ThlS report recommends that the Clty Council hold a public hearing
for the formatlon of an assessment distrlct for constructing and
repalring concrete gutters and sidewalks, for resurfacing streets,
for lmproving alleysr and for completlng the appurtenant workr and
a~lowlng commercial and lndustrial property owners to pay for their
assessments lD lnstallments
These lmprovements are to be
performed lD ~ulflllment of the FY 1995-96 Annual Street
Resurfaclng Program at various commercial,

resldentlal locatlons
Background
On October 10 r 1995, the Clty Councll adopted Resolution No
8945 (eeS) to set a publlC hearing for December 12r 1995. On

December 12, 1995, the public hearing was opened and then contlnued
to February 13, 1996.
The purpose of the public hearing is to
declare the Clty'S lntentlon to assess property owners for costs
and hear protests regarding the proposed work.
The FY 1995-96
Annual Street Resurfaclng Program lncludes gutter construction,
street resurfacing, alley improvements, slurry sealing, parkway
pavement removal, curb ramp construction, curb and gutter repa~rs,
bus
pad
construct lon,
sldewalk
and
driveway
repalr
and
constructlon. Thls program also includes earthquake-related bridge
and parklng lot repalrs at various locations In the City. The
criteria used to determine the streets and alleys included in thls
year's program and the method of repair include: age, drainage
problems, surface and subsurface condltlons, complaints recelved,
type of use (i. e., commercial or resldential), current traffic
volume, and proJected change of use or trafflc volume.
In accordance wlth the 1979 City Councll policy, resldential
propertles are assessed one half the cost of removal and
replacement of damaged curbs, sidewalks, driveways, and parkway
pavement and are not assessed for new gutters, street resurfacing,
or alley reconstruction.
Commerclal propertles are assessed the
full cost of all repair work

The asphalt pavlng assessment 1S calculated so that commercial
property owners pay the same respect1ve unit cost regardless of the
width of the street affecting the1r property. Typical assessments
for commerclal or industrial property owne~s with a 50-foot lot
are $1,075 for street resurfacing, $1,150 for new gutter
constructlon, $3,500 for alley lmprovements, and $300 for sldewalk
repairs
Typical assessments for residential property owners w1th
a 50-foot lot are $150 for sidewalk repair and $187.50 for driveway
repair.

The attached resolution w1ll amend the Resolutlon of Intention
8495 (CCS) adopted on October 10, 1995. That resolution stated that
bonds will be issued for alley reconstruct1on only, however, staff
recommends Council offer the bond payment method as one of two
payment opt1ons to commercial and 1ndustrial property owners withln
the street resurfac1ngjgutter construct1on and alley reconstruction
assessment district.
Some of the above-mentloned propertles may
also have sldewalk, driveway, and curb repalTs.
Because of the
costs associated with alley reconstruction, street resurfac1ng,
gutter, curb, parkway and sldewalk construction, commercial and
lnaustr1al property owners will have the optlon of making

lnstallment pa~ents plus interest at an ann~al rate of 8.75% over
10 years as a part of bond financlng for these improvements.
Notlces of the Clty'S intent to form an assessment district and
hold a publlc hearing were posted on October 24, 1995 and affected
property owners were notlfled by mail on October 20 and 24, 1995 of
the time and place of the hearing ln accordance wlth state law. On
December 12, 1995, the public hearing was continued to February 23,
1996,
ln order to meet
the Government
Code notiflcation
requirements.
Notlces of the public meetlng and public hearing
were mailed to affected property owners on December 28, 1995, and
posted on December 20, 1995. A Notlce was also published In The
Outlook on December 29, 1995, and on January 4 and la, 1996. City
staff held a publlC meeting on January 24, 1996 with affected
property owners and heard publlC comments
A list of property owners with estimated assessment amounts is
attached to this report. The assessment map wlll be available to
the Clty Cauncll at the tlme of the publlc hearlng.

The unlt costs are set by the Superintendent of Streets, and are
perlodlcally updated to reflect current costs

Corner lots are assessed either 50% or 100% depending on legal
address.
Owners of corner lots where the legal address lS the
street belng repalred pay 100% of applicable repair work. If the
legal address is the adJacent street, the property owner pays 50%.
Corner lots have the potentlal of being assessed for both sides of

thelr lot If both streets are improved.
This policy eases the
lmpact on corner lots by assesSlng 100% on one street and 50% on
the cross street.

This

sources such as the General Fundr Water and Wastewater Funds,
earthquaker and Propos1tlons A & C funds. Revenue of approx1mately
$227,000 for the repalr of sidewalksr driveways and curbsr and the
removal of pavement In parkway areas wlll be deposited in Revenue
Account No. 01-500-421-00000-0179-10000, nSidewalk Repair Revenue."
For commerclal and lndustrlal properties, assessments in the
estimated amount of $422,800 wlll be paid by affected property
owners upon complet1on of the work and wlll be held ln a trust
account no
80-000-000-00000-9750-04289 pending payment to the

contractor.
Bonds are issued for any unpaid assessments.
Bond
proceeds are paid to the contractor and the property owner(s) then
pay the bond holder(s} over time.
A detalled breakdown of assessments wlll be available upon
conflrmatlon of assessments after the work has been completed.
Recommendatlon
It is recommended that the City Council.

2} Close the public hearing,
3) Adopt the attached Resolutlon establishing an assessment
dlstrlct for constructlng and repairing concrete gutters and
sidewalks, for resurfacing streets, for improving alleys, and
for completlng the appurtenant work; and

to allow

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA ORDERING THE CONSTRUCTION OF CONCRETE GUTTERS,
ALLEY IMPROVEMENTS, STREET RESURFACING, SIDEWALKS,
DRIVEWAYS AND CURB REPAIRS, AND THE REMOVAL OF DAMAGED
PAVEMENT IN PARKWAY AREAS AND APPURTENANT WORK, IN
CONJUNCTION WITH THE FY 1995-96 STREET RESURFACING
PROGRAM AS SET FORTH IN RESOLUTION OF INTENTION NUMBER
8945 (CCS) AND AMEND SECTION 5 OF RESOLUTION OF INTENTION
NUMBER 8945 (CCS) , IN THE CITY OF SANTA MONICA
WHEREAS, the City Council of the City of Santa Monica on the
10th day of October, 1995, passed and adopted its Resolution No.
8945 (CCS) setting a publlC hearing and describing its intention to
order work described therein to be donei and
WHEREAS, written notlces and postlng of sald improvements have
been glven in the manner required by lawi and
WHEREAS, any and all written objections and protests to the
proposed work or the extent of the distrlct to be assessed wlll be
heard and be considered by the Clty Council,
WHEREAS, sald improvements has been considered fully,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:

SECTION 2.
All protests and obJections of every kind and
nature to the proposed work are hereby overruled and den1ed
SECTION 3.
Despite reference in Section 5 of Resolution
Number 8495 to the contrary, bonds will be 1ssued for all
assessments on commercial and industrial propertles described 1n
such Resolutlon of Intention.
Resolution Number 8945 (CCS) is
hereby
amended
to
reflect
such
change.
SECTION 4.
Pursuant to Streets and Highways Code Section
5880, the Street Superintendent lS directed to commence the
construction of concrete gutters, alley improvements, and street
resurfacing Slxty (60) days after glving notice.
Section 5614
calls for the Street Superintendent to repalr damaged sidewalks,
driveways and sixty (60) days after giving notice and where
property owners have not diligently and without interruptlon
prosecuted the repair work to completion.
SECTION 5.
The City Clerk shall certify to the adoption of
this Resolution, and thereafter the same shall be In full force and
effect.
