A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA MAKING CEQA F~Nt~INGS
NECESSARY TO APPROVE THE ZONING ADMINISTRATOR DETERMINATIQN
ALLaWING A SUPERMARKET UNDER THE TERMS OF
THE EXISTING ARBORETUM DEVELOPMENT AGREEMENT
WHEREAS, the City Council has certified an Environrnental
Impact Report far the Zoning Administrator Determinatian allawing
a supermark~t under the terms of the existing Arboretum
Develapment Agreement;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES IiER~BY RESOLVE AS FOLLOWS:
SECTION ?. Consisten~ with Article VI, Section 12 of the
City of Santa Monica CEQA Guidelines and Sections 1509~ and 15Q92 _
cz Lh~ State of California CEQA Guidelines, the C~ty Council
finds that all impacts resulting from the pxoject can be reduced
to an acceptable level. A1.1 significant enviranmental etfects as
id.entified below can feasibly be avoided and have been eliminat2d
or substantially lessEned.
ia) The final EIR determined that, without m~tigation and
as compaxed ~o the development allowed under the ex~sting
Developmen* Agreement, d~velapment of a supermarket under the

proposed Zoning Aamir.istrator Determination coul~ significantly
impact traffic f~ow at the intersec~ion of 20th Street and
w~lshize Sou~evard in the PM peak hour period. Consistent wzth
Artic~e VI, Sectzon 12 of the City CEQA Guadelines and Section
1~~9~ of the State of Ca~~farn~a CEQA Gu~delines, the C~ty
Council f~nds that the fal~owing mitigation measure has been
requ~red ir the project which will mitigate these traffic impacts
to below the level of significance:
(1} For ~he intersection of 20th Street and Wilshire
Boulevard the applicant is required under the existing
Development Agreement ta restripe the narthbound approach on
20~h Street to provide two through lanes instead of one
r~~ht-turn cnly lane and one through lane When this i~
campleted, the impact ident~fied for this ~ntersection wi11
_ _ be fully mitigated
ib? The CEQA-mandated environment~Ily superiar alternative
was found ~o be reszdential d~velopment of the site, as analyzed
fsl~y in Scheme C in the Final EIR This is not a feasible
al~ernative under the Zoning Administrator Determination scenaria

found residential ta be a perm~t~ed use under ~he terms of the
ariginal Arboretum Development Agreement

SECTTON 3. The City Clerk sha11 certify to the adoption of

AN ORDINANCE OF THE CITY CdUNCIL OF THE
CITY OF SANTA MONICA
APPROVING THE DEVELOPMENT AGREEMENT AMENDMENT BETWEEN
ARBORETUM DEVEL~PMENT PARTNERS, L.P., A CALIFORNIA
LIMITED PARTNERSHIP AND THE CITY ~F SANTA MONICA
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES QRDAIN A5
FOLLOWS:
SECTION 1. The Develapment Agreement Aanendment attached
hereto as Exhibit "A" and incorporated herein by reference between
Arboretum Development Partners~ L.P., a California Limited
Partnership, and the City of Santa Monica, a municipal corparation,
is hereby approved.
SECTION 2. Each and every term and condition of the
Development Agreement Amendment approved in Section 1 of this
Ordinance shall be and a.s made a part of the Santa Monica Municipal
Code and any appendices thereto. The City Council of the City of
Santa Monica finds that public necessity, public convenience, and
general welfare require that any provision of the Santa Monica

Municipa~ Cade or appendices thereto inconsistent with the
pr~vis~ans af this Development Agreement, to the extent of such
inconsistencies and no further, be repealed ar modified to that
extent necessary to make f~lly effective the provisions of this
Development Agreement Amendment.
SECTION 3. Any provision af the Santa Monica Municipal Cade
or appendices thereto, inconsistent with the provis~ons af this
ordinance, to the extent af such inconsistencies and no further,
are hereby r~pea~ed or modified to that extent necessary to effect
the provisions of this ~rdinance.
SECTION 4. If any section, subsection, sentence, clause, or
phrase of this Ordinance is for any reason held ta be invalid or
unconstitutional by a decision of any court of any competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance. Tha City Council hereby
declares that it wou~d have passed this ardinance, and each and
every section, subsection, sentence, clause, or phrase not declared
invalid or uncanstitutianai without regard to whether any portion
of the ~rdinance wauld be subsequently declared invalid or
unconstitutional.

SECTION 5. The Mayor shall sign and the C~ty Clerk shal~
attest to the passage of this Ordinance. The City Clerk shall
cause the sa~e to be published once in the official newspaper
within 15 days after its adoption. This Ordinance shal~ be
