GS:SES:LR:pam/CC1352PH.tech.engine Council Meeting: June 15, 1993 Santa Monica, California TO: Mayor and City Council FROM: City staff SUBJECT: Recommendation to Hold a Public Hearing for Establishing an Assessment District for the FY 92-93 Annual street Resurfacing Program and Appurtenant Work Introduction It is recommended that City council hold a public hearing for establishing an assessment district for constructing and replacing concrete gutters; resurfacing streets, sidewalks and appurtenant work. These improvements are in conjunction with the FY 92-93 annual street Resurfacing Program at various commercial, industrial, residential locations in the City. Background On April 13, 1993, the City Council adopted Resolution No. 8571 (CCS) setting a public hearing to hear protests concerning the gutter construction; street resurfacing; slurry sealing; parkway pavement removal; curb ramp construction; replacement of curb and gutter, and sidewalk and driveway construction at various locations in the city. The criteria used to select which streets and the method of repair include: age, drainage, surface and subsurface conditions, complaints received, type of use (i. e. , commercial and residential) , current traffic volume, and projected change of use or traffic volume of the streets. Notices of the public hearing were mailed to property owners on - 1 - It) -4- JUN 1 .~) . !;3 April 23, and May 27, 1993 and posted on the streets, in accordance with the state La'itl. In accordance with a 1981 city council policy, residential properties are assessed one half the cost of removal and replacement of damaged curbs, sidewalks, driveways and the removal of damaged parkway pavement. Commercial properties are assessed the full cost of repair of this work. Residential properties are not assessed for new gutter construction or street resurfaclng; however, commercial and industrial property owners are assessed the full cost. The proposed assessments are designed so that each commercial and industrial property owner pays the same unit cost regardless of the width of the street on which their property fronts. Consistent with the present policy for assessing commercial and industrial properties this assessment will be a cash assessment and no bonds will be issued. The total estimated assessment for a commercial or industrial property owner with a 50 foot lot, is $650.00 for resurfacing, and $800.00 for new gutter construction. - 2 - Proposed Method of Spreadinq the Assessment Cost Residential Property Commercial/Ind. The assessment district will be administered in accordance with the procedures set forth in the Improvement Act of 1911 of the California streets and Highways Code and the Government Code. Budqet/Financial Analysis The assessment district will generate revenues of approximately $125,000 for FY 1993-94 which will be deposited in Revenue Account No. 01-500-401-00000-0124-10000, "street Resurfacing Assessments." Cash revenues will be received in FY 94-95. Any unpaid assessments will be placed on the 1995-96 tax roll. The estimated cost for this annual street resurfaclng program is $614,000. There is $614,000 budgeted ln various Capital Improvement accounts for this program. FOR STREET RESURFACING AND GUTTER CONSTRUCTION: Commercial and industrial property owners will be assessed approximately $16.00 per linear foot for gutter construction and $13.00 per linear foot for street resurfaclng. Residential Property owners will not be assessed. FOR SIDEWALKS, DRIVEWAYS AND CURBS AND PARKWAY PAVEMENTS: Commercial, industrial and residential property owners will be assessed the full cost of $6.00 per square foot for sldewalks, $7.50 per square foot for driveways, $15.00 per llnear foot for curbs, and $3.00 per square foot for parkway pavement removal. However, for the portion of the areas damaged by roots from a parkway tree, the residential property owner is assessed only 50% of the costs. The city will pay the balance. You may do the work yourself or hire a private contractor. The City will provide the concrete to do the work if the damage was caused by parkway tree roots. Replacing private survey markers located in the sidewalk where the repair is made is the sole responslbility of the property owner. Repairs must meet Santa Monica Standard Specification No. 24 for construction of Curbs, Sidewalks and Driveways and Plan No. 1122. Section 5614 calls for the Street Superintendent to repair da~aged s~dewalks, drlveways and curbs two (2) weeks after g~ving notice and where property owners have - 7 - not diligently and without interruption prosecuted the repair work to completion.
