CalIfornIa June 24. 1986 TO: Mayor and CIty Councll FROM: Clty Staff SUBJECT: Recommendation to DIrect the CIty Attorney to Prepare a CommunIty NOlse Control Ordlnance and make an approprlatlon from the General Fund to the AIrpOrt budget for FY1986-87 IntroductIon Thi s report recommends tha t the CI ty Councll dl rect the Ci ty Attorney to prepare a communlty nOlse control ordInance and make necessary budget adJustments to Implement a nOlse control progTam in the City. ,Back ground At Its meetlng on January 14. 1986. the Councl1 dlrected staff to develop a proposal and lmplementatIon plan for a nOIse ordInance for reVIew by City Councll In conJunctIon wlth the 1986-87 budget process. ThIS dIrectIon derIved from an 1nvestlgation Into a number of a1 ternat1ves for dealIng Wl th the n01se generated by motor1zed leaf blowers. Many cItIzens had complaIned about the IntrUSIon of this nOIse source into reSIdentIal areas of the City. - 1 - /I-A JUN 2 -4 1986 Jill - 1 'fiG ~ Noise Element of the General Plan The quesrlon of an overall program for deallng wIth the problem of commun1ty n01se pollutlon was first addressed by the C1ty 1n the mld Seventies. In response to State requlrements~ the C1ty conducted a communlty nOIse survey and developed a NOlse Element of the General Plan. The Noise Element was adopted by the Clty Counell on November 11. 1975. The document provldes a POllCY overVlew for deal1ng wlth the problems of nOlse pollutlon. Speclflcally~ analyzes the ''It 1dentif1es the sources of commun1ty noise: extent of nOlse pollutlon and estlmates the potential 1mpact upon the Clty. This ldentlflcatlon process 10 turn provldes the baS1S for goals, obJectlves and lmplementatlon programs deslgoed to create a qUleter enVlronment 1n the Clty. .." (Nolse Element of the General Plan, p. 12) A careful reVlew of the concluslons of the NOlse Element was undertaken as part of the analysls leading to thlS report. Whlle the NOlse Element was adopted a decade ago. lt stlll appears to prov1de adequate POllCY gUldance ln the area of nOlse pollutlon. A thorough and comprehenslve nOlse survey was taken and a linde range of alternatlves was consldered. Moreover. the Noise Element 15 prlmarily useful as a land use plannlng tool 1n develop1ng communlt1es. By 1975, the developed and the development actlvl ty Clty was already fully then as now was one of 1nflll. These klnds of n01se problems are better managed through the abatement and enforcement mechanlsms of a n01se ord1nance. - 2 - The NOIse Element recommended that the CIty".. .adopt and enforce a noise ordInance." The Element recommends a maXImum permitted nOIse level and dIscusses approprIate nOIse levels for dIfferent zones of the C~ty. ~urrent Noise Control Measures in Santa MODIca There are a wIde var~ety of references to nOIse and efforts to control nOIse In the MunicIpal Code. WIth the exceptIon of the AIrport, whIch poses a unIque problem~ there has been no cohesive approach to the settIng of communIty nOIse standards. Attempts at no~se control have been fragmented, epIsodIC and dIverse In approach. The folloWIng IS a compendIum of Santa MonIca MunICIpal Code SectIons dealIng with nOIse pollutIon. o S.H.H.C. Section 3970. Motor Vehicle Alarms: ThIS sectIon, adopted In 1983, declares that the nOIse from motor vehIcle alarms IS a publIC nUIsance and prOVIdes that allOWIng motor vehIcle alarms to emIt nOIse for more than 15 mInutes is an InfractIon. o S.H.H.C. Section 31010. NOIse Abatement: ThIS sect Ion establIshes the authori ty of the ChIef of PolIce to abate nOIse from entertaInment establIshments up to and IncludIng reqUIring permIttees to Install sound proofIng. o SoH.H.C. Sectlon 4128. NOISY AnImals: This section declares It to be a nUISance to keep, maintaIn, or permit - 3 - any anImal WhICh by sound or cry dIsturbs the peace and comfort