BACKGROUND Procedure for Residential Streetliqht Installation On December 8, 1992, City Council adopted Resolution of Intention No. 8505 (CCS) setting a public hearing for the purpose of determining whether public convenience and necessity require the construction of streetlighting and declaring its intention to construct streetlighting and appurtenant work on Arizona Avenue, from Franklin street to centinela Avenue. In accordance with City code, whenever the occupants of 60 percent of the residential units in any area petition the City Council to undertake proceedings to provide for residential streetlighting improvement, the City Council shall institute those proceedings 1 /~~A JM~ ~ ") ~ --.i 1991 under the Improvement Act of 1911. Petitions having the minimum required signatures are presented to City Council and a time and date is set for a public hearing. After considering the public testimony, the City council may order the work to begin. Then the project is competitively bid by private contractors, a contract is awarded by City council to the lowest and most responsible bidder and bonds are authorized to be sold. Property owners are assessed for street I ighting based on their property's dimensions. In accordance with city policy, residential property owners are assessed 50% of their front footage or 20% of their side footage costs for construction of the streetlighting system. The City pays the balance. Owners may pay for the improvements in full, or they may pay over ten (10) years to include an interest rate which is currently at 8.8% per annum. Discussion The request for streetlighting along Arizona Avenue has a chronology dating to 1991. In 1991, at the request of some area occupants, a petition was circulated for this area but did not have the required 60% signatures. Thereafter, in early 1992 a new petition was requested by the circulators and returned to the City in May 1992. Circulators thought that there was a concern for safety in the neighborhood. streetlighting is perceived by some area residents to prevent crime in the area. Staff and city Attorney's Office reviewed the new petition for the Arizona Avenue 2 area and determined that it follows city policy and practice, and is a valid petition. Petitions requesting streetlighting along Arizona Avenue as well as several other areas were presented to City council on June 9, 1992. A public hearing was scheduled and held on July 28, 1992 for Arizona Avenue and other areas. At the request of city Staff, the hearing for Arizona Avenue from Franklin street to centinela Avenue was deferred to a later date. City council ordered the work to begin in all areas except Arizona Avenue. The deferral was due to a complaint received from a property owner on Arizona Avenue concerning the validity of the streetlighting petition signed by the occupants of the area. The property owner claimed that only the signatures of occupants of the units with Arizona Avenue addresses should be accepted in the petition, and that corner lots with non-Arizona Avenue addresses should not have the right to sign the petition. The city's past and present policy has been to accept petitions from occupants of all the units in a proposed assessment area including corner lots. Although corner lots may have the address of the adjacent street, they will benefit from the streetlights, and thus occupants of those lots are allowed to sign the petition and will be responsible for their share of the assessment. The city Attorney's Office has reviewed this complaint and still believes the petition is valid. 3 Rent Control Staff verified that 15 out of 25 total occupants of the area signed the petition. It is important to note that although the pastor of the Church of Latter Day saints located at the corner of Arizona and centinela is in favor of the streetlights, the site was not counted towards the 25 total occupants of the area since the church is not considered a residential unit. Even without the Church, this petition meets the 60% requirement and conforms with Rent Control Regulations for pass-through of assessments. In most instances, pass-through charges will be less than $2.00 per month per apartment unit. On December 23, 1992, more than 15 days prior to the public hearing, notices describing the hearing were officially posted and occupants and property owners were notified by mail of the time and date of the public hearing. A notice was advertised in The Outlook in the manner prescribed by state Law. Copies of the signed petition, a map of the proposed assessment district and a list of property owners and occupants will be available for review in the Council Chambers at the time of the public hearing. 