~NTRODUCTION
This report recommends that the City Council certify the attached
statement of Official Actian for tha above referenced appeal.
BACKGROUND
After a publ~c hearinq, and careful review af the record and
s~aff recommendation, the City Council upheld an appeal of the
Planning Commission's conditional requirement that imposed a two
to threa atory hefqht limit far devalopment of a project at 800
wilshire Houlevard. The City Council approved a three to four
story building height limit with findinqs contai.ned in the
a~taehed Statement oP Official Action.

DEVEIAPMENT REVIEW FINDING5
1. With the pro~ect modifications and conditions appraved by
the Council, the physica~ location, size, massinq, and
placement of propased structures on the site and the loca-
tion of proposed uses within the project are compatible
with and relata harmoniausly to sur~oundinq sitas and
neiqhborhoods, in that the bufldinq is located on Wilshire
Boulevard, which fs characterized by a ranqe of commercia~
deve~opment, including o~f~ce bu3ldinge with sim~lar
building heights as appraved by the Council; and that the
~opoaed deve~.opment, with its 2.5 FAR and four-stoxy
heiqht alonq Wilshire Boulevard, will step down to a 1.5
FAR and three-story height along LincoJ.n Sou].evard and to
a one story height above the servics station area, wi11

provfda an adequate amount of landscaging and apen space
ad~acent to street Isvel and on the interior of the site,
and provide an appropr~ate txanaition between the commer-
cia~ly~zoned par~~ls alang Wilshire and L~ncoln
Boulevards and the residentially-zoned parcela located to
the east alonq Ninth Streat.
2. The rights-of-way can accommodate autos and pedestrfans,
including parking and access, in that the eite design
will provide adequate drfveway and parkinq fac~~ities and
the site is ad~acent to two improved arterial streets:
Wilshire and Lincoln Boulevard,
3. The health and safety sar~icea {po~~ce, fire, etc.) and
public infrastructure (e.g. utilities} are sufficient to
accommodate tha new devalopment, in that tha praject ~s
praposed to be an in-fill of an already deve~oped area
with all n~ceesary services and infrastructure already in
place.
4. Any on-site provisian of hausir~q or parka and pe~lic open
spacB, which are part af the required project mitiqation
measures required in Subchapter 5G of the City of Santa
Monica Compreh~nsive Land Us~ and Zon~ng Ordinance, satis-
factorily meet the goals cf the mitiqation program, in
that the pr~ject will be raquired to camply with the re-
quirements of this program.
5. The project is generally consistent with the Municipal
Code and General Plan, in that the pro~ect as conditioned
is designed to meet all code and General P~an require-
ments, with the exception of the required parking
variance.
6. Reasonable mitigation measurea have been incluc3ed for aI~
adverae impact~ identified in an Environmental Impact Re-
port, fn ~hat aIl reasan~ble mitigation measures recommen-
ded by the EIR have been included as conditions of approv-
al for tha pro~ect.
VAR~ANCE FINDINGS
1. ~~here ar~ ~pecial circurastances ar exc~ptional charac-
teriatics applicable to the praperty involved, including
size, shape, topography, loc~ttion, or surroundinga, or ta
tha intended use or development o~ the property that do
not apply to other properties in the vicinity under an
identical zoning classification, in that the number of on-
site parkinq spaces exceeds the code raqu~rement and the
inclusion of compact and tandam parking spaces will nat
detrimentaZly affect the cfrculatian and parking patterns
of the gro~ect.
2. The granting of such variance wil~ not be detrimental or
in~urious to the property or imprvvements in the qeneral
vicinity and district in which the property is located, in

