SUBJECT: Recommendations from the Landmarks Commission for an Alternative
Initiative to Amend the City’s Landmarks Ordinance.
INTRODUCTION
On November 12, 2002, the City Council considered a petition proposing an
amendment to the City’s Landmarks and Historic District Ordinance. Subsequently, the
Landmarks Commission held meetings to provide recommendations to present to City
Council for its consideration in assessing whether to submit a proposition to the voters
amending the Landmarks Ordinance.
SUMMARY
Landmarks Commission Recommendations
The Landmarks Commission held two special meetings, on November 19, 2002, and on
December 2, 2002. At the first meeting, the Commission developed ideas for ordinance
amendments that might clarify the Landmarks process and the Landmarks Commission
jurisdiction, expand property owners’ participation in the designation process and
provide additional incentives to benefit Landmark property owners. The second
meeting focused on refining the ideas into a communication to present to the Council.
The Commission’s recommendations are included as Attachment A.
CEQA Analysis of Landmarks Commission’s Recommendations
During the period between the Commission’s two special meetings, staff reviewed the
Commission’s suggestions to determine the level of environmental review that each
suggestion would require under the California Environmental Quality Act (CEQA). A
City-sponsored initiative would be subject to CEQA and there is insufficient time to
prepare the required negative declaration or EIR. Therefore, a City-sponsored initiative
can only propose changes to the Landmark Ordinance that are exempt from CEQA.
Staff’s preliminary analysis is that some of the suggested ordinance changes could
result in effects on the surrounding area that would require more extensive
environmental review while other proposed ordinance changes could not have any
possible impact and would be exempt from CEQA review.