of InhabItants of any neIghborhood. o S.M.M.C. AIrport No~se Abatement In addl t Ion: the Cl ty CounCIl has recent ly adopted an ordInance (#1361) regulatIng the hours of trash collectIon and has adopted an ordInance (#1364) prohIbItIng the usage of motorIzed leaf blowers from 8:00 p.m. to 8:00 a.m. durIng weekdays and from 8:00 p.m. to 9:00 a.m. on weekends. It IS clear that the CIty'S approach to nOIse control to date has been to respond to problems and complaInts as they have arIsen DurIng the past SIX months alone, the CounCIl has conSIdered nOIse problems arISIng from constructIon. from maIntenance of reSIdentIal property. from bars and restaurants, and from prIvate trash collectIon actIVIties. Staff strongly belIeves that the CounCIl should adopt a set of uniform performance standards WhICh are embodj ed In an overall communIty nOIse ordInance. Such an approach would clearly state the CI ty IS comml tment to protect 1 ng the qua 11 ty of 11 fe In the communIty and would prOVIde a legally sound and adminIstratIvely feaSIble way of controllIng nOIse pollutIon. - 5 - What are the pTevailin~ kinds of noise 1n the C1tv? Santa Monlca may be characterlzed as a nOlsy urban enV1ronment 1n that lt has been fully developed for qUlte some t1me. The Santa Monl ca NOlse Survey found f 1 ve d1 f ferent prImary ca tegorl es of nOlse to ordlnance n01se A be prevalent 1n the City. A communlty nOlse control 15 useful 1n controlllng three of the flve sources of d1SCUSSlon of each nOlse source reveals dlfferlng mltlgatlon problems and opportunlties. o Surface TransDortatioD Noise. The noise survey taken 1n 1975 lndlcated that surface transporta t 10n 1 s the prImary noi se source in the Ci ty. ThIS findlng control nOIse remains valld in 1986. The City may not emisS10ns from veh1cles because such dlrect control 15 pre-empted by the State and Federal governments. The Clty through Its pollce power can and does enforce eXlstlng laws governing surface transportation nOise such as the Motor Vehicle N01 se Standards In the Call fornla Vehlcle Code. Staff does not feel that addltlonal CIty regulatlon ln thIS area 1S warranted. o Alrcraft NOlse In 1984 reached an agreement problem WI th the f or many Federal The Cl ty years and has extenslvely studied thIS AVIatIon AdmInIstratIon to develop a comprehenSIve noise mitlgat10n program for the Santa Monica Alrport. Th1s program was made CIty law 1n early 1985 WIth the adoption - 6 - of the Santa Monlca Alrport NOlse Code (8.M.M.C. Sect10n 10050 et. segl. A1rcraft n01se should spec1f1cally be exempted from the commun1ty nOIse ordlnance as control over alrcraft ln flight 15 exclu51vely regulated by the Federal Government and as extens1ve regulat10n eX1sts as to alrcraft landIng at or tak1ng off from the Santa Mon1ca Airport. o PopulatloD N01se Th1s category of nOlse can be characterlzed as nUlsance noise. Included Wlthln th1S category are noise from lawn mowers. leaf blowers, ampl1fled mus1c~ bark1ng dogs~ air cond1tlon1ng UDltS and sW1rnming pool and Jacuzzi pumps. As ind1cated above, the C1ty currently has a varlety of n01se related ord1nances but does not have an obJect1ve standard for allowable levels of n01se 1n the var10US zones of the C1ty. o Construction Noise Constructlon n01se has become a greater problem 1n the C1ty of late wlth an 1ncrease 1n resl.dent1al remodels, commerclal development and public works proJects. Differing types of constructlon can make dlfferent levels of noise. Problems range from equ1pment usage to delivery of roa ter1al s and can be the resul t of both h1gh nOl se levels and the t1me of day the act1vlt1es take place. The C1 ty currently regulates the tlme at WhlCh construct1on act1vlties take place. It 15 also poss1ble to lim1t - 7 - construct1on noise levels at the adJacent property 11ne by enact1ng maX1mum nOlse lImIts. Such