SUBJECT: Hold Public Hearing on Proposed streetlighting District
on Twenty Fourth street Between Wilshire Boulevard and
Arizona Avenue
Introduction
This report requests City council hold a public hearing to
determine
the
convenience
and
necessity
of
constructing
streetlights and recommends that City Council order the work on
Twenty Fourth Street between Wilshire Boulevard and Arizona
Avenue to begin.
Backqround
On October 29, 1991, the city council adopted Resolution of
Intention No. 8314 (CCS) setting a public hearing for the purpose
of determining whether public convenience and necessity require
the construction of streetlighting and declaring its intention to
construct streetlighting and appurtenant work.
Residential
property owners are assessed 50% of front footage and 20% of side
footage costs, with the city paying the remaining 50% and 80%,
respectively.
Commercial property owners are assessed 100% of
front footage and 40% of the side footage costs, with the City
paying the remaining 60%.
Resolution 8314 (CCS) set a public
hearing for November 26, 1991, at which time any interested party
may address City Council regarding the proposed work or
improvements.

streetlight project. staff met with affected property owners on
August 14, 1991 to discuss this streetlight project. Notices of
Public Hearing were mailed to each property owner and resident,
posted on the street more than fifteen days in advance of the
public hearing (November 8, 1991) and advertised in The Outlook
in the manner prescribed by state Law. A list of property owners
and residents, streetlight petition and a copy of the proposed
assessment diagram will be available for review in the Council
Chambers at the time of the public hearing.
Budqet/Financial Impact
The total estimate for the project is $32,000.00. This is based
on a cost of $27.35 per front footage. The estimated cost for a
residential property owners' share is $550 for a 40 foot lot
fronting on Twenty Fourth Street, with the City's share being an
equal amount. The proposed breakdown is as follows:
Commercial property owner assessments $ 3,200.00
Residential property owner assessments 11,700.00
City's contribution 17,100.00
Total project estimate $32,000.00
Appropriation authority is available in Account No. 01-770-453-
25491-8917-99155, "New Streetlight Systems", for the City's
contribution. The remaining costs for the project will be paid
through property owner assessments. Assessments paid will be
held in trust in Account No. 80-000-000-00000-9750-04289 pending
payment to the contractor who installs the lights. Bonds are
then issued for any unpaid assessments. Bond proceeds are paid

to the contractor and the property owner(s) then payoff the bond
holder(s) over time.
Recommendation
It is recommended that City Council:
1. Open the public hearing on the convenience and necessity of
the proposed streetlighting district, as described in the
Resolution of Intention;
2. Close the public hearing; and
3. Acknowledge any protests and adopt the attached resolution
finding that the public convenience and necessity requires
the construction and hereby ordering the work to begin.

IMPROVEMENT ACT OF 1911
STREETLIGHTING ASSESSMENT PA~MENT PROCEDURES
Through the State of Cal1fornla Improvement Act of 1911, lt is posslble for a
maJorlty of the property owners of a nelghborhood to obtain lmprovements such
as streetllghtlng. The Act provldes that the costs of the lmprovements such
as surveYlng, prepanng plans. constructlon costs, prepanng CQuncll
resolutlons. advertlslng, lnspectlon, and prepanng the assessment and bonds
may be assessed to the property owner.
The Clty Councl1's past polley was to 1nltlate a streetl1ght1ng dlstnct lf
60% of the property owners petltloned for streetllghts. Under new procedures
adopted by the Clty Councll and the Rent Control Board, tenants also may
petltlon for streetl1ghts. In thlS lnstance, the petltlon must be slgned by
60% of the res1dents ln a streetllghtlng dlstrlct.
The Clty Councl1 presently assesses resldentlal owners one-half the cost of
lnstall wg the streetllghtlng, approxlmately $675 per 50 foot frontage The
Clty pays the remalnder of the cost. Commerclal property owners wlll be
assessed 100% of the cost per frontage. In additlon, the Clty presently pays
all malntenance costs and the cost of the energy to llght the streetllghts.
By actlon of the Clty Counell and Rent Control Board. when tenants clrculate
the petltion. the property owner may pass-through the cost to the tenants over
a la-year perlod wlth each unlt on a property paYlng the same cost. In most
lnstances, monthly charges wlll be less than S2.00 per apartment unlt, THERE
IS NO CHARGE TO EITHER PROPERTY OWNERS OR TENANTS UNTIL THE STREETLIGHTS ARE
INSTALLED AND WORKING.
The Improvement Act provldes that the property owner may pay the assessment:
1. By Cash. Cash payments may be made w1thln 30 days after the
assessmeni 15 conflrmeo. InvOlces wl1l be mal1ed to all
property owners. After 30 days, cash payments may st111 be made
but lnterest must be charged.
OR
2. By Installment Payments. Payments may be made 1n 10 annual
lnstal1ments plus lnterest wh1ch lS bllled seml-annually. The
unpald balance may be pald at any tlme an lnterest payment 1S
due. A lien wlll be placed on the property.

