JO-A Cal i for...llJW 1 8 199' GS:SES:LR:bat/CCI127PH.tech.engine council Meeting: June 18, 1991 Santa Monica, TO: Mayor and city council FROM: City staff SUBJECT: Recommendation to Hold Confirmation of Gutter Resurfacing Assessments on Eighth street and the East a Publ ic Hearing for the Construction and street pi co Boulevard between Twenty City Limits Introduction This report recommends that the City Council hold a public hearing to hear protests regarding the work and to confirm the assessments for gutter construction and street resurfacing on pico Boulevard between Twenty Eighth street and the East City limits. Backqround The reconstruction of pico Boulevard between Twenty Eighth Street and the East City limits was approved by City Council in FY 1985-86 as a Federal Aid Urban capital improvement project. This project experienced delays in the design and construction phase including approximately 18 months in obtaining Caltrans approval to advertise. The project includes the construction of concrete bus pads, curbs, gutters, and curb ramps, and asphalt concrete resurfacing and asphalt concrete reconstruction in certain areas of the city. Only commercial and industrial property owners will be assessed. The assessed costs are: 1) $9.50 per lineal foot which is 100% of the cost of gutter construction, and 2) $7.50 per lineal foot which is 50% of the cost of the street resurfacing. The total assessment is $17.00 per lineal foot when construction of both lo-A- JUN 1 -8 1991 . items is necessary in front of a property. . property owners were notified in accordance with state law and the public hearing was held February 23, 1988. After closing the public hearing, the council ordered the work to commence. The work is completed, and commercial and industrial property owner assessments are now due. A public hearing to confirm the assessments must be held pursuant to section 5882 of the California streets and Highways Code. On May 14, 1991, the city Council set the public hearing for June 1.1, 1.991.. Notices of public hearing were sent to commercial and industrial property owners on May 24, 1991. A list of property owners and assessments will be available to Council at the time of the public hearing. BUdget/Financial Impact Approximately $34,168.73 will be generated from property owner assessments. Revenue will be deposited in Account No. 01-500- 401-00000-0124-10000, "street Resurfacing Assessment District", during FY 1991-92. Any unpaid assessments will be put on the 1991-92 property tax rolls by the Los Angeles County Assessor's office. Recommendation It is recommended that the City council: 1. Open the public hearing; 2. Close the public hearing: 3. Acknowledge any protests; and 4. Adopt the attached resolution confirming the assessments. RESOLUTION NO. 8243 (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA APPROVING THE ASSESSMENT DIAGRAM AND CONFIRMING ASSESSMENTS FOR STREET RESURFACING AND GUTTER CONSTR~CTION ON PICO BOULEVARD BETWEEN TWENTY-EIGHTH STREET AND EAST CITY LIMITS WHEREAS, the City of Santa Monica, pursuant to section 5100 et seq. of the streets and Highways Code, commenced proceedings to resurface streets and construct gutters on: PICO BOULEVARD BETWEEN TWENTY-EIGHTH STREET AND EAST CITY LIMITS all within the City of Santa Monica; and WHEREAS, the proceeding is more fully described in the Resolution of Intention adopted by the City council on January 26, 1988, being Resolution Number 7545 (CCS); and WHEREAS, the contract for the above-described work has been fulfilled to the satisfaction of the Superintendent of Streets; and WHEREAS, the Superintendent of Streets has made an assessment to cover the sum due for the work performed and specified in the contract; and WHEREAS, the assessment has been filed with the city Clerk; and WHEREAS, the City Clerk gave the notice required by Sections 5362 and 5363 of the Streets and Highways Code; and . . WHEREAS, upon the day and hour fixed for hearing by the Clty Clerk, the city Council of the Clty of Santa Monica heard and passed upon any and all objections, appeals, and protests, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1 . All obj ections, appeals, and protests of every kind and nature be, and the same are hereby, overruled and denied. SECTION 2. The diagram of property, affected and benefited by the street resurfacing and gutter construction on: PICO BOULEVARD BETWEEN TWENTY-EIGHTH STREET AND EAST CITY LIMITS in the city of Santa Monica, as more fully described in Resolution Number 7545 (CCS) and therein declared to be the property to be assessed to pay the expense of the improvements, is approved and the City Clerk is directed to execute the certificate on the diagram certifying such approval and to deliver the diagram to the Superintendent of Streets. SECTION 3. The assessment for the street resurfacing and gutter construction on: PI CO BOULEVARD BETWEEN TWENTY-EIGHTH STREET AND EAST CITY LIMITS as more fully described in Resolution Number 7545 (CCS)/ be, and the same hereby is, confirmed and approved. SEC'rION 4. The Superintendent of Streets shall forthwith attach a warrant to said assessment bearing the date of this confirmation. SECTION4t. . The assessment roll, warrant, and diagram shall be recorded in the Off1ce of the Superintendent of Streets, and immediately thereafter the City Clerk shall file a copy of the assessment diagram in the Office of the County Recorder, and thereafter shall record in said Office of the County Recorder a Notice of Assessment, all in the manner and form prescribed by Section 3114 of the Streets and Highways Code of the state of California. SECTION 6. Assessments not paid to the City within the specified time shall be sent to the Los Angeles County Assessor to collect such assessments upon the tax roll which general taxes are collected.
