Introduction
This report requests that City Council hold a Public Hearing for
establishing an assessment district for the reconstruction of the
alley and order the work on Lincoln Court between Olympic
Boulevard and Michigan Avenue to begin.
Backqround
The city's policy is to assess commercial and residential
property owners for certain public works improvements using the
Improvement Act of 1911.
These include gutter construction,
street and alley paving, tree planting and streetlighting.
On November 12, 1991, the City Council adopted Resolution of
Intention No.
8324
(CCS)
setting a public hearing for
December 17, 1991, to hear protests concerning the street
reconstruction and appurtenant work on Lincoln Court between
Olympic Boulevard and Michigan Avenue.
Lincoln Court is
currently in extremely poor condition with the full length of the
alley containing numerous irregularities and potholes. There is
a drainage problem due to the extremely flat grade. Due to the
extent of the needed repairs, patching is not feasible. The

reconstruction of Lincoln Court consists of replacing the
existing deteriorated asphalt paving with new concrete paving.
The life of the proposed concrete alley is estimated to be in
excess of 50 years.
A similar alley assessment project was completed in 1985, on
Ozone Place North. Property owners for the Ozone proj ect were
assessed for 70% of the cost and a utility company was respon-
sible for the remaining 30%.
Discussion
The Lincoln Court assessment as proposed, is similar to a
streetlighting assessment. Industrial and commercial property
owners will be assessed 100% of the cost per footage,
approximately $77.00 per lineal foot. Residential property
owners will be assessed 50% of the cost per footage,
approximately $38.50 per lineal foot with the city paying an
equal share. The cost split is related to the proportionate
amount of wear and tear caused by vehicles from the commercial
parcels as compared to the residential parcels. One property
owner has deposited $6,000.00 for his assessed share of the cost
as a condition of his development permit.
Any interested party may address City Council regarding the
proposed work or improvements. Notices of the Public Hearing
were mailed to each property owner (November 22 and December 5,
1991), posted in the alley, and printed in The Outlook more than
fifteen days in advance of the public hearing in the manner
prescribed by state Law. Staff notified all six affected

property owners and held a meeting on October 30, 1991 to discuss
the proposed assessment proj ect. Only one owner attended the
meeting and he was in favor of the project. A list of property
owners and a copy of the proposed assessment diagram will be
available for review in the council Chambers at the time of the
public hearing. The assessment district will be administered in
accordance with the procedures set forth in the Improvement Act
of 1911 of the California streets and Highways Code.
Budqet/Financial Impact
The total estimate for the project is $44,000.00. The proposed
breakdown is as follows:
Commercial and industrial property owner assessments $22,800.00
Residential property owner assessments 10,600.00
city's Share 10,600.00
Total project estimate $44,000.00
The assessment district will generate revenues of approximately
$33,400.00 to be deposited in Account Number
01-500-401-00000-0124-10000, "street Resurfacing Assessment
District." The total cost of this project, including the City's
share, will be charged to ClP Account No.
01-770-421-20092-8900-99152, "street Repair/Resurfacing". Cash
revenues will be received in FY 1991-92 and any unpaid
assessments will be placed on the 1992-93 tax roll.
Recommendation
It is recommended that City Council:
1. Open the public hearing;

2. Close the public hearing and acknowledge any protests; and
3. Adopt the attached resolution establishing an assessment
district for street reconstruction on the above named City
street.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA FINDING THE PUBLIC
CONVENIENCE AND NECESSITY REQUIRES THE
CONSTRUCTION OF CONCRETE PAVEMENT MiD
APPURTENANT WORK AND ORDERS WORK TO BEGIN
ON LINCOLN COURT BETWEEN OLYMPIC
BOULEVARD AND MICHIGAN AVENUE AS SET
FORTH IN RESOLUTION OF INTENTION NUMBER
8324 (CCS)
WHEREAS, the City Council of the city of Santa Monica,
on the 12th day of November 1991, passed and adopted its
Resolutlon of Intention, being Resolution No. 8324 (CCS) setting
a public hearing; and
WHEREAS, Resolution of Intention duly and legally was
published as required by law and written notice of said
improvement has been given in the manner required by law~ and
WHEREAS, any and all written objections and protests to
the proposed work or the extent of the district to be assessed
were heard and considered by the City Council: and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1.
The public convenience and necessity
requires the construction of concrete pavement and appurtenant
work on LINCOLN COURT BETWEEN OLYMPIC BOULEVARD AND MICHIGAN
AVENUE, within the City of Santa Monica.

SECTION 2. All protests and objections of every kind
and nature to the construction of concrete pavement and
appurtenant work on LINCOLN COURT BETWEEN OLYMPIC BOULEVARD AND
MICHIGAN AVENUE, as described in section 1, within the City of
Santa Monica, be, and the same are hereby, overruled and denied.
SECTION 3.
Pursuant to the streets and Highways Code
section 5880, the street Superintendent is directed to commence
the construction of concrete pavement and appurtenant work above-
described after a sixty (60) day period after giving notices
wherever the property owners have not started the alley
reconstruction themselves.
SECTION 4 .
The City Clerk shall certify to the
adoption of the Resolution, and thenceforth and thereafter the
same shall be in full force and effect.
