An Ordinance Amending Santa Monica Municipal Code
section 2900 to Eliminate the Category of Non-voting
Members of the Commission on Older Americans
At its meeting on September 13, 1988, the City Council
introduced for first reading an ordinance eliminating the
category of non-voting members of the Commission on Older
Americans. The ordinance is now presented to the City Council
for adoption.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordinance be adopted.

ORDINANCE NUMBER

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING SECTION 2900 OF THE
SANTA MONICA MUNICIPAL CODE TO ELIMINATE THE CATEGORY OF
NONVOTING MEMBERS OF THE COMMISSION ON OLDER AMERICANS
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1. Santa Monica Municipal Code Section 2900 is
amended to read as follows:
SECTION 2900. commission on Older
Americans. Pursuant to the provisions of
Section 1000 of the Santa Monica Municipal
Charter, the City council does hereby
create a Commission on Older Americans.
The membership of said commission shall be
appointed by the city council and shall
consist of nine (9) members to be electors
of the city. None of the voting members
shall hold any paid office or employment
in City Government. At least five of the
Commissioners shall be over 60 years of
age.

All non-voting seats in effect at
the time of passage of this Section shall
terminate as of June 30, 1989, and the
City Council shall not fill any vacancies
of Commission non-voting seats if any such
seat is vacated prior to June 30, 1989.
SECTION 2. Any provision of the Santa Monica Municipal
Code or appendices thereto inconsistent wi th the provisions of
this Ordinance, to the extent of such inconsistencies and no
further, are hereby repealed or modified to that extent necessary
to affect the provisions of this Ordinance.
SECTION J. If any section, subsection, sentence, clause,
or phrase of this Ordinance is for any reason held to be invalid
or unconstitutional by a decision of any court of any competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance. The City Council hereby
declares that it would have passed this Ordinance, and each and
every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether
any portion of the Ordinance would be subsequently declared
invalid or unconstitutional.

SECTION 4. The Mayor shall sign and the City Clerk shall
attest to the passage of this Ordinance. The City Clerk shall
cause the same to be published once in the official newspaper
within 15 days after its adoption. This Ordinance shall become
effective after 30 days from its adoption.
