between Colorado Avenue and Broadway, and 9th Court

Boulevard
Introductlon
Th~s report recommends that the Clty Council hold a publlC hearing
to conflrm the assessment costs for alley improvements made to 4th
Court between Colorado Avenue and Broadway, and to 9th Court
between Olymplc Boulevard and 476' North of OlymplC Boulevard.
These improvements lncluded replacement of asphalt pavement with
concrete pavement and the appurtenant work. The work was performed
ln conjunctlon with the annual Street Resurfaclng Program.
Backqround
The eXlstlng asphalt pavement on 4th and 9th Courts had
deteriorated signlficantly in numerous areas resulting lTI open
cracks, extensive potholes, and runoff water dralnage problems.
On April 27, 1993, Clty Council approved Resolutlon of Intentlon
8577(CCS}. On May 27, 1993, notlces of the Clty'S intent to form
an assessment dlstrict and hold a publlC hearlng were posted and

mailed ln accordance with State law to all affected property
owners. The public hearing was held on August 3, 1993, and after
closlng the public hearlng, the Clty Counell ordered the work to
commence Similar alley assessment proj eets were completed in
1992, on 2nd and 3rd Courts between Broadway and Wllshire
Boulevard, and ln 1993, on Lincoln Court between Olympic Boulevard
and Mlchlgan Avenue
PrlO::::- to thlS reconstructlon, portlons of 4th Court had been
repaved with concrete and are still ln good condition. Due to the
extent of the damage on the remalnlng portlons, patchlng with
asphalt was not an econOIDlcal alternatlve. The reconstructlon of
4th Court consisted of replaclng the existlng deteriorated asphalt
pavlng wlth new concrete paving.
The work at 9th Court was precipitated by excessive flooding due to
poor dralnage The reconstructlon of 9th Court consisted of the
replacement of the deteriorated asphalt pavlng with new concrete
pavlng for the entlre length of the alley, removal of a drywell due
to stagnant water problems, regrading the alley to lmprove dralnage
flow, and construction of a curb wall In order to allow continued
use of the alley during business hours, work was performed nights
and on weekends Thus, 9th Court has a higher unit cost than 4th
Court.

The installation of these new concrete alleys will result in
reduced malntenance costs, ellmination of flooding of adj acent
propertles, elimlnation of drywell water lnfiltration into an
eXlsting sanltary sewer line on 9th Court, better ride quality, and
reliable stormwater drainage. The useful life of these new
concrete alleys is estimated to be ln excess of 50 years.
The two alley reconstructlon projects are complete and property
owners' assessments are now due. On October la, 1995, the City
Councll set a publlC hearing for 6:30 p.m. on December 12, 1995.
All affected property owners were notlfied on October 18, 1995 of
the publlc hearing date and the assessment amount. The assessment
map, a list of property owners and assessment amounts will be
available to the City Council at the time of the public hearing.
Payment Ootlons
Property owners have two options for paYlng these assessment costs.
The flrst optlon is to pay in cash (cash payments would be excluded
from bond issuance). The second optlon is to make installment
payments plus lnterest (at a rate of 9% per annum) over 10 years as
a part of bond financlng for these improvements at which point
liens will be placed on these propertles. The notice was mailed to
property owners ln 1993 discussing both of these optlons. These
payment optlons are slmllar to those offered to participants of
streetlightlng assessments.

The assessment d1strict will be adm1n1stered in accordance with the
procedures set forth in the Improvement Act of 1911 of the
Callfornla Streets and H1ghways Code and the Government Code.
Budqet/Financial Impact
The cost to property owners for the improvements on 4th Court is
$72 per llneal foot on each side of the alley. There are nine
parcels on 4th Court. The assessment for a 50-foot lot is $3,600.
The cost to property owners for the improvements on 9th Court is
581 per 11neal foot on each side of the alley. There are 12
parcels on 9th Court. The assessment for a 50-foot lot 1S $4,050
The Ull1t costs include all inc1dental costs associated w1th staff
t1me 1n conducting eng1neering surveys, posting and mailing of
not1ces, advertisement, construction management, inspections,
recordat1on, construct1on costs, and lnvoicing for up to ten (10)
years of property owners who choose to pay thelr assessment in the
1nstallment plan. All assessments relate to commercial/industrial
properties. There are no resldential properties affected wlthin
the boundar1es of this assessment district.
The total proJect cost includlng incidental costs 1S $127,297.35.
The cost for 4th Court 1S $50,400 and for 9th Court 1S $76,897.35.
The total inCldental cost for thlS project lS $7,880.35. Revenues
wlll be deposlted into Revenue Account No. 01-130-224-00000-0417-
10000.

