SUBJECT: Recommendation to Hold a Public Hearing and
Adopt a Resolution of Confirmation Regarding
The Costs of Abating a Public Nuisance at
1524 11th Street, santa Monica, california
INTRODUCTION
This report requests that the City Council hold a public
hearing to hear protests or objections, if any, by the property
owner, regarding the placement of a lien or special assessment on
the property located at 1524 11th Street, santa Monica, California
("subject property") for the cost of abating a public nuisance at
the subject property by the Nuisance Abatement Board C'NAB").
Following the public hearlng, it 1S requested that the City Council
adopt a Resolution of Conf1rmatlon affirming the lien and special
assessment on the subject property for the abatement costs.
BACKGROUND
The subject property came before NAB in the Fall of 1995. At
that time, it contained a vacant two unit dwelling.
City
inspectors found that the structures were not secured from
unauthorized entry.
Specifically, the rear door of the front
structure was open and a gate to the property was not locked. The
1nterior of the structures contained a large amount of flammable
debris. As a whole, the dwellings were not boarded and secured to
the standards of the Santa Monica Fire Department.
The conditions on the property also caused a large number of

cats to congregate on the premises. The presence of the cats along
with the condition of the property represented a health hazard to
those on the premises and to those res iding in the ad J acent
propert1es.
Since the property was not fenced in compliance with the
standards of the Santa Monica Fire Department, there was also easy
access to the property by individuals and by motor vehicles. The
ease of access created the conditions giving rise to the publ1C
nuisance conditions noted above.
These conditions constituted a health hazard, fire hazard and
a violation of the zoning provisions of the Santa Monica Municipal
Code, all of which collectively constituted a public nU1sance
requiring immediate abatement.
On or about November 8, 1995/ the Nuisance Abatement Board
found the subject Property to constitute a public nU1sance and
ordered the owner to remove all \'leeds, overgrown foliage and
accumulation of trash and other combust1bles from both the interlor
of the structure on the premises and from the grounds of the
premises, properly board and secure all openings to the structures
on the Premises in accordance with the standards set forth 1n the
Santa Monica Fire Department I s "Standard Method for Securing
Openings in Vacant Buildings," and erect a fence along the entire
per imeter of the Premises according to the Santa Monica Fire
Department's "Standard Method for Fencing Vacant Properties."
At its meeting of December 14, 1995, the Nuisance Abatement
Board was informed by Clty inspectors that the owners of the
subject premises failed to take any corrective action in response
to the Notice of Resolution adopted on November 8, 1995.
Specifically, there was debris in the front structure, an openlng
in the rear which had not been secured and the front gate remained
unlocked. The Nuisance Abatement Board authorized City staff to
proceed with abatement of the conditions if the owner dld not
perform the required work within ten (10) days and with placement
of a lien or special assessment on the subject property for the
cost of the abatement. The owner did not comply wlth the order.
On or about January 9, 1996, Shepard Glass Company, an outslde
contractor for the City, removed debris from the inter lor and
exterior of the subject property and boarded up all accesslble
windows as per Santa Monica Fire Department requirements. The cost
of this work was $1,670.00.
On or about January 10, 1996, Santa Monica Fence Company, an
outside contractor for the City, provlded a fence enclosure and
access gate to the subj ect property as per Santa Monica Fire
Department requirements. The cost of this work was $2,771.00.
consequently, the total cost of abatement was $4,441.00. Work
lnvoices are attached hereto.
On or about October 4, 1996, pursuant to Santa Monica
Municipal Code section 8.12.190(c), NAB caused notice to be given
to the owners of the subject property by certified mail, setting
forth the cost of the abatement and day, hour, and place of the
hearing on this NAB report regarding the cost of the abatement and
any objections or protests raised by the property owners. This
notice was received on October 7, 1996. Notice was also personally
served on Marc Fronen on October 11, 1996 at his residence. Mr.
Fronen accepted service of a copy for Jacqueline Fronen.
If the abatement costs are not paid within ten (10) days of
the hearing before the city council and its confirmation of the NAB
report, it shall constitute a special assessment against the
subject property and shall be recorded with the Office of the
County Recorder of the County of Los Angeles. Such lien shall be
collectible at the same time and in the same manner as secured
property taxes are collected and shall be subj ect to the same
penalties, priorities, and procedures in the case of delinquency.
BUDGET/FINANCIAL IMPACTS
Funds for abatement of the property were approprlated from
Account Number 01-500-401-0000-5506-0000. Revenue from this
special assessment will be credited to Account Number 01-130-224-
00000-0417-10000.
RECOMMENDATION
It is respectfully recommended that the City Council:
1. Hold a public hearing regarding the costs of abatement at
the property located at 1524 11th street, Santa Monica, California;
2. Following the public hearing, adopt the attached
Resolution of Confirmation which affirms the action of the
Nuisance Abatement Board with regard to the property located at
1524 11th Street, Santa Monlca, California; and
3. Authorize the filing of a Notice of Lien with the Los
Angeles County Recorder and have the Notice of Lien delivered to
the Los Angeles County Auditor for entry in the County Assessment
Book Opposlte the description of the particular property for
collection of the special assessment together with all other taxes
on the property.

WHEREAS, the NUlsance Abatement Board adopted a Resolution on
November 8, 1995 declaring conditions at 1524 11th street, Santa
Monlca, California ("subject property") to be a publ1.c nuisance and
authorizing city personnel to abate these conditions at the
property;
WHEREAS, pursuant to the authorization of the Nuisance
Abatement Board, the City has abated the nuisance conditions at the
subject property and incurred costs in undertaking this abatement;
WHEREAS, the Nuisance Abatement Board caused to be served upon
the owners of the subject property, a Notice of Cost of Abatement
setting forth the cost of the abatement and the date, time, and
place of hearing on thlS Resolution;
WHEREAS, the Nuisance Abatement Board, concurrently with the
submlttal of this resolutlon, has submitted the report regarding
the abatement of the publlc nuisance on the subJect property; and
WHEREAS, the City Council for the City of Santa Monlca has
held a publlC hearing regarding the costs for the abatement of the
public nuisance on the subject property,

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
RESOLVES AS FOLLOWS:
SECTION 1.. The report of the Nuisance Abatement Board
regarding the public nuisance at 1524 11th street, Santa Monica,
California is confirmed and that the reasonable cost of abatement
of the nuisance at the subject property is $4441.00.
SECTION 2. If payment of the nUIsance abatement costs is not
made wIthin ten (10) days of this confirmation of the NUlsance
Abatement Board's report and adoption of this Resolution, the c~ty
of Santa Monica is entitled to and hereby attaches a spec~al
assessment lien upon the descrIbed property upon recordation In the
Office of the County Recorder of the County of Los Angeles.
SECTION 3. Such lien shall constitute a special assessment
against the property and shall be collectible at the same time and
In the same manner as secured property taxes are collected and
shall be subject to the same penalties, priorities, and procedures
In the case of delinquency.
SECTION 4. The City Clerk shall transmit a certified copy of
thlS resolution to the Los Angeles County AUditor/controller
to place a special assessment against the subJect property.

SECTION 5. The City Clerk shall certify to the adoptlon of
this Resolutlon, and thenceforth and thereafter the same shall be
in full force and effect.
