Zones
Introductlon
ThlS report transmits the Plannlng COnTInlSS10n' s recoJllIUendatlons
that certain sectlons of the Zonlng Ordlnance permlttlng auto-
matlC parklng and commercial use of residentlal lots be deleted.
Background
Followlng a eomprehenslve study of the use of resldentlal
properties for parklng and co~merclal uses and three publlC
hearlngs, t~e Clty Plannlng CommlSSlon has recommended deletlon
of the followlng sectlons of the Zonlng Ordlnance.
1. Seetlon 9129E--whlch automatlcally permlts parking
on R2, R3 and R~ lots Wlt~ln 150 feet of a commerclal
or lndustrlal zone.
2. Sectlon 3112A4--whlch per~lt~ par~ing structures to
be bU11t In "A" Dlstrlcts.
3. Sectlon 9l31--whlch permlts properties bounded by
three streets to be developed for commerclal and parklng
purposes.
4. SectloD 9147--whlCh perMlts t~e Clty Councll to allow
commerclal use en R2, R3 or R4 sltes of 4 acres or more.
Propertie~ zoned R2A, ~3A and R4A would not be affected by the
changes o~ner than lose the rlght to have parking structures. The
Plannlng COITlITl1ssion has not yet undertaken conslderatlon of a zone
change on the "A" propertles. Nelther the three street proVlslons
of SectloD 9131 or the four acre proVlslons of Sectlon 9147 have
ever been used.

Alternatlves
The Clty Councll may accept, reJect or nodlfy any recomrnendatlon
of the Plannlng Commlssion ln regard to land use matters in the
Clty.
Recommendatlon
It 15 respectfully recommended that the C1ty Cauncll act favorably
on the Plannlng Commlsslon's recommendatlons by directlng the Clty
Attorney to prepare the requlred ordlnances.

FINDINGS AND RECOYh~NDATIONS OF THE CITY
PLANNING CO&~ISSION OF THE CITY OF SANTA
MONICA ON PROPOSED &~~XDH~~TS TO CRAPTBR 1,
ARTICLE IX OF THS SANTA MONICA MU~ICIPAL CODE
RELATI~G TO USE OF RESIDENTIAL PROPERTIES
FOR PARKING AND CO~rnERCIAL USES.
SECTION 1. The City P1annlng Commission of the City of Santa
Monica hav1ng declared its intention to aMend Chapter 1,
Article IX of the Santa Monica Municipal Code by the de1etlon
of Sectlons 9l12A4, 9129E, 9131 and 9147 In their entirety and
a Public Hearlng having been held on April 6, 1981, the Clty
Planning Commission hereby finds as follows:
1. Sectlons 9l12A4 and 9129E, permittlng the automatic
use of certain reside~tial properties for automobl1e
parking and parklng structures in connection wlth adjacent
buslnesse~ are not in the public interest and should be
deleted.
2. Section 9131, permitting automatic use of resldential
properties under certain circumstances, is not good zoning
practlce and should be deleted.
3. Section 9147, providlng for a Speclal Condltlonal
Use Permit on properties of 4 acres or more, is unnecessary
and should be deleted.
4~ The public necessity, publlC convenience, general
welfare and good zoning practice requlre the proposed
amend.'11en ts .
SEC~ION 2. The Clty Planning CO~~lssion also flnds that lt can
be seen with certainty that the deletion of these sections will
have no detrlrnental effect on the envlronment wlthin the meaning
of the Ca1jfornia Environmental Quallty Act.
SLCTIO~ 3. The City Plannlng Commission, therefore, recommends
