SUBJECT: Planning Commission Action
On June 21, 1982 the Planning Commission approved a motion
requesting the City Council consider withdrawing the
automatic protest of an off premise beer and wine license
for a proposed new Mini-Mart on Main Street and that it be
considered by the Council on June 22nd.
A staff report is attached 1f the matter is considered by
the Council.

Opposition to a Requested Liquor License on Main
Street be Withdrawn for Establishment of a New Food
Market .'
Introductl.on
This report transmits the Planning Comm~ssion's recommendation
that the City Council direct the Plann~ng Director to withdraw
opposition to an application for an off-premise beer and wine
license by a proposed Mini-Market at Main and Mar~ne.

In 1979 the City Council directed the administration to officially
oppose issuance of add~tional ll.quor licenscson Main Stre~t. Since
that date the Planning Director has filed a written opposition to
all applicat10n notices recel.ved from the State Department of
Alcoholic Beverage Control.
On April 7, 1982 of this year an application for an off-premise
beer and w~ne license was filed by Southland Corporation for a
proposed 7-11 store at 3100 Main Street and duly opposed in
accordance with the Councilfs directive~ On June 17, 1982 the
city was notified by ABC that the application was w~thdrawn by
Southland Corporation and that should a new applicatlon be filed
by a new applicant within one year for the same address, the City's
protest be automat1cally re1nstated against the new applicant.

On June 21, 1982 the Planning Commission conditionally approved
an Interim Development Permit for a Mini-Market by a different
applicant at the same address and also a motion requesting the
City Council to authorize withdrawal of the protest against
~5suance of a liquor license. The applicant indicates that the
market is not economically feasible without the ability to sell
packaged beer and wine. The CO~~i5sion requested that this
request be placed before the City Council at the meeting of
June 22, 1982 to expedite consideration.
Alternatives
The Council may withdraw opposit~on to the requested licese or
allow it to remain ~n effect. The appeal period on the Interim
Development Permit runs out on July 10, 1982. Dur2ng this period
the Commission action may be appealed to the City Council."
Recommendation
It is respectfully recommended that the City council defer action
1n regard to the liquor license until the appeals period has
expired and in the event the Commission's action is appealed the
question of the liquor 1~cense be consldered slmultaneollsly with
the appeal.