4 BUDGET/FINANCIAL IMPACT The 25 residents of this area reside at five residential properties. In addition there is one church in the area and since the church is not considered a residential unit, it will be assessed the commercial rate. The church is on a corner lot and will be assessed $10.70 per side footage. The estimated share of the assessment for residential property owners is $13.40 per front footage and $5.40 per side footage for corner lots. out of the six properties to be assessed four are corner lots, therefore, the City's share of the assessment is higher than 50%. The estimated typical property's share of the assessment costs on Arizona Avenue ranges from $300 - $1,900 depending on lot size. The total estimated construction cost is $21,000. The total estimated property owners share of assessments for this area is $5,200. A grant program will be available for low to moderate income households. Appropriation authority for the City'S contribution is available in CIP Account No. 01-770-453-25491-8917-99155, "New Streetlight Systems", in the amount of $15,800.00. The remaining costs for the project will be paid through property owner assessments. Assessments will be paid upon completion of the work and cash payments will be held in trust account #80-000-000-00000-9750-04289 for payment to the contractor who installs the streetlights. If payments are not made on time, bonds are then issued for unpaid assessments. Bond proceeds are paid to the Contractor when the 5 property owner(s) pay the bond holder(s) overtime. RECOMMENDATION It is recommended that city Council: 1. Open the public hearing and accept public testimony regarding on the convenience and necessity of the proposed streetlighting district, as described in the Resolution of Intention No. 8505 (CCS); 2. Close the pUblic hearing; and 3 . Acknowledge any protests and adopt the attached resolution finding that the public convenience and necessity requires the construction and order the work to begin. The Act provides that the costs of the improvements such as surveY1ng, prepar1ng plans, construction costs, preparing Council resolutions, advertising, inspection, and preparing the assessment and bonds may be assessed to the property owner. The City Counc1l/s past policy was to initiate a streetlighting distr1ct if 60% of the property owners petitioned for streetlights. Under new procedures adopted by the City Council and the Rent Control Board, occupants also may petition for streetlights. In this instance, the petition must be signed by 60% of the occupants in a streetlighting district. The City Council presently assesses residential owners one-hal f the cost of 1nstall ing standard streetl ighting, approximately $690 per 50 foot frontage. The City pays the rema1nder of the cost or approx1mately $690 per 50 foot frontage. Commerc1al property owners will be assessed 100% of the cost per frontage. In addition, the City presently pays all ma1ntenance costs and the cost of the energy to light the streetlights. By action of the City Council and Rent Control Board, when occupants ci rculate the petiti on, the property owner may pass-through the cost to the tenants over a la-year period with each unit on a property paying the same cost. In most instances, monthly charges will be less than $2.00 per apartment unit. THERE IS NO CHARGE TO EITHER PROPERTY OWNERS OR TENANTS UNTIL THE STREETLIGHTS ARE INSTALLED AND WORKING. The Improvement Act provides that the property owner may pay the assessment: 1. By Cash. Cash payments may be made wi thin 30 days after the assessment is confirmed. Invoices will be mailed to all property owners and payment is due 1n 30 days. After that, cash payments may st ill be made but interest must be charged at a rate of 8.~ per annum. OR 2. By Installment Pa)'llents. Payments may be made in 10 annual installments plus interest which is billed semi-annually. The unpaid balance may be paid at any time an interest payment is due. A lien will be placed on the property which can be removed only after full payment has been made. Financial aid for low-to-moderate income property owners is avai 1 able. The publ ic interest and convenience requires, and the city Council of the city of Santa Monica hereby orders, the work described in Resolution No. 8505 (CCS) to be done on ARIZONA AVENUE BETWEEN FRANKLIN STREET AND CENTINELA AVENUE, within the City of Santa Monica. Any and all of said protests and objections of every kind and nature to the proposed work or to the extent of the district to be assessed be, and the same are hereby, overruled and denied. SECTION 2. The City Council hereby finds and determines further that the "Special Assessment Investigation, Limitation, and Majority Protest Act of 19311' shall not apply to the making of said improvement. SECTION 3. Improvements shall be conducted under the Improvement Act of 1911, which is Division 7 of the streets and Highways Code of the state of California, and the Street Superintendent and the city Attorney presented to the said city Council the Resolution of Intention required by said Improvement Act to initiate the proceedings for said improvements. SECTION 4. After the bid package has been prepared, the 8 City Clerk hereby is directed to post a notice for five days on or near the door of the city council Chambers of the City Hall inviting sealed proposals or bids for doing the work ordered and referring to the specifications on file and to publish a notice inviting such proposals for two days in The Outlook, a newspaper published and circulated in said City. SECTION 5. Reference hereby is made to Resolution No. 8505 (CCS) for a description of the work, the assessment district, the bonds to be issued, and for further particulars. SECTION 6. The city Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