limlts should be consistent wIthIn dIfferent zones of the City. o Industrial Noise IndustrIal nOIse 15 probably the least signlficant of the primary nOIse sources 1n the CIty due to the fa1rly good consolidation of industrIal uses in two areas of the C1ty: the Olympic corrIdor and the AIrport. A nOIse ordinance could help to mInImIze problems at the boundaries of industrIal zones by creating maximum n015e lim1ts for IndustrIal uses which border on residential or commercIal land uses. Hodel CommunIty Noise Ordlnance A number of agencIes IncludIng the CalIfornIa Department of Health~ the EnVIronmental ProtectIon Agency and the National Instituted of OccupatIonal Health and Safety have cooperated to develop a model communIty noise and VIbratIon control ordInance. The mode] ord1.nance has been Implemented 1n many communit1es around the country and has been thoroughly tested 1n the courts. VerSIons of the model ord1nance have been adopted by the County of Los Angeles, the County of Orange. the City and County of San Franc1sco. Burbank and Long Beach. Enforcement Certa1n actlvltles under the ordinance could be enforced wlthout measurement, for example, barklng dogs, loud partl.es and violat1on of n01se curfews. Other enforcement act1vit1es will requIre measurement of sound levels by Clty personnel and the issuance of orders to abate n015e. cltatlons, or flnes. Such actlons could be appealed to a hearlng examlner appo1nted by the City Attorney. NOlse Ordinance Implementation In order to determ1ne the staff and budgetary lmpacts resulting from the adoptlon of a communIty noise ordlnance. staff contacted four Southern Californ1a Jur1sd1ctions wh1ch have lmplemented simllar ordlnances. Questlons were asked regardlng stafflng. volume of complaInts, population served and equlpment utl11zed. The four JUTlsdlctlons contacted were the City of San D1ego, Clty of Long Beach. the County of Los Angeles and the County of Orange. o City of San Diego The Communlty nOlse ordlnance for the C1ty of San D1ego is adm1n1stered by the Noise Abatement Offlce of the BU1ldlng Department. The of f 1CB handles communi ty nOl se, a 1 rport n01SB and no~se enforcement for the construct1.0n of new bUlld~ngs. The n01se abatement office has a total staff of - 13 - '- SlX~ of whom three are dIrectly lnvolved 1n the enforcement of communIty nOIse standards. The CIty of San DIego has a total populatIon of Just over one millIon people. A total of 8~500 communIty nOIse complaInts are receIved each year~ for an average of one complalnt of every 118 persons. ThIS ratlo If applled to Santa Monlca'a 90.000 resldents~ would result in about BOO complaInts per year. The chart below depIcts the type of complalnts recelved 1n San DIego and the correspondlng proJected complalnt levels here 1n Santa Monlca. San Dlego follows a four tlered approach to enforcement as outllned below: 1. 00 recelvlng the flrst complalnt a "green card" is malled to the alleged offender lnd1catlng that a nOlse complalnt has been flIed and lncludes recommeodatlons on how to resolve the problem. resolves 52% of the cases. The "green card" 2. If a second complalnt 1S received at least seven days after the green card 1S malled, a "second notlcell 15 mal led to the alleged offender complalnant. The "second notlcell and a copy advi ses the to the alleged offender of the requlrements of the Munlclpal Code, and that a fleld lnvestlgatlon wl11 be made. The 1nvestlgator evaluates the nOlse problem, makes recommendatlons to abate the problem. and establlshes a deadllne by WhlCh the recommendatlons are to be met. The "second notlce" and investlgatlon process resolve 79% of the cases that reach the second notlce stage. For cases involvlng a dog barklng. a notice titled. "Suggested Ways to Control Excesslve Dog Barklngt" 15 malled wlth the second not1ce. 3. If the