Bonds are issued for any unpald assessments.
Bond proceeds are
pald to the Contractor or asslgnee, and the property owner(s) then
payoff the bond holder over time.
Recommendatlon
It is recommended that the City Councll:
1) Open the public hearing;
2) Close the public hearlng; and
3) Acknowledge any protest and adopt the attached Resolution
conflrmlng the assessment costs.

WHEREAS, the Clty of Santa Monlca, pursuant to Sectlon 5100 et
seq. of the Streets and Hlghways Code, commenced proceedlngs to
reconstruct alleys and appurtenant work on:
4th Court - between Colorado Avenue and Broadway, and
9~~ Court - between Olympic Boulevard and 476' North of

all withln the City of Santa Monicaj and
WHEREAS, the proceeding is more fully described ln the
Resolutlon of Intentlon adopted by the Clty Council on April 27,
1993 Delng Resolutlon Number 8577(CCS)j and
WHEREAS, the contract for the above descrlbed work has been
fulf~lled to the satisfaction of the Superlntendent of Streets; and
WHEREAS, the Superlntendent of Streets has made an assessment
to cover the su~ due for the work performed and specified in the
contracti and
WHEREAS, the assessment has been flIed with the City Clerki
and
WHEREAS, the City Clerk gave the notlce required by Sections
5362 and 5363 of the Streets and Highways Code; and
WHEREAS, upon the day and hour fixed for hearing by the Clty
Clerk, the City Council of the City of Santa Monlca to hear and
pass upon any and all Ob]ectlons, appeals, and protests,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS
SECTION l. That all ob] ectlons, appeals, and protests of
every klnQ and nature be the same are hereby overruled and denied.
SECTION 2. That the map of property affected and beneflted by
the reconstruction of alleys and appurtenant work on:
4th Court - between Colorado Avenue and Broadway, and
9th Court - between OlymplC Boulevard and 476' North of
OlymplC Boulevard,
all ln the Clty of Santa Monical
Resolution Number 8577(CCS), and
as more fully descrlbed ln
therein declared to be the
property to be assessed to pay the expense of the improvements, 1S
approved and the C1ty Clerk is d1rected to execute the certificate
on the map to the Super1ntendent of Streets.
SECTION 3.
That the assessment of the reconstruction of

assessment distr1ct in the Office of the County Recorder I and
thereaf~er shall record in sald Office of the County Recorder, a
Notlce of Assessment, all ln the manner and form as prescribed by
SeetloD 3114 of the Streets and H1ghways Code of the State of
Cailfo~nla.
SECTION 6. The City Clerk shall certlfy to the adoption of
th1S Resolut1on, and thenceforth the same shall be 1n full force
and effect.

Callfornla, the following work was caused to be done by the Street
Superintendent as part of the FY 94-95 Street Resurfaclng Program:

The Santa MonIca City Council created the Commission on the Status of Women In
August 1981 after It determined that because of a tradition of preJudice, political,
economic and educatIonal restrictions, women had been demed, by virtue of their
status as women, baSIC human rrghts. These tradItions resulted In Inequalrtles In
economiC, political, legal and social status, and In restricted access to services related
to their physical and mental well-being. Although, the national conscIousness has
been raised dUring the past 15 years, the gains have been sporadic and uneven The
purpose of the SMCOSW IS to "work for the elimination of inequality between the
sexes In all areas of life, including but not limited to employment, health, education,
politIcal lIfe and law enforcement n

BACKGROUND INFORMATION
Although the status of women continues to Improve, there IS stili much more to be
done to achieve and protect equality for women Women's Issues continue to emerge
In the political agenda as we search for answers to the problems of affIrmatIve action,
child care, domestic violence, health care, sexual harassment, and teenage pregnancy

The political climate that eXists today has facIlitated a VICIOUS attack on affirmative
action The CommissIOn IS determined to advocate for the continuation of affIrmative
action programs m the CIty and across the nation.
The tragic murders of Nicole Brown Simpson and Ronald Goldman last year,
unfortunate as they were, shed light on the serious problem of domestic violence and
Its effect on women and children On the state level, there IS pending legislation
aimed at changmg the way domestic violence offenders are rehabilitated and/or
pUnished In the past year, the City of Santa MOnica has realized the continuation
of the Domestic Violence Program administered by the Legal Aid Foundation of Los
Angeles whIch, among other serVices, assists VIctims wIth obtaining temporary
restraining orders, and provides tramlng for legal and mental health professIonals
The work to provide quality, affordable child care continues on the legislative front
and m the social service arena. Teenage pregnancy is a huge problem as young
mothers are usually unable to complete their education and become self-sufficient
On the local level, the SAPID programs, at Santa Monica High School, IS making a big
difference In Improving the quality of life and opportunities for teenage mothers
The Commission IS committed to work on all these Issues with the goal of Improving
the status of women
REVIEW OF 1994-1995 ACTIVITIES
In the past year, the SMCOSW worked on several well-defined programs, proJects,
and activIties which benefit the women of Santa MOnica.
1 Participated In and sponsored several events mcludlng the Latina Youth
Conference, the Westslde CoalitIon's Martin Luther King, Jr. Celebration,
World AIDS Day, and Stop the Violence March
2. Advocated for and supported Important programs and proJects, such
as child care, domestic violence resources and programs, Partners m
Learning (tutoring program for teenage mothers), and SAPID (support
program for teenage mothers)
3 Celebrated Women's History Month In honor of women employed by the
City In nontraditIOnal Jobs. Reception Included entertamment,
refreshments, awards program, prrzes donated by women-owned
busmesses, and a photo exhIbit of honorees.

