SUBJECT Recommendation to Accept the Certified Results of the Street Resurfacing
Assessment Election and Approve the Formation of the Assessment Dlstnct
In Conformance with the Right to Vote on Taxes Act (Prop 218)
Introduction
ThIs report recommends that the City CouncIl accept the certified results of the street
resurfacing assessment election as tabulated by the City Clerk and approve the formation
of an assessment district for repalnng concrete curbs, dnveways, and sidewalks, for
resurfacing streets, for restonng parkways, for constructing concrete gutters, for
reconstructing alleys, and for completing the appurtenant work These Improvements are
to be performed In fulfillment of the FY 1996-97 Annual Street Resurfacing Program at
vanous commercial, Industnal, and residential locations The report also recommends that
the City Council adopt the attached Resolution of Intention to assess property owners for
construction costs In conformance with the Right to Vote on Taxes Act (Proposition 218)
and order the work to begin
Background
The FY 1996-97 Annual Street Resurfacing Program Includes gutter construction, street
resurfacing, alley Improvements, slurry sealing, parkway pavement removal, curb ramp

construction, curb and gutter repairs, bus pad construction, and sidewalk and dnveway
repair and construction at various locations In the City The crltena used to determine the
streets and alleys Included In this year's program and the method of repair Include age,
drainage problems, surface and subsurface conditions, complaints received, type of use
(I e , commercial or residential), current traffic volume, and projected change of use or
traffic volume
Bids for the construction of thiS project were received on January 21, 1997 Damon
Construction Company was awarded thiS project by City Council on February 25, 1997
The contractor was authorized to proceed with the non-assessment portion of the project
until the new Right to Vote on Taxes Act (Proposition 218) assessment dlstnct process was
resolved The non-assessment related portion of the work IS complete and the contractor
IS currently awaiting authonzatlon to proceed with the remaining work
In accordance Proposition 218, an Engineer's Report was prepared which determined the
general and speCial benefits of each specific proposed Improvement General benefits
enhance the public as a whole, while speCial benefits enhance a particular parcel A copy
of thiS report IS available In the office of the City Engineer According to Proposition 218,
parcels may only be assessed for speCial benefits
ThiS report recommends that parcels be assessed for only 50% of the speCial benefit cost
of the proposed Improvements determined by the Engineer's Report The recommended

reduction In assessment charges IS In consideration of the burdens on properties caused
by the Northndge earthquake and the high policy pnonty which has been assigned to
Infrastructure repair and maintenance by the City Council as a significant community
benefit It IS recommended that street resurfacing and alley reconstruction assessments
for reSidential properties be waived to be consistent with long-standing City policy
Consistent with recent City policy, assessments will also be waived for non-profit
organizations which can provide eVidence of receiving a welfare exemplion from the Los
Angeles County Tax Assessor
Proposition 218 DIscussion
Ballots and notices of the City's Intent to form an assessment dlstnct and hold a public
heanng In conformance with Prop 218 were mailed to affected property owners at least
forty five (45) days In advance of the time and place of the public heanng In accordance
with State law Ballots were tallied proportional to the financial obligation of the affected
property For example. If one property has work totaling $300 that property has 300 votes
as compared to a property that may have $5,000 worth of work receiving 5,000 votes The
City Clerk received all ballots and kept them secured until the voting was closed on
November 11, 1997 There was a total of 472 ballots mailed to affected property owners
with 212 completed ballots returned There were 124 ballots In favor and 88 ballots
opposed The final vote count was 76,426 votes In the affirmative and 65,976 votes In
the negative The results of the ballot tally resulted In a maJonty of property owners-

proportional to their financial obligatlon- voting In the affirmative to form the assessment
district
Payment Options
Property owners paYing for street resurfacing, alley reconstruction, gutter, curb, parkway
and sidewalk reconstruction will have the option of making a cash payment within 30 days
or Installment payments plus Interest The terms of the Installment payment plan will be
determined at the time staff returns to council to confirm costs

The Unit costs are set by the Supenntendent of Streets, and are penodlcally updated to
reflect actual costs They Include staff time In conducting englneenng surveys, posting and
mailing of notices, construction management, inspection and construction The street
resurfacing assessment IS calculated so that non-residential property owners pay the same
respective unit cost regardless of the width of the street affecting their property
Corner lots are assessed either 50% or 100% of the proposed assessment share
depending on legal address Owners of corner lots where the legal address IS the street
being repaired pay 100% of applicable repair work If the legal address IS the adjacent
street, the property owner pays 50% Corner lots have the potential of being assessed for
both sides of their lot If both streets are Improved ThiS policy eases the Impact on corner
lots by assessing 100% on one street and 50% on the cross street
The assessment amounts were spread to all properties In the dlstnct based upon the
proportion of the special benefit realized Any amount waived will be financed through City
funds not the remaining properties In the assessment dlstnct City funding for thiS project
totals $2,570.731 23 and the assessments total $329,11977

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA FINDING THAT THE PUBLIC CONVENIENCE AND NECESSITY
REQUIRE THE CONSTRUCTION OF CONCRETE GUTTERS, ALLEY
IMPROVEMENTS, STREET RESURFACING, SIDEWALKS AND
DRIVEWAYS, CURB REPAIRS, RESTORATION OF PARKWAYS, AND
APPURTENANT WORK, IN CONJUNCTION WITH THE FY 1996-97
STREET RESURFACING PROGRAM
WHEREAS, the City Council of the City of Santa MOnica on September 9,1997,
passed and adopted Resolution of Intention Number 9196 (CCS) declaring Its intention to
order work described therein to be done, and
WHEREAS, Resolution of Intention Number 9196 (CCS) was duly and legally
published as required by law, notice was given In a manner required by law and all written
objections and protests to the proposed work or the extent of the district were heard and
considered by the City CouncIl. and
WHEREAS, public hearings have been held pursuant to Resolution of Intention
Number 9196 (CCS) and the laws and ConStitution of the State of California on the
proposed construction of concrete gutters and alley Improvements, street resurfacing,
repair of damaged sidewalks and driveways and curbs, restoration of parkways, and

Intention required by the Improvement Act to Initiate the proceedings for the Improvements