that simi~ar projects in the past hav~ utilized compact
and ~andem parkinq with no siqnificant impact on circula-
tion patterns or neiqhboring properties and that pravided
parking is in excess ag that required.
3. The strict app~~ca~fon of the provisians of th~s Chapter
would result in practical difficulties or unnecessary
hardehips, not i~cluding ecor.omic difficulties or economic
hardships, in that past pro~ecta have incorporated compact
and tandem parkinq spaces with no siqnificant impacts and
the total number of park~ng spaces pravided exceeds the
required nl~mher.
4. The grant~ng of a variance wfll not be contrary ta or in
confiict with the general purposes and intent of this
Chapter, or to the goa3s, objectives, and policies o~ the
General Plan, in that the project as conditioned is con-
sistent with the Ganera~. Plan.
5. The variance would not impair the int~qrity and character
of the district in which it is to }ae iacated, in that more
parking than ia required will be provided and the varianca
will not affect the appearance aP tha praject.
6. The sub~eet site is physica~ly suitab~e for the praposed
variance, in that ~.t is a recycling of commercia~ land
with the provisian of adequate access and circulation.
7. There are adaquate provisians for water, sanitation, and
public utilit~es and services to ensure that the praposed
varfance wouZd not be detrimental ta public health and
safety, in that the pro~act is an in-fi11 in a developed
area with all necessary imprcvements.
8. There will be adequate pravisions for public accesa to
~erve the subject variance proposal, in that adequate
dri.veways wi~l be pravided and pedestrian sidewalks are in
existence.
9. The strict app~ication of the provis~ons of Chapter la of
the City o~ Santa Monica Comprehensive Land Uae and Zoning
Ordinance wauld result in unreasonable deprivaticn of the
use or enjoyntent of the pro~~rty, in that simi~ar var`_an-
ces have bean granted in the past which have not created
any de3eterious effects and parking is pravided for the
pro~ect in excegs of that required.
CONDITIONS
Plans
1. This approval is for those plans dated 11/1OJ89 as re-
viewed by the City Council on O1/16/90, a copy of whiah
shall be maintained in the files of the City Planning Di-

of approval.
2. The Plana shall comply with aIl other prcvisions of Chap-
ter 1, Articie IX of tha Municipal Cade, (Zoning ~r-
dinance) an~ a~l other pertinent ordinances and General
PZan policias of the City of Santa Manica.
3. Final parkinq Iot layout and specifications shall be ~ub-
~ect to the review and approval of the Parking and Traffic
Engineer.
4. M~nor amendments to the plana shal~ be sub~ect to approval
by the Director of Planninq. A siqnificant change in the
approved concept sha~l be subject to Planninq Comm~ssion
Review. Construction sha~~ be in conformanca wi~h ths
plans submitted or as modffied hy the P~anninq Cam~ission,
Architectural Review Baard or Director of Planning.
5. Plans for fin~l design, landscap~nq, screening, trash en-
closures, and siqnage shall be sub~ ect to review and ap-
proval by the Architectural Review Board.
6. The Architectural Review Hoard, in its review, shail pay
particular attention to the pro~ect's pedestrian orienta-
tion and amenities; scale and articulation of design ele-
ments; exterior colors, textures and materials; window
treatment; glazing; and ~.andscaping.
Fees
7. The C~ty is contemplating the adoption of a Transportatian
Management Plan which is intended to mitigata traffic and
air quality impacts resuiting from both new and exiating
develop~ent. Tha Plan will like~y inc~.ude an ordinance
establishinq mitigation raqu~rements, including one-time
payment a~ fees on certa~n types o~ new deveZopment, and
annual fees to be paid by certain types of employers in
the City. This ordinance may requira that the owner of
the proposed project pay such new development fees, and
that emplayezs within the pro~ect pay s~ch new annual em-
pZoyer faes related to ~he City's Transportatian Manage-
m~nt Plan.
Demolit~on
S. Unti1 such time as tha demalition is undertaken, and un-~
~ess tha structure is currently ~n use, the existing
structures shall be maintained and secured by boardinq up
al~ open~nqs~ erect~ng a security fence, and removinq al~
debris, bushes and plantinq that inhib~t the easy surveil-
lance of the property to the satis~action of the Building
and Safety officer and the Fire Department. Any landscap-
ing material rema~.ning shal~ be watered and maintained
until demolition occurs.

Construction

13. Sidewalks, curlas, gutters, pavfng and drivewaya which need
rep~.acinq ar rsmoval as a result of the pro~ect as deter-
m~ned by the Department af General 3A1"V1C@~ shall be re-
constructed to the satisfaction of the Department of
General Services. Approval for this wark sha~.l be ob-
tained from the Department of General Service~ priar to
issuance of the building permits.
14. Vehicles hauling dirt ar ather constructicn debris from
the stte shall cover any open laad with a tarpaulin or
other secure coverinq to minimize dust emissions.
15. Street trees shall be maintained, relocated or prnvided as
required in a manner consistent with the City's Tree Code
(Ord. 1242 CCS). per tha s~acificatiana of the Department
of Recreati.on and Parks and tha Department of General Ser-