CITY OF SANTA MONICA FINDING THAT THE
PUBLIC CONVENIENCE AND NECESSITY
REQUIRES THE CONSTRUCTION OF

ORDERS HORK TO BEGIN ON TWENTY FOURTH
STREET BETWEEN WILSHIRE BOULEVARD AND
ARIZONA AVENUE AS SET FORTH IN
RESOLUTION OF INTENTION NUMBER 8314
(CCS)
NHEREAS, the city council of the city of Santa Monica,
on the 29th day of October 1991, passed and adopted its
Resolution of Intention, being Resolution No. 8314 (CCS) I
declaring its intention to order work described therein to be
donel which Resolution of Intention duly and legally was
published as required by law and notice of said improvement has
been given in the manner required by law and all wr1tten
objections and protests to the proposed work or the extent of the
district to be assessed were heard and considered by the City
Council: and
WHEREAS, a public hearing has been held duly and
regularly pursuant to Resolution No. 8314 (CCS) and the laws and
Constitutlon of the state of California on the proposed
construction of streetlighting and appurtenance work thereto, as
described in the Resolution No. 8314 (CCS), on TWENTY FOURTH
STREET BETWEEN WILSHIRE BOULEVARD AND ARIZONA AVENUE, within the
City of Santa Monica: and
WHEREAS, said improvement has been considered fully,

SECTION 1. The public interest and convenience
require, and the city Council of the City of Santa Monica hereby
orders, the work described in Resolution No. 8314 (CCS) to be
done on TWENTY FOURTH STREET BETWEEN WILSHIRE BOULEVARD AND
ARIZONA AVENUE, within the City of Santa Monica.
Any and all of said protests and obj ections of every
kind and nature to the proposed work or to the extent of the
d1strict to be assessed be, and the same are hereby, overruled
and denied.
SECTION 2. The ci ty Council hereby finds and
determines further that the "Special Assessment Investigation,
Limitation, and Majority Protest Act of 1931" shall not apply to
the making of sa~d improvement.
SECTION 3. Improvements shall be conducted under the
Improvement Act of 1911, which is Division 7 of the Streets and
Highways Code of the state of California, and the street
Superintendent and the City Attorney presented to the sa1d city
Counc1l the Resolution of Intention required by said Improvement
Act to initiate the proceedings for said improvement.
SECTION 4. After the bid package has been prepared,
the City Clerk hereby is directed to post a notice for five days
on or near the door of the City Council Chambers of the city Hall
inviting sealed proposals or bids for doing the wor~ ordered and

referrlng to the speciflcations on file and to publish a not1ce
invitlng such proposals for two days ln The Outlook, a newspaper
published and clrculated In sald city.
SECTION 5. Reference hereby 15 made to Resolution No.
8314 (CCS)
for a descriptlon of the work, the assessment
distrlct, the bonds to be lssued, and for further partlculars.
SECTION 6.
The City Clerk shall certify to the
adoption of thlS Resolutlon, and thenceforth and thereafter the
same shall be in full force and effect.
