control Program and Adopt Resolution Establishing
Fees", sets forth fees for six categories of businesses based on
number of wastewater samples/inspections required to comply with
Federal law. In response to both discussions with the Chamber of
Commerce and calls received from concerned owners of small auto
repair shops regarding the proposed program, staff is modifying
its
original
proposal
to
incorporate
the
following
recommendation.
Background
Staff has recommended that the city council approve an expanded
Industrial Wastewater Control program and establish fees as
discussed in Agenda Item IIA. In response to calls received from
concerned owners of small auto repair shops regarding the
proposed annual fee of $646, staff has reexamined the various
sizes of auto repair shops and their impact on the wastewater
system.

There are approximately 159 auto repair shops in the city. As
shown above, staff originally proposed that all auto repair shops
be
placed
in
the
same
category
requiring
three
samplesjinspections per year at an annual fee of $646.
After comparing the number of auto repair bays of the auto repair
shops and their related impact on the City's sewer system, staff
concludes that the auto repair shops should be divided between
the Auto Repair and Problem Restaurants category and the
Printers, Others Category. This change would place approximately
100 small auto repair shops into the Printers, Others category
which will require two samples/inspections per year at an annual
fee of $430.
Based on current staff analysis, a small auto
repair shop would be defined as having no more than one repair
bay.
Budget/Financial Impact
As discussed in Agenda Item 11A, program costs for this fiscal
year (1989-90) are estimated at $249,509 and projected revenues

are $289,776. If the 100 small auto repair shops are moved from
the Auto Repair and Problem Restaurant Category to the Printers,
others category there would be a decrease of projected revenues
in the amount of $21,600 for a revised projected total of
$268,176 for this fiscal year.
Recommendation
It is reco:mm.ended that the proposed expanded Industrial
Wastewater Program be modified to
include
two
separate
categories:
Auto repair and small auto repair shops in the
Printers, others category.
It is also recommended that the
budgeted industrial wastewater fee revenues for FY 89/90 be
increased by $136,332 as opposed to the $157,932 which was stated
in the original staff report.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA ESTABLISHING FEES FOR INDUSTRIAL
WASTEWATER CONTROL PROGRAM FEES
WHEREAS, the City council of the city of Santa Monica adopted
ordinance Number 1373 (CCS) on June 10, 1986 establishing the
Industrial Waste Control Program; and
WHEREAS, Section 5426 of said Ordinance enables the city Council
to set fees to recover the cost of enforcing said ordinance,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION L The following fees are hereby established as set
forth by Section 5426 of Ordinance Number 1373 (eCS):