16. A conatruction period mitiqation plan shall be prapared by

TO EXECUTE A MEM~RANDUM OF UNDERSTANDING WlTH THE
MANAGEMENT TEAM AS50CIATES
WHEREAS, the City administratifln anc~ re~resentat~~es of the
Management Team Assoc~ates have met ar~d conferred under the terms af Ordinance
No 801 {CCS~ and have reached agreement on wages, F~~urs and other terms and
conditions of ernployment, and
WHEREAS, Sectron 2.06 of Ordina~ce No. 801 (CCS) of the Crty of
Santa Mo~ica requires preparatior~ a~ a written Memarandum of Understanding
between the admrnistration and employees if an agreement can be reached; and
WHEREAS, Section 2.06 of ~rdinance No 801 (CCS} further provides
that any such Memarandum of Understanding shall not be binding unless and untif
presented to the go~eming ~ody for cfetermination; and
WHEREAS, tE~e purpose of the Memorandurr~ of Understand~r~g is ta
promote and provEde harmonious re~ations, COO~J~f8tlOf1, and understanding between
the City and the Management Tearn Associates;

nated person(s) responaible for coordinatinq traneporta~
tian demand management measures at the deve~apment. 2)
Damand management ~easures to be employed at the site to
reduce circulatian impacts whfch would atherwise occur.
such measures may inc~ude, but are not limited to programs
addressing: A. Educatian and Marketinq ta alert employees
and visitors to the si~e to demand reduction proqrams and
incentivea; B. Parking Management such as parkinq charges
for single-accupant veh~c~es, reduced rates for car and
vanpools; C. Ridesharing programe such as a r~deshare
matching program, incentivea, and car and vanpoal sub-
sidies; D. Transit programs such aB provision of bus
schedules to emplayee~ and visitors, subsidized bus takens
and passes to emp~oyees and visitors; E. Bicycling pro-
grams such as provision of secure bicycle storaqe facili-
ties, provision of showers and lockers; F. Altsrnative
Work Schedules for building employees to avo3d peak AM and
PM traffic haurs and reduce overall trips; G. Trip Lenqth
Reduction by programs to increase proportion of employees
residing within three m~les of the project site. The
goal af the Transpcrtatian Demand Management Plan shall be
to reduce vehicle trips which would otherwise accur by
twenty percent,
23. Landscaping plans shall comply with Subchapter 5B
(Landscaping Standards) af the zoning ardinance inc~uding
use of water-canserving landscapinq materials, landscape
maintenanca and other standards contained in tha
Subchapter.
Misce~laneaus Conditions
24. The building address shall be painted an the raof af the
building and shall measure four feat by eight feet (32
square feet).
25. The operation shall at all times be conducted in a manner
not detrimental to surrounding properties or residents by
reasan af lights, naise, activities, parkinq cr other
actions.
26. No medical office use sha1~ ba permitted at the site.
27. If any archaeological remains are uncovered during
excavation ar constre~ction, wark in the afPected area

shail be auspended and a recoqnized specialist sha~l be
contacted to conduct a survey of the affeated area at
pro~ect's owner's e~ense. A determination shali then be
made by the Director of Planning ta determine the sig-

and requirements, if any, to address such findings.
28. Re~use areae, storage areas and mechanical equipment sha1Z
screaned in accordance with S~C Section 904~.13-9040.15.
Refusa areas ahall be vf a size adequate to meet an-site
need, including recycling. The Architeetural Review Board
in its review shall pay particular attention to the
sczeening of such area~ and equipment.
29. Street and/ar alley lighting shall ba provided on public
rights of way adjacant ta the pro~ect ~f and as needad per
the specifications and with the apprava], of the Department
a~ General Services.
Validity of Permits
3~. In the e~ent penaittea violates or fails to comply w~th
any conditions of approval of this permit, no further per-
mits, licenses, approvals or certificates of occupancy
shall be isaued until such violat~on has been fully
remedied.
31. Within ten days of Planning Divfs~on transmtttal of thg
Statement of Offic~al Action, project applicant shall
sign and return a copy of the Statement of Ofticia~ Action
prepared by the Planning Dtvision, agreeing to the Condi-
tions of approval and ackriowledging that failure to comply
with such conditions shall constitute grounds for poten-
tial revocation of the permit approval. Sy s~gninq same,
applicant shall not thereby waive any iegal righta appli-
cant may possess regarding said conditicns. The signed
Statement shall be returned to the Planning Division.
Failure to comply with this conditfon shall constitute
qrounds for potential permit revocation.
Monitoring of Conditians
32. Pursuant to the requirements of Public Resources Code
Section 2i081.6, the City P~anninq Division w~ll coordf-
nate a monitaring and reporting pragram reqard~ng any re-
quirad chAnges ta the project made in con~unction with
gro~ect approval and any conditions of apgroval, including
those conditions intended to mitigate or avoid signif~cant
effects an the environment. This pragram shal~ include,
but is nat limited ta, ensuring that the Plannfnq Divfsion
itself and other Cfty divisions and departments such as
th~ Building Division, the General Services Department,
tY~a Fire Department, th~ Police Department, the Comtnunity
and Economic Development Department and thB Finance De-
partment are aware of project raquirements which must be

aatisfiea ~rior to issuance cf a Hui~ding Permit, Certi~i-
cate of Occupancy, or other permit~ and that ather respan-

