This improvement was completed in conjunction with the 1991-92 street Resurfacing Program. Backqround The City's policy is to assess commercial and residential property owners for certain public works improvements using the Improvement Act of 1911. These include gutter construction, street and alley paving, tree planting and streetlighting. On November 12, 1991, city Council approved the formation of an assessment district for the reconstruction and appurtenant work on Lincoln Court between Olympic Boulevard and Michigan Avenue. Lincoln Court was in extremely poor condition along the full length of the alley containing numerous irregularities and potholes. There was also a drainage problem caused by flat grade of the alley. Due to the extent of the needed repairs, patching - 1 - I ()--,f f.." - .~ ., ~ --.' _t ~ . jij. was not feasible. Thus, reconstruction was required. The reconstruction of Lincoln Court consisted of grading and replacing the existing deteriorated asphalt paving with new concrete paving. The life of the new concrete alley is estimated to be in excess of 50 years. On November 22, and December 5, 1991 notices of the public hearing was posted and mailed in accordance with state law to all affected property owners. The public hearing was held on December 17, 1991 and after closing the public hearing, Council ordered the work to commence. The alley reconstruction was completed in conjunction with an annual street resurfacing project and the property owner assessments are now due. A public hearing to confirm the assessment of costs must be held pursuant to section 5882 of the California streets and Highways Code. On March 23, 1993, city Council set the public hearing for May 11, 1993. All affected property owners were notified on March 26, 1993 of the public hearing date and their assessment amount. A list of property owners and assessments amounts is attached. Discussion Industrial and commercial property owners are assessed 100% of the cost per footage or $67.25 per lineal foot. Residential property owners are assessed 50% of the cost per footage or $33.63 per lineal foot, and the City pays the other 50%. Commercial and industrial properties are assessed more than - 2 - residential properties because commercial and industrial vehicular traffic causes more wear and tear to pavements. The assessment for residential owners range from $1,680 to $3,700 per property. A similar alley assessment proj ect was completed in 1985, on Ozone Place North where property owners were assessed for a portion of the costs. Budqet(Financial Impact The total cost of this project is $38,450 which includes the city's contribution and staff time, construction, engineering, surveying, posting and mailing of notices, construction management and inspection time. It is calculated that $29,163 will be generated from property owner assessments for this street reconstruction: Commercial and industrial property owner assessments $ Residential property owner assessments Total owner assessments $ 19,875 9,288 29,163 The total cost of this project, including the City's share, has been charged to CIP Account No. 01-770-421-20092-8900-99152, "street RepairjResurfacingll. Cash revenues will be received in FY 1992-93 and any unpaid assessments will be placed on the 1993-94 property tax roll by the Los Angeles County Assessor's Office. Revenues will be deposited in Account Number 01-500-401-00000-0124-10000, "street Resurfacing Assessment District. II - 3 - Recommendation It is recommended that City Council: 1) Open the public hearing; 2) Close the public hearing; and 3) Acknowledge any protests and adopt the attached resolution confirming the assessment of costs. SECTION 4. The Superintendent of Streets shall forthwith attach a warrant to sald assessment bearlng the date of this confirmation. SECTION 5. The assessment roll, warrant, and diagram shall be recorded in the Office of the Superi ntendent of Streets, and immedi ately thereafter the City Clerk shall file a copy of the assessment diagram in the Office of the County Recorder, and thereafter shall record in said Office of the County Recorder a Notice of Assessment, all in the manner and form - 2 - -- ~ --- - prescribed by Section 3114 of the Streets and Highways Code of the State of California. SECTION 6. Assessments not pald to the City wlthin the specified time shall be sent to the Los Angeles County Assessor to collect such assessments upon the tax roll which general taxes are collected. SECTION 7. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter, the same shall be in full force and effect.
