SUBJECT: Hold Public Hearing on Proposed Streetlighting District
on Sixth Street Between Santa Monica Boulevard and
Arizona Avenue
Introduction
This report requests city Council hold a public hearing to
determine
the
convenience
and
necessity
of
constructing
streetlights and to order the work on Sixth Street between Santa
Monica Boulevard and Arizona Avenue.
Background
The City's policy is to assess commercial property owners for
certain pUblic works improvements using the Improvement Act of
1911.
These include gutter construction, street and alley
paving, tree planting and streetlighting.
On September 10, 1991, the City Council adopted Resolution of
Intention No. 8287 (CCS) setting a public hearing for the purpose
of determining whether pUblic convenience and necessity require
the construction of streetlighting and declaring its intention to
construct
streetlighting and appurtenant work.

recommending that streetlights be installed on sixth street for
the safety and convenience of the facilities on that street. The
YMCA and the city Main Library are located on sixth street
between Santa Monica Boulevard and Arizona Avenue.

Any interested
party may address City Council regarding the proposed work or
improvements.
Notices of Public Hearing were mailed to each
property owner, and posted on the street fifteen days in advance
of the public hearing (September 19, 1991) in the manner
prescribed by State Law. A list of property owners and a copy of
the proposed assessment diagram will be available for review in
the Council Chambers at the time of the public hearing.
Budget/Financial Impact
The total estimate for the project is $14,000.00. The proposed
breakdown is as follows:

Appropriation authority is available in Account No. 01-770-453-
25491-8917-99155, "New Streetlight Systems", for the City's
contribution. The remaining costs for the project will be paid
through property owner assessments.
Recommendation
It is recommended that city council:
1. Open the public hearing on the convenience and necessity of
the proposed streetlighting district, as described in the
Resolution of Intention;
2. Close the public hearing; and

3. Acknowledge any protests and adopt the attached resolution
finding that the public convenience and necessity requires
the construction and hereby ordering the work to begin.

IMPROVEMENT ACT OF 1911
STREETLIGHTING ASSESSMENT PAYMENT PROCEDURES
Through the state of California Improvement Act of 1911, it is
possible for a majority of the property owners of a neighborhood
to obtain improvements such as streetlighting. The Act provides
that the costs of the improvements such as surveying, preparing
plans, construction costs, preparing council resolutions,
advertising, inspection, and preparing the assessment and bonds
may be assessed to the property owner.
The Improvement Act provides that the property owner may pay the
assessment:
1. By Cash. Cash payments may be made within 30 days after
the assessment is confirmed. After 30 days, cash
payments may still be made but interest must be charged.
OR
2. By Installment Payments. Payments may be made in
10 annual installments plus interest which is billed
semi-annually. The unpaid balance may be paid at any
time an interest payment is due.

CITY OF SANTA MONICA FINDING THE PUBLIC
CONVENIENCE AND NECESSITY REQUIRES THE
CONSTRUCTION OF STREETLIGHTING AND
APPURTENANT WORK AND ORDERS WORK TO BEGIN
ON SIXTH STREET BETWEEN SANTA MONICA
BOULEVARD AND ARIZONA AVENUE AS SET FORTH
IN RESOLUTION OF INTENTION NUMBER
8287 (CCS)
WHEREAS, the city Council of the City of Santa Monica,
on the 10th day of September 1991, passed and adopted its
Resolution of Intentlon, being Resolution No. 8287 (CCS),
declaring its intention to order work described thereln to be
done, which Resolution of Intention duly and legally was
publlshed as required by law and notice of said improvement has
been given in the manner required by law and all written
obJections and protests to the proposed work or the extent of the
district to be assessed were heard and considered by the city
Council; and
WHEREAS, a public hearing has been held duly and
regularly pursuant to Resolution No. 8287 (CCS) and the laws and
constitution of the State of California on the proposed
construction of streetlighting and appurtenance work thereto, as
described in the Resolution No. 8287 (CCS), on SIXTH STREET
BETWEEN SANTA MONICA BOULEVARD AND ARIZONA AVENUE, wlthin the
city of Santa Monica.
WHEREAS, said improvement has been considered fully,

NOW! THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The public interest and convenience
require, and the City Council of the city of Santa Monica hereby
orders, the work described in Resolution No. 8287(CCS} to be done
on SIXTH STREET BETWEEN SANTA MONICA BOULEVARD AND ARIZONA
AVENUE, within the City of Santa Monica.
Any and all of said protests and obj ections of every
kind and nature to the proposed work or to the extent of the
distrlct to be assessed be, and the same hereby are, overruled
and denied.
SECTION 2. The city Council hereby finds and
determ1nes further that "special Assessment Investlgation,
Limitation, and Majority Protest Act of 1931" shall not apply to
the making of said improvement.
SECTION 3. Improvements shall be conducted under the
Improvement Act of 1911, Wh1Ch is Divislon 7 of the Streets and
Highways Code of the State of Californla, and the street
Superintendent and the City Attorney presented to the said city
Council the Resolutlon of Intention required by sald Improvement
Act to initiate the proceedings for said improvement.
SECTION 4. After the bid package has been prepared,
the City Clerk hereby is directed to post a notice for five days
on or near the door of the City Council Chambers of the City Hall
inviting sealed proposals or bids for doing the work ordered and

referring to the speclfications on file and to publlSh a notice
inviting such proposals for two days in the outlook, a newspaper
published and circulated in said City.
SECTION 5.
Reference hereby is made to Resolution
No. 8287(CCS) for a description of the work, the assessment
district, the bonds to be issued, and for further particulars.
SECTION 6.
The city Clerk shall certify to the
adoption of this Resolution, and thenceforth and thereafter the
same shall be in full force and effect.
