SUBJECT: Recommendation to Hold a Public Hearing for Establishing
an Assessment District for the Annual street Resurfacing
Program and Appurtenant Work
Introduction
It is recommended that the City Council hold a public hearing on
forming an assessment district to construct concrete gutters,
resurface streets, repair damaged sidewalks, driveways and curbs,
and remove damaged pavement in parkway areas. These improvements
wlll be in conjunction with the FY 1993-94 Street Resurfacing
Program at various commercial, industrial and residential locations
in the City.
Backqround
On March 22, 1994, the City Council adopted Resolution No. 8735
(CCS) setting a public hearing to hear protests concerning
establishing an assessment district for gutter construction, street
resurfacing, slurry sealing, parkway pavement removal, curb and
sidewalk repairs, and driveway construction at various locations in
the city. The streets that have been selected were inspected and
evaluated as ranking high on the "Pavement Management System
Report" as streets in need of repair.
The cri terla used to
determine the streets to be included in this year's program and the
method of repair include: age, drainage problems, surface and

subsurface conditions, complaints received, type of use (i.e.,
commercial or residential), current traffic volume, and projected
change of use or traffic volume of the streets.
In accordance with the 1979 city council policy decisions,
residential properties are assessed at one half the cost of removal
and replacement of damaged curbs, sidewalks, driveways and parkway
pavement. Commercial properties are assessed the full cost of
repair of this work.
Residential properties are not assessed for new gutter construction
or street resurfacing; however, commercial and industrial property
owners are assessed the full cost of new gutter construction and
street resurfacing. The proposed assessments are calculated such
that each commercial and industrial property owner(s) pays the same
unit cost regardless of the width of the street on which their
property fronts. Consistent with the present policy for assessing
commercial and industrial properties, this assessment will be a
cash assessment and no bonds will be issued. Total estimated
assessment for a commercial or industrial property owner with a 50
foot lot would be $925 for resurfacing, and $1,150 for the gutter
construction.

The unit costs include staff time in conducting engineering
surveys, the posting and mailing of notices, construction
management and inspection, and construction. Some corner lots will
be assessed at 50% of the street resurfacing and gutter
construction costs instead of 100% of the costs.

The assessment district will be administered in accordance with the
procedures set forth in the Improvement Act of 1911 of the
California streets and Highways Code and the Government Code.
Notices of public hearing were mailed to property owners on April
8, 1994, and posted on the streets, in accordance with the state
Law. A list of affected property owners is attached to this staff
report.
Budqet/Financial Analysis
The assessment district will generate for FY 1994-95 revenues of
approximately
$80,000
for
street
resurfacing
and
gutter
construction to be deposited in revenue account number 01-500-402-
00000-0124-10000, and the amount of $60,000 for sidewalk, driveway
and curb repa1rs to be deposited in revenue account number 01-500-
421-00000-0179-10000.
The estimated cost for this street
resurfacing is $615,000. There is $615,000 budgeted in various CIP
accounts for this program:

Recommendation
It is recommended that the City Council:
1) Open the public hearing;
2) Close the public hearing; and
3) Adopt the attached Resolution establishing an assessment
district for constructing concrete gutters, resurfacing
streets, and repairing sidewalks, driveways, curbs, and
removing damaged pavement in parkway areas and conducting
appurtenant work.

impondra $23 por cada pie lineal de construcci6n de desagues y
$18.50 par cada pie lineal de repaVimentacion de calles. Los

PAVIMENTACION DE ACERAS, ACCESC A GARAJES, Y ZANJAS: Alas

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA ORDERING THE CONSTRUCTION OF CONCRETE GUTTERS,
STREET RESURFACING, SIDEWALK, DRIVEWAY AND CURB REPAIRS
AND THE REMOVAL OF DAMAGED PARKWAY PAVEMENT AND
APPURTENANT WORK ON VARIOUS CITY STREETS, IN CONJUNCTION
WITH THE FY 1993-94 STREET RESURFACING PROGRAM
WHEREAS, the City Council of the City of Santa Monica on the
22nd day of March, 1994, adopted Resolution No. 8735 (CCS) setting
a public hearing~ and
WHEREAS, wrl tten not lees and posting of sald lmprovements have
been given in the manner required by law~ and
WHEREAS, any and all written obJections and protests to the
work of the extent of the distrlct to be assessed wl11 be heard and
be considered by the City Council,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:

constructlon of concrete gutters, street resurfaclng and repalr of

SECTION 2.
All protests and objections of every kind and
nature to the proposed work are hereby overruled and denied.
SECTION 3.
Pursuant to streets and Highways Code section
5880, the street Superintendent is directed to' commence the
construction of concrete gutters and street resurfaclng sixty (60)
days after giving notice.
Section 5614 calls for the Street
Superintendent to repair damaged sidewalks, driveways and curbs two

(2) weeks after giving notice and where property owners have not
diligently and without interruption prosecuted the repair work to
completion.
SECTION 4.
The City Clerk shall certify to the adoption of
this Resolution, and thereafter the same shall be in full force and
effect.