4 Coordinated "Take Our Daughters to Work Day" which Involved the
placement of over ninety ninth grade Santa MOnica High School students
with professIonals from the City and the local business communrty
Students were exposed to a vanety of occupations and were able to
witness the realities of the work world as they rode In Harbor Patrol
boats, surveyed construction sites, helped at a shelter for mentallY-III
women, and went to work with a variety of other professionals.
5. Networked with women's organizations and attended the annual
conference of the National ASSOCiatIons of Commissions on Women In
Topeka, Kansas Attended two networkmg and lobbYing days In
Sacramento: Women In Action Lobby Day and Latina Action Day
Attended the annual Los Angeles City and County COSW awards
programs hononng women as well as the Governor's Conference for
Women In Long Beach
6 Analyzed proposed legislation and made recommendations to legislators
at the local, state and national level on affirmative actIon, reproductive
nghts, domestic violence, child custody, economic equity, violence
against women and children, and other Issues
7 Heard the follOWing presentations at regular COSW meetings'
Barbara Greenstein, Director, Westslde Legal Services, on the clOSing
of the agency and the search for a new legal service to oversee
the Domestic Violence Program In Santa MOnica;
Mike DenniS, Director, and Pam Wortham, Purchasing Agent, Santa
MOnica Finance Department, on the Women and MinOrity
BUSiness Enterprrse Program;
Anne Dunn, ASSistant Executive Director, L.A City COSW, and
JuanIta Holcomb, Chair, Frrends of the L.A. City COSW, on the
structure and support of the Friends organization;
VIVIan RothsteJn, Director, Ocean Park Community Center, on services
to homeless women In Santa MOnica,
SylVia Gentile and SIdney Ann Ross-Risden, members, L.A. Wages for
Housework Committee, on the UN Fourth World Conference on
Women In BeiJing,
Richard Bridges, Santa Monica Fire ChIef, on the Department's
progress In the area of recrultmg, hiring, and promotmg a more
diverse workforce, and
Susan MIllman, Director, Prrvate Attorney Involvement Program, and
Jessica Soske, Attorney, Legal Aid Foundation of L.A , on the
Domestic Violence Program

8. Monitored the City's affirmatIve action plan by meeting regularly with the
Personnel Department, evaluating the diversIty of the City's workforce,
and making recommendatrons accordingly
9 Analyzed the findings of the COSW's "Quallty of Workfrfe Survey TI
Dlstnbuted results to City staff and elected officials
10 Met with Personnel Department on the development of a business/career
expo scheduled for October 1995.
1995-1996 GOALS AND OBJECTIVES
The SMCOSW Will continue to work on ItS mandate to' promote the general welfare
of women In Santa MOnica, educate the public about Issues of concern to women,
and advocate and offer advice on Issues that affect the status of women.
In order to effect thiS mandate, programs and projects Will'
1 Benefit the female reSidents and employees of Santa Monica.
2 BUild upon eXisting resources prOVided by Santa MOnica commISSIOns
and city departments, and other women's commISSIons and
organizations
3 Educate the community on SMCOSW targeted Issues and proJects.

publrc resources
PROPOSED 1995-1996 ACTIVITIES
1 Follow-up on the Needs Assessment Survey of Santa MOnica City
employees with designated training and workshops
2 Through the Economic Resource Commrttee, focus on links between the
corporate and business community and the many women who work to
achieve entrepreneunal Independence by co-sponsonng a
Career/Business Expo wIth the City's Personnel Department.
3 Honor women employed by the City as part of Women's History Month.

because it Ignores the compellmg evidence supplIed by the American Cancer SocIety that says
that there 15 no safe level for second-hand smoke; secondly, the ordmance says that alcohol
lIves are not as unportant as profits, and perhaps campaIgn contributions; and, thirdly, the
maker of the motIon was not clear as to what thIs motion really is and how It wIll really be
carned out in bars and restaurants.
