Myers, City Attorney ~-c JAN 1 2 19~~ ~ e e CA:RMM:LN:r C~ty Council Meet1ng 1-12-82 Santa Monica, Californ1a ORDINANCE NO. 1241 (City Council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CREATING A SOCIAL SERVICES COMMISSION THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION l. Chapter 11 is hereby added to Article II of the Santa Monica Municipal Code to read as follows: Chapter ll--Social Services Commission Section 2920. Find1ngs and Purpose. The City Council finds and declares: (a) The City annually expends funds on the provision of social ser- v1ces to residents of the City. <b) The need for social ser- vices increases at the same time that federal and state funds for social services decrease. ~ e e (c) Each year the C~ty is requested to provide funds to agencies and programs in excess of the funds available for social ser- vices. <d) It is the policy of the City that funds for social services be dlstributed in a manner that will maxim1ze the direct benefits to resi- dents in need of such serV1ces. (e) It is the policy of the City that distribution of funds for social services be based on a planned system in order to maximize efficient use of resources and minimize dupli- cation of services. (f) There is a need for the regular and ongoing assessment of social service needs and of those programs delivered in the City by service providers includ1ng the City, County of Los Angeles and private organizations. (g) There is a need for citizen participation in the process -2- e e of evaluating and funding social ser- vice programs. Sect~on 2921. Creation of Soc~al Services Comm~ssion. Pursuant to Section 1000 of the City Charter, a Soc~al Serv~ces Commission is here- by created. The Commission shall consist of seven members and shall be appolnted by the City Council. The Commission and CommlSSloners shall be subject to all the terms of Article X of the City Charter settlng forth pro- cedures for appointment of Commis- sioners, terms and meetlngs. Section 2922. Powers and Dutles. The Commission shall have the power and the duty to: (a) Schedule periodic hearings to determine the unmet social service needs of the residents of the City. (b) Recommend to the City Council policies to guide the provi- Slon of social services to residents of the City and review and comment on procedures developed by the City -3- e e Manager for the development of a comprehensive delivery system to pro- vide social serv~ces. (c) Recommend to the City Council specif~c social service pro- grams necessary to serve the unmet needs of the residents of the City. (d) Rev~ew the City Manager's proposed budget for social services and make its recommendations thereon to the City Council. (e) Prepare an annual assess- ment for the city Counc~l on the extent to which agencies and programs of the City, County of Los Angeles, and other entities are achieving goals and object~ves for social services. Sect~on 2923. Cooperation w~th Other Groups and Individuals. The Commission shall coordinate its activit1es with other Boards and Com- missions and shall consult and maintain contact with groups and indiv1duals who are concerned with the planning and provis~on of social services. -4- - e Section 2924. Reports. The Commission shall render written reports of its activities to the City Council not less than once every three months and at such other times as requested by the City Council. SECTION 2. Any provislon of the Santa Monica Municipal Code or appendices thereto ~nconsistent wlth the provlsions of this ordinance, to the extent of such incons~stencies and no further, is hereby repealed or modified to that extent necessary to affect the provisions of this ordinance. ThlS ordinance does not alter or change the powers and duties of any other Board or Commission of the City. SECTION 3. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a declsion of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the ordinance. The City Council hereby declares that it would have passed this ordinance and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconst1tutional wlthout regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 4. The Mayor shall sign and the Clty Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once ln the ~- .; e e officlal newspaper wlthin lS days after its adoption. The ordinance shall become effective 30 days from its adoption.