34. To mitigate adverse height, bulk, and traff~c impacts of
~he praject as identified in the E2R and by the Commission
and CaunciZ on appeal, the bui~ding height shall nat ex-
ceed four staries/56 feet along Wilshire Boulevard and
sha13, step down to thra~ atories/45 feet along Lincaln
Hcule~ard. The prc~ect sha~l be remanded back to the
Plann~ng Caminissicn f~r further review as indicated
harein. Floor area shall be limited to a a maximum of
75,000 square feet with ~- maximum 2.5 FAR in the Wilshire
Corridor Diatrict and 1.5 FAR (2.Q overal~ average) ~n ths
Lincoln-Narth District. The Plann~ng Commission shall
revfew the design of the buildinq, project accesa and fn-
creased Zandscaping along Lincoln and Wilshirs Boulevards
in order to ansure that the project does not substantiaily
differ from tha prc~ect as discussBd and certilied in ~IR
884. Tha ser~ice station shall cantinue to show no alley
ingres~g/agres~. A min~mum of 50~ o~ the ground floor
shall contain retail usas consistent w~.th the category of
reta3l uses permitted 3n the C6 District and General Plan
Districts. The interiar courtyard shall be ma#.ntained on
the sita. Ingress/Egress to the Subterranean qaraqe shall
ba provided from Lincoln Bou~evard andf or Wilshire
Boul~vard only.
35. On-site parking shall be provided without charge to ten-
ants and employeas at the project site unless and until
such time as a preferential parki?~~ d~st~ict is es-
tablished ~n the pro~ect ar~a, which in the ~udgment of
the Plann~ng Director and Parking and Traffic Engineer
will adequataly grotect neighhorhoad residents from paten-
tial parking impacts of the project.
36. To mitigata traffic impacts idantified in the environmen--
tal impact analysis, no medical offica, or branch bank
u~es shall be permitted fn the pro~ect.
37. Tf requested by the Santa Monica Transportat~on Depart-
ment, pro~ect owner shall pravide and maintain a bus shel-
ter built to City specifications along the Wilshire and

39. Prior to issuance of a Certificate of Occupancy for the
pro~jact, and if reqvirad by the GBneral Sezvices Depart-
ment, applicant shall. perform to the satiafaction, or re-
imburse the City for the co8t a~ the following traffic
mitiqat~.on measures:
-Restripe the existinq eastbound approach to Lfnco~n
Boulevard an w~lshire Boulevard to provide an exclusive
right-turn lana. Thi~ would provida this appraach with
one exclusive ~eft-turn lane, ~wo through lanes and an
~xclus~.ve right~turn ~ane.
-Restripe the existing westbound approach to L~.ncoln
Bou].evard on Wilshire to pra~rids an additional lane. This
measure would provide a total of five lanes on the west-
bound approach, rasulting in double left-turn and ri.ght-
turn lanea and a single thr~ugh lane.
40. The service station sha11 contain a mechanical exhaust
system that directe air and odars away from the ad~acent
residential dis~rict.
41. Canstructian equipment, fixed and mo}~ile, aperated within

The Wilshire/Montana Neighborhood Coalition wishes to
infarm you of a unanamous vote of ats board of directors,
taken at zts mont~jty 3 February public meeting, on the issue of
uses of the propertX at 808 Wilshire Blv~o
Board rnembers agreed to ask that the Council take the
fo~lowing actions to ~nsure that this large buildzng be
used and mainta~ned in accordance with the developer's
promises and in harmony with ~ts residential neighbors:
(1) Support an appeaZ of the October 1998 Planning
Commission Aermission to canvert the prom~.sed retail spaces
into non-pedestrian-fr~endly affices;
(2) Oppose the ~novement on the part of property co-owner
Fu~ita Corporation to break i~s pramises for a pedestrian-
oriented bualdzng with neigh~orhood resident use of retail
and service businesses and to work cooperative~y with
ne~ghborhoad groups and representatives as well as c~ty staff
in identifying appropriate tenants and uses;
(3} Deny the origanal approval in support of a resolution
protecting the interests of this ~mportant zntersect~on property
~hat a.s shared by residential neighbors in both the
Wilshire/Montana and MYd-Cities corridors; and
(4) Closely scrutinize the property owner's actions in
~ight of its d~sruptzve actions relatzng to emp~oyes of the
Sheraton-Miramar Hotel, which is owned by the same Fu~ita Corp.