lnvestlgator lS not successful ln solving the problem. two courses of actlon may be taken: ( a) For cases where the nOl se 1 S cl ear ly under the dlrect control of the alleged offender and is - 15 - '- easIly quant.lflable. (b) For cases where the nOIse 15 not clearly under the dlrect control of the alleged offender and IS not easIly quantIfIable, (e.l.. barklng dogs). an admlnlstratlve hearlng may be scheduled by the NOIse Abatement Officer. To meet thIS crIterla, the complaInt must be supported by two or more resIdents resIding In separate resIdences adjacent to the alleged offender, or three or more reSldents residlng ln separate resIdences not nece ssar lly adJacent, but 1 n close proxlml ty to the alleged offender. If these crIteria are met, the Hearl ng Of f lcer WIll make recommenda t Ions to abate the problem and gIve a speCIfIC tlIDe lImIt to achIeve complIance. The "hearIng" resolves 78% of cases that reach the hearIng stage. 4. If the recommendatIons set forth at the hearlng are not successful In resolVIng the problem. the case may be sent to the CIty Attorney for prosecutlon. The Clty of Long Beach has a staff of three inspectors who work on all of the above actlvltles In addltlon to nOlse ordlnance enforcement. Enforcement actlvltles are two-fold. The CIty records nOlse levels of places of entertalnment prIor to the Issuance of bUSIness lIcenses for night clubs and danCIng establIshments. In addItIon, the City~ WIth a populatIon of over 300,000, receIves an average of two to three noise complalnts each week from the community. The peak complal nt perlod 1 s the summer and the prlmary type of complaInt 1S nOlse from 81r cond1t1oners. Long Beach opera tes two sound monltor equlpped wlth a prInter hand-held meter. level meters: a portable l.nstalled 1n a van~ and a o County of Los Angeles The county of Los Angeles admlnl.sters a communi ty nOlse control program for both the unlncorporated areas of Los Angeles County and for 5 CItIes on a contractual baSIS. The total populatIon served IS 1.25 m1.l11.on. As 1.n Long Beach~ the program IS also responslble for codes. The County of run by the Health Department who 15 enforcement of health and safety Los Angeles employs fIve people ln thl.S diVIsion. An average of 4 noise complaInts are receIved and responded to each week. The County of Los Angeles owns and operates two portable nOl se monl tor s and two hand held sound 1 eve 1 meters. The maJor categorIes of nOlse problems are the follOWIng: lndustrlal nOlse~ aIr condltloners and amplIf1.ed sound from nIght clubs and amphltheaters. - 18 - " " County of Orange The Orange County Health Department enforces a commun1ty no~se ord1nance for the unlncoporated areas of Orange County and for fourteen cltles on a contractual basls. Total populatlon served 1S over 1.5 mllllon. One staff person 1S assIgned to thIs program on a full time basls. Orange County recel ves between three and f 1 ve noi se complaInts per week related to JacuzzI and sWlmmIng pool pumps, alr condItIoners. commercIal nOlse and ampllfled sound from nIght clubs. In additlon~ they recelve a number of complaInts related to outdoor amphItheaters. Orange County operates a portable nOIse monltor and a sound level recorder which can record for up to flfty hours. Bud~etary/Flscal Imoact Staff proposes that nOlse ordlnance enforcement requirIng to thel r measurement be assIgned to the Al rport Department due greater eXperIence WIth acoust1Cs and nOlse standards. Enforcement of transltory nOlse sources such as partIes~ constructlon noise~ barklng dogs~ motor vehlcle nOIse~ etc. would contlnue to be handled by the Santa Monlca Pollce Department. No ~ncrease ln approprlatlon for the Pollce Department is necessary. It wlll be nece~sary to approprlate $16.420 from the General Fund into the Alrport Department budget for FY1986-87.
