SUBJECT: Ordinance Creating Commission on the
Status of Women
At its meeting on July 28, 1981, the City Council
introduced for fLrst read1ng an ordinance creating a Comm~s-
sion on the Status of Women. Because of amendments, the
ordinance was once against introduced for first read~ng at
the meeting of the C~ty Counc~1 on August 11, 1981. The
ordlnance lS now presented to the City Council for adopt10n.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordLnance be adopted.

AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA CREATING A
COMMISSION ON THE STATUS OF WOMEN
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
ORDAIN AS FOLLOWS:
SECTION 1. Chapter 10 is hereby added to Article II of
the Santa Mon1ca Mun1c1pal Code to read as follows:
Chapter lO--Commission on the status
of Women
Section 2910. Findin~s and
Purp~se. The City Council finds and
declares:
(a) Because of tradlt10n and
prejudlce and because of social,
political, economlC and educational
restrictions on women through the
years, women have been denled by

v~rtue of the~r status as women basic
human rights, result1ng in inequities
in economic, pollt~cal, legal and
soc~al status and in access to ser-
vices related to their physical and
mental well-being.
(b) Discrimination against
women is ln~mical to the public
welfare.
(c) It lS the policy of the
City to give every Lnhabitant of the
City equal economic, political,
social and educational opportun1ties
and to provide equal services and
protection by public agencies.
(d) It is the policy of the
City to keep the public lnformed on
developments in the legal and social
status of women; to develop and
distribute pert1nent information
and recommendat~ons to City agencies
and to the general public; to
provlde expert advice and assistance
to the offices, agencies, boards,
departments, and employees of

the City in undertaking efforts
to assure equalLty Ln the treatment
of the sexes; and to officlally
encourage private persons and groups
to take steps to remove the barriers
in the struggle of both women and men
for equal opportunlties result1ng
from tradition, preJudice and
the educational, economic, political,
legal and social restrictlons of the
past.
Section 2911. Creation of
Comm~SSlon on the status of Women.
Pursuant to section 1000 of the City
Charter, a Comm2ssion on the Status
of Women is hereby created. The
Commission shall consist of nine
members, all of whom shall be resi-
dents of the City of Santa MonLca and
all of whom shall be women, and shall
be appoLnted by the City Council.
The CommLssion and Commlssioners
shall be subject to all the terms of
Article X of the C~ty Charter setting
forth procedures for apPo1ntment of
Commissioners, terms and meetings.

Sect10n 2912. Coord1nator. A
Coordinator for the Commission shall
be appointed by the City Manager
subJect to the approval or
disapproval of the Commiss1on. All
staff personnel of the Commission
shall be under the immediate
direct10n and supervision of the
Coordinator.
Section 2913. Bud~et. The
City Council shall approprlate funds
to re1mburse the members of the Com-
mission for the1r dlrect expenses
involved in attending meetlngs out-
side the City and to pay for person-
nel, services and facil1t1es as may
be reasonably necessary to enable the
Commission to exerClse its powers and
perform its duties. Each Commis-
sioner shall rece1ve compensation as
determ1ned by resolut1on of the City
Counc1l.

Section 2914. Powers and
Dutles. The Commission shall have
the power and the duty to:
(a) Prepare and disseminate
educatlonal and lnformational mater-
ial relative to the role that tradi-
tion, pre]UdlCe and the depriva-
tion of equal opportunlties and
access 1n areas such as educatlon,
employment, and health care have
played 1n keep1ng women of all races,
creeds, ages, and marital status from
developing thelr full 1ndividua1
potentials and from contributing
fully to the cultural and economic
life of the community.
(b) Hold public hear1ngs on
matters relevant to the general scope
of the Commission.
(c) ReVlew national, state and
local legislatlon which may have an
impact on the status of women and
recommend to the City Council posi-
tlons on slgnlf1cant legislation
affect1ng the status of women.
<d) Develop and maintain a
Talent Bank of Women Wh1Ch can be

