On 1 IDA FEB '3 1996 December 12, 1995, the public hearing was opened and then contlnued to February 13, 1996. The purpose of the public hearing is to declare the Clty'S lntentlon to assess property owners for costs and hear protests regarding the proposed work. The FY 1995-96 Annual Street Resurfaclng Program lncludes gutter construction, street resurfacing, alley improvements, slurry sealing, parkway pavement removal, curb ramp construction, curb and gutter repa~rs, bus pad construct lon, sldewalk and driveway repalr and constructlon. Thls program also includes earthquake-related bridge and parklng lot repalrs at various locations In the City. The criteria used to determine the streets and alleys included in thls year's program and the method of repair include: age, drainage problems, surface and subsurface condltlons, complaints recelved, type of use (i. e., commercial or resldential), current traffic volume, and proJected change of use or trafflc volume. In accordance wlth the 1979 City Councll policy, resldential propertles are assessed one half the cost of removal and replacement of damaged curbs, sidewalks, driveways, and parkway pavement and are not assessed for new gutters, street resurfacing, or alley reconstruction. Commerclal propertles are assessed the full cost of all repair work 2 The asphalt pavlng assessment 1S calculated so that commercial property owners pay the same respect1ve unit cost regardless of the width of the street affecting the1r property. Typical assessments for commerclal or industrial property owne~s with a 50-foot lot are $1,075 for street resurfacing, $1,150 for new gutter constructlon, $3,500 for alley lmprovements, and $300 for sldewalk repairs Typical assessments for residential property owners w1th a 50-foot lot are $150 for sidewalk repair and $187.50 for driveway repair. Payment ODt1ons - - The attached resolution w1ll amend the Resolutlon of Intention 8495 (CCS) adopted on October 10, 1995. That resolution stated that bonds will be issued for alley reconstruct1on only, however, staff recommends Council offer the bond payment method as one of two payment opt1ons to commercial and 1ndustrial property owners withln the street resurfac1ngjgutter construct1on and alley reconstruction assessment district. Some of the above-mentloned propertles may also have sldewalk, driveway, and curb repalTs. Because of the costs associated with alley reconstruction, street resurfac1ng, gutter, curb, parkway and sldewalk construction, commercial and lnaustr1al property owners will have the optlon of making 3 lnstallment pa~ents plus interest at an ann~al rate of 8.75% over 10 years as a part of bond financlng for these improvements. Notlces of the Clty'S intent to form an assessment district and hold a publlc hearing were posted on October 24, 1995 and affected property owners were notlfled by mail on October 20 and 24, 1995 of the time and place of the hearing ln accordance wlth state law. On December 12, 1995, the public hearing was continued to February 23, 1996, ln order to meet the Government Code notiflcation requirements. Notlces of the public meetlng and public hearing were mailed to affected property owners on December 28, 1995, and posted on December 20, 1995. A Notlce was also published In The Outlook on December 29, 1995, and on January 4 and la, 1996. City staff held a publlC meeting on January 24, 1996 with affected property owners and heard publlC comments A list of property owners with estimated assessment amounts is attached to this report. The unlt costs are set by the Superintendent of Streets, and are perlodlcally updated to reflect current costs They include staff tlme ln conductlng engineering surveys, posting and mailing of notlces, construction management, lnspection and constructlon. Corner lots are assessed either 50% or 100% depending on legal address. Owners of corner lots where the legal address lS the street belng repalred pay 100% of applicable repair work. If the legal address is the adJacent street, the property owner pays 50%. Corner lots have the potentlal of being assessed for both sides of 5 thelr lot If both streets are improved. This policy eases the lmpact on corner lots by assesSlng 100% on one street and 50% on the cross street. For commerclal and lndustrlal properties, assessments in the estimated amount of $422,800 wlll be paid by affected property owners upon complet1on of the work and wlll be held ln a trust account no 80-000-000-00000-9750-04289 pending payment to the 7 contractor. Bonds are issued for any unpaid assessments. Bond proceeds are paid to the contractor and the property owner(s) then pay the bond holder(s} over time. A detalled breakdown of assessments wlll be available upon conflrmatlon of assessments after the work has been completed.
