The Rules and Regulatlons were drafted by the Clty Attorney's offlce and Dr. Karl Kryter, the Clty'S nOlse consultant. If approved by Clty Council, the Rules and Regulatlons wlll be adopted by the Alrport Dlrector. BACKGROUND Ordlnance No. 1137, adopted October 10, 1979, provldes for a Slngle Event NOlse Exposure Level (SENEL) Ilmlt of 85, and for the excluslon of types of alrcraft estlmated to be unable to meet an 85 SENEL at the Santa Monlca Alrport nOlse Qeters. The ordlnance dlrects the Alrport Dlrector to complle a IlSt of alr- craft types that wlll be excluded, based upon nOlse emlSSlon estlmates. After wr~tten comment was recelved from an alrport neighbor and from aVlatlon lnterests, the Alrport Cornrolsslon held a publlC hearlng on the orlglnally proposed verSlon of these Rules and Regulatlons. The CommlSSlon wlthheld approval pendlng reV1Slon and a further COffiffilSSlon study seSSlon. The Rules and Regulatlons were revlsed; the CommlSSlon approved them and recornaended that the Counell approve them too. A baslc summary of the Rules and Regulatlons lS eontalned ln a sectlon preeedlng thelr Text (Regs. pp. 1-3). Because the ordlnance has been prell~lnarlly en]olned pendlng trlal of NBAA v. Clty of Santa MO~lca, the Rules and Regulatlons would not be effeetlve lmmedlately, even lf approved and adopted (see Regs. p. 3). ALTERNATIVES The COUDCll may dlrect further reV1Slon or modlflcatlon of the Rules and Regulatlons, may requlre further publlC hearlng, or may authorlze the Alrport D~rector to adopt them as wrltten. RECOMMENDATION It lS respectfully recommended that Clty Counell approve the Rules and Regulatlons as wrltten.