used in a variety of ways, including
but not lim~ted to assisting the
Personnel Department in recruit~ng
qualified women candidates for
employment opportunit~es and nomlnat-
ing quallfied women for appointment
by the C~ty Councll to vacanCles on
boards and commiss~ons of the City.
(e) Cooperate with and make
recommendatlons to the Personnel
Department and the Personnel Board in
the development and implementation of
programs and pract~ces which have the
purpose of furthering the obJectives
of this Chapter, includ~ng but not
l~mited to recommendations regarding
terminology used in job announcements,
recruitment technlques, job qualifica-
tions, salary schedules, training and
promot~onal practlces.
<f) Study job categor~es which
tradit10nally are filled pr1marl1y by
women or primarily by men to determ~ne
whether the rate of compensation in
the trad2tionally female Jobs compares
reasonably and favorably w1th the rate

of compensation in the trad~t~onally
male jobs, taking lnto consideratLon
the training, experience, mental and
physical effort and responsib1lity
required and the working conditions
involved, and make recommendations con-
cerning necessary steps to implement
equ1table rates of compensation.
(g) Study and make recommenda-
tions regarding the special employment
problems of women stemmlng from the
assignment to them of traditional
roles such as responsibility for ch11d
rearing, including but not limited to
the need for child care centers,
on-the-Job training and retraining for
those who have been out of the employ-
ment market for extended periods and
part-tlme employment opportunities.
(h) Cooperate with and make
recommendat~ons to law enforcement
agencies and officials concerning the
enforcement of laws which have a par-
ticular impact on women.
(i) Cooperate with and make
recommendat~ons to the Board of

Educatlon of the Santa Monlca-Mallbu
Unified school District on the
development and lmplementatlon of
programs and practices WhlCh have the
purpose of furthering the obJectives
of this Chapter, including but not
limited to recommendatlons concerning
in-service tralnlng and sex-role
models for female students who may be
interested in employment not tradi-
tionally fLlled by women.
(J) Provide Lnformation, guid-
ance and technlcal assistance to other
public agencies and private persons,
organizations and institutions engaged
in actlvlties and programs intended to
eliminate prejudice and dlscrirnination
against women because of their status
as women.
(k) Cooperate with and make
written recommendatlons to the City
agencies, boards and commlssions and
City officials regarding the
development and implementation of
programs and practices for the purpose
of furthering the objectives of this
Chapter.

(1) Investigate and mediate, at
the request of a party and wlthln the
lim1tat1ons of staff time and re-
sources, all incidents of dlscrimina-
tion against women because of their
status as women which are not within
the exclusive Jurisdiction of some
federal, state or clty agency, and
make specific recommendat10ns to the
involved parties as to the methods for
eliminating discrimination against
women.
(m) Prepare, encourage and co-
ordinate programs of voluntary action
to reduce or eliminate existing
inequalities and disadvantages in both
the public and private sector result-
ing from prejudice, tradition and past
discrimination.
Section 2915. Cooperatlon with
Other Groups and I~di~idu~ls. The
Comm1ss10n shall consult and maintain
contact wlth groups and indivlduals

who are concerned with the status of
women or who are primarily responsible
for assurlng equal opportunlties for
women.
Section 2916. Re~orts. The
Commlss1on shall render written
reports of Its actlvities to the City
Council not less than once every three
months.
SECTION 2. Any provislon of the Santa Monica Munlcipal
Code or appendices thereto inconsistent with the provislons
of this ordinance, to the extent of such inconsistencies and
no further, is hereby repealed or modifled to that extent
necessary to affect the provisions of this ordinance.
SECTION 3. If any sectlon, subsection, sentence,
clause, or phrase of this ordinance is for any reason held to
be invalid or unconstltutlonal by a decislon of any court of
competent jurlsdiction, such decislon shall not affect the
validity of the remalning portions of the ordinance. The
City Council hereby declares that lt would have passed this
ordinance and each and every sectlon, subsection, sentence,
clause, or phrase not declared invalid or unconstltutlona1
without regard to whether any portlon of the ordinance would
be subsequently declared lnvalid or unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk
shall attest to the passage of this ordinance. The City

Clerk shall cause the same to be published once in the
offic1a1 newspaper wlthin 15 days after its adoption. The
ordinance shall become effect1ve 30 days from its adoption.
