SR-10-A (80) IDA EPWM CIVIL CP AA RO s.\sp1753\cc1753-2 doc CouncIl Meeting August 10, 1999 Santa MOnica, Callforn&.UG ~ ~ TO Mayor and CIty CouncIl FROM City Staff SUBJECT Recommendation to Hold a Public Heanng and Adopt the Resolution Ordermg the Vacation of Excess Street Right-of Way and Public Service Easements at WIlshIre Place and FIfteenth Court Alleys IntroductIon This report recommends that the City Council hold a public heanng to hear comments from the public regarding the proposed vacation of public access and utility easements located at WilshIre Place and FIfteenth Court ThIs report also recommends adoptIon of the resolutIon ordermg the vacation of these easements Background From Its InceptIon In 1926, Santa MOnica Hospital Medical Center has functioned as a non-profit, full-servrce, communlty-based medIcal center The hospital suffered significant structural damage as a result of the 1994 Northndge Earthquake, requlnng temporary closure Followmg substantial mtenm structural repairs, the hospital tower reopened rn 1995. WIth requirements established by the Office of Statewide Health Plannmg and Development that the hospital tower must either be replaced or upgraded to current codes by 2003 1 lOA AUG 1 ~ ~,..~,... In August 1995, the hospital was acqUired by the University of California (UCLA), and renamed the Santa Monica-UCLA MedIcal Center (8M-UCLA-MC) Following a detailed assessment of the earthquake damage, and completion of the 8M-UCLA-MC Master Plan Study, UCLA determmed that repalnng the hospital tower would prove unacceptably disruptIve to patient care and not be cost effectIve Instead. they recommended the construction of a new tower and the acquIsition of three commercial properties fronting Wilshire Boulevard to accommodate a replacement bUilding In conjunction With the acquIsitIon, UCLA has requested that the City take action to vacate the public utIlity and rrght-ot-way easements located In W,lshire Place South and Frfteenth Court alleys (see Attached Legal Descnptlons and Site Maps ot the subject area) DISCUSSion The proposed site for the replacement medIcal taclllty encompasses the entire City block bounded by WilshIre Boulevard and Anzona Avenue, between 15th and 16th Streets In conjunction With Its acquIsItion at the parcels along Wilshire Boulevard, UCLA requests that the City vacate ItS publiC utIlity and nght-ot-way easements located In Wilshire Place South In addition, they request the vacation at public utility easements reserved by Resolution Number 3610 (CC8) adopted In 1967 In connection With the vacatIon ot the nght-ot-way easement In a portion of 15'h Street Court 2 Legal descnptlons of properties are provided In Exhibit A of the attached Resolution, as well as a site survey map showmg the alley and easements to be vacated Completion of the vacation proceedings shall be contingent upon 1) UCLA obtaining ownership of the properties located at 1512-1524 Wilshire Boulevard and 1502 Wilshire Boulevard. and 2) taking all steps necessary to relocate existing utility facilities to the satisfaction of each utility provider and the City Engmeer Relocations will be performed at UCLA's sole expense On July 13, 1999 the City Council of the City of Santa MOnica adopted Resolution No 9423 (CCS) settmg the matter for publtc hearmg and declanng ItS mtent to order vacatIon of the excess public street right-of-way and public servIce utIlIty easements located at the site On July 22 and 29, 1999 notices of the proposed vacatIon proceedIngs were publIshed In the Arqonaut On July 19, 1999 notices of the proposed vacation proceedings and publiC hearing were posted along the areas to be vacated Publication and postmgs was done In accordance With California Streets and Highways Code Sections 8322 and 8323 BudqetlFmanclallmpact No SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ORDERING THE VACATION OF EXCESS STREET RIGHT-OF-WAY AND PUBLIC SERVICE UTILITY EASEMENTS IN WILSHIRE PLACE SOUTH AND 15TH COURT ALLEYS IN THE CITY OF SANTA MONICA WHEREAS, the City of Santa MOnica has determmed that the public nght-of-way and public servrce utrllty easements In the real property descnbed In SectIon 1 and the attached Exhibits A and B (the "Property") of this Resolution are no longer needed for the purposes acqUired and that said excess public nght-of-way and the public service utility easements located therern are not needed for street or any other publIc use, and WHEREAS, The Regents of the University of California, a California Constitutional corporatIon ('U nlverslty of California") owns or will acquire certam real property abutting the Property and has requested that the City vacate the street nght-ot-way easements and public seNlce utility easements located on, above, or beneath the Property In order to faCIlitate Its construction of a replacement facIlity for the Santa MOnica-UCLA Medical Center (the 'ProJect"), and WHEREAS, on July 13,1999, the City Council of the City of Santa MOnica adopted Resolution No 9423 (eCS) setting the matter for public heanng and declarmg Its Intent to order vacation of the excess public street nght-of-way easements and public service utility easements located on, above and beneath the Property, and WH E REAS, on July 22 and 29. 1999 notices of the proposed vacation proceedings were published as reqUired by California Streets and Highways Code Section 8322, and WHEREAS, on July 19,1999, notices of the proposed vacatIon proceedmgs were posted as required by CalifornIa Streets and Highways Code Section 8323, and WHEREAS. the Environmental Impact Report ("EIR") for the Project provides that the University of California, at Its sole cost and expense, will relocate utility lines and appurtenant structures ("'Utility FacilIties") located on, above or beneath the Property which are affected by the Project, and WHEREAS, as a condition to the vacation of the public street nght-ot-way and publIC service utIlity easements located on, above or beneath the Property the City Will require that the University of California, at Its sole expense, take all steps necessary to assure relocation of the Utility Faclhtles to the satIsfactIon of each respective utility proVider and the City Engrneer, and WH EREAS. vacation of the Property must be completed In order that the Umverslty of California may proceed With the construction of the Project In accordance With the EIR, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOllOWS SECTION 1 The City Council of the City of Santa MOnica orders vacation of the excess street nght-of-way easements and publiC service utility easements located on, above and beneath Wilshire Place South and 15th Court alleys In the City at Santa MOnica, as more particularly descnbed In the legal descnptlons set forth In Exhibit "A", and depicted In the draWing attached as Exhibit 'B.', both of which are attached hereto and Incorporated herein by reference SECTION 2 Completion of the vacation proceedings and recordation of a resolution ordenng vacation of the publiC nght-of-way and public service utility easements shall be contingent upon the UniversIty of Callforma (I) obtaining fee Simple ownership 2 of the properties located at 1512-1524 Wilshire Boulevard and 1502 WIlshire Boulevard, (II) taking all steps necessary to relocate eXisting Utllity FacIlities to the satIsfaction of each respective utility provider and the City Engineer, and (III) the University of California's beanng of all costs associated with the relocation of the
