the Clty Attorney reported that the matter of permlttlng Malibu
electors to be nomlnated to serve on the Cornmisslon may be
lncluded In the Code by ordinance. After addltlonal discusslon,
a Councll motlon was approved by a vote of SlX to one that the
matter of code reV1Slon be referred to the Clty Attorney and
Clty Clerk for lnput and analysls of lmplicatlons of the code
reVlslons.
The Falr Electlon Practlces Commlsslon met on Frlday June 1st.

The City Counc~l at its meeting of June l2, 1984 under agenda
ltem lO-A, approved a motion to delete from the FEPC Workplan
1 tern C in Ob)ectl ve 3. Discussion around the motion gave
as the reason that other agencies and offices in the City
perform that work.
I am wr~ting you this memorandum in regard to the City Councl1
actlon so that the f~nal budget document, when printed, wl11
not lnclude ObJective 3, Item C which the Council has deleted
by formal motlon at that meeting.
In the normal course of events, I will be notlfying the
Fa~r Electlon Practices Cornmiss~on of the Councll's act~on
as I always do in matters of thlS regard.

Dear Councllmembers,
At your August 9, 1983 meetIng you requested that the FEPC conSI-
der recommendIng changes In the CIty ElectIon Code, ArtIcle 11 of
the Santa MonIca ~unlClpal code, as we deemed necessary. ~ne
CIty Clerk IS submIttIng to you along WIth thIS letter a copy of
the electIon code contaIning our recomme~ded changes and
deletIons.
Tne most ObVIOUS change concern3 the CommISSIons enforcement
powers. We belIeve that the commlSlon serves a purpose as a
disclosure body WhiCh can brIng electIon problems and fIlIng
dIscrepanCIes to the publICS attentIon In a tImely manner, but
that reallstlcly It can do lIttle to enforce regulatIons beyond
referIng Items to the DIstrIct Attorneys offIce or recommending
that agrIeved partIes turn to the courts. TnlS p~llosophy IS
reflected in deletIons made In section 11201, and ~n our decision
to totally rewrite section 11204.
In all cases In WhICh the code referes to the Santa Honlca
Unified Scnool DIscrict Board of Educat~on "or" the Santa Mon1ca
Community College Board we recommend changing the "or" to "and"

also recommend adding the Rent Board 1n all appropriate sectlons
as It should both be covered eXpliCitly by the orulnance and
allowed to partiCIpate In the selectIon of FEPC commlSS10ners In
the same manner as the Council and the School Boards.
We recommend ammendlng section 11208A to ma~e the assesment of
late fees an automatic process WhICh can be handled by the C1ty
Clerks Offlce. We felt that these fees should be gett1ng asses-
sed, which ~as not Deen happening, but that they should oe auto-
matlc rather than at the dlscretion of the FEPC.
SectIon 11211 was ellm~nated altogether because It IS already
covered more speclficly by state law. The flrst sentence of
Section 11000 regarding the fIling of papers should alSO be
ammended to refer to state law so that the problems that
developed during the 1983 electIon Will not happen ag~in.
We are suggestIng ammendIng Section 11210 in order to make It
eaSier for campaIgns to hold small scale but large volume events
such as bake sales or rummage sales In WhIch It is dIffIcult to
o~taln the names of all the people who e1ther contribute goods or
purchase goods.
Althoug~ the FEPC oversees Malibu elections le: the school and
College 8oards, no Mallbu reSIdent IS allowed to serve on the
commIssion because the Santa Monlca City Cnarter restricts partl-
cipatIon on commISSIons to reSidents of Santa MonIca. To correct
thIS we recommend that the Counc11 put a charter ammendment on
the next ballot whlCh would allow electors from Aallbu to be
nOffi1nated to serve on thlS particular commISSIon.
It 1S hoped that these changes Will be of utmost benefit to the
--
community. It should be mentioned that a great deal of thought
was gIven to these changes by members of the CommIsSIon.
The FEPC wl.ll be meeting agaIn on October 27, 1983 to dISCUSS
several electIon process questIons about WhICh members have
raIsed concerns. We would be happy to answer any questIons or
conSIder any addItional concerns that the CounCIL may have at
tha t tIme.
