On August 9, 1983, the appeal of the Planning Commission's denial
of DR 146 was presented to the C.l.ty Council. The applicant was
not present and the appeal was denied. At the request of
Councilmember David Epste.l.n, the Council agreed to recons.l.der the
item with the applicant present.
Background
The proposed project is the same as was presented to the Council
on August 9, 1983. The staff report prepared for that meet.l.ng is
attached. Also attached is a letter from the applicant's attorney
which reiterates the terms and conditions to which the applicant
is w.l.lling to agree. This department has been unable to confirm
support for this agreement from the Seventh and Strand
neighborhood organization.
The Planning Commission, in denY.l.ng the proJect indicated to the
applicant that if he wished to pursue the matter further, he
should meet with concerned residents of the area to address the
issues raised and resubmit a rev.l.sed proJect to the Planning
Cormniss1on.

The proJect has been modified to specify uses wh~ch will not be
included, but revisions have not addressed planning questions
of site design and conformance to the proposed Land Use Element
policies, specifically the Land Use Element deslgn issue of the
build-to line with parking in the rear, or the provision of a
broad landscape buffer along Lincoln Boulevard.
Budget/Financial Impact
The recommendations presented in th.l.s report do not have a budget/
financial impact.
Recommendation
It is respectfully recommended that this appeal be denied and
that the applicant be encouraged to submit a revised project to
the Planning Commiss.l.on for consideration.
