I would like the following infonnation on the requirement listed below: Theaters. Cinemas requirement: 1 space per 4 fixed seats or 1 space per 80 sq. ft. of FA of assembly area, whichever is greater. 1. What is the backgr-uiIDd on this section of the code? Specifically, how was the logic developed that allowed one parking space to equal 4 fixed seats or 80 square feet of floor area? Who was involved in formulating thig requirement? 2. How did the above Theaters/Cinemas parking requirement become part of the Santa Monica Municipal Code? Did Parlcing and Traffic advance the proposition for consideration in the code? If your depa.&'l.t.uent did not handle it who did? 3. What body voted on the proposal and to add it to the Municipal Code? These permits are sold on a first-come, first-serve basIS by the CIty A lIst of purchaser names for Lots 11 and 12 IS attached The City does not have JunsdictlOn over Lot lOA With regard to your question about the process the CIty uses to venfy parking studies and consultant credentials (partIcularly with respect to Meyer. Mohaddes, ASSOCIates, Inc.), the City revIews parkmg studies submmed by consultants to ensure that the methodology and standards used are consIstent with standard City practices and reqUIrements. TIns revIew IS based on the Parkmg and Traffic DIvisIOn's knowledge of parking requirements and demands in dIffering areas of the CIty Meyer. Mohaddes ASSOCIates. Inc. is a consulting firm who speCIalizes m transportation planmng and engmeenng. The firm has extensIve expenence m policy analysIs. traffic operatIOns, traffic Impact assessment, and traffic mitigatlon programs. In addition, the firm specializes in preparmg traffic and parkmg Impact studIes for commercIal projects throughout Southern CahfomIa With regard to the VIOlations regarding CondItion No. 37 of CUP 90-065, whIch states that the outdoor patIO shall not be used for restaurant servIce of food, beverages, and/or alcoholic beverages. the City's Zoning Inspector first sent a notice of this VIOlatIOn to the property owner on May 13. 1997, mfornllng hIm that food and beverage servIce to the outdoor tables was not permItted. Site VISIts beginmng on May 17, 1997 through August 6, 1997 confirmed that the restaurant was no longer servmg food or alcohol to these outdoor patIo seats. In this letter you requested background information regarding how the requirement for theaters, cinemas (smgle and multI-screen) and other places of assembly was denved. Specifically, thIs section requires: 1 space per 4 fixed seats or 1 space per 80 sq. ft. of floor area of assembly area, whichever is greater. 1. In response to your first question regarding the background of this section of the Code, the CIty'S Parlang Ordmance (SMMC Section 9.04.10.08 (Purpose)) sets forth the reasoning behind the implementatIon of parking regulations. TIns Ordmance is attached in full to this letter. Parking requirements for theaters were originally adopted by the CIty CouncIl on September 28, 1948, as Santa Moruca Mumcipal Code Section 9115B3(d), which sets forth the following parkIng reqwrements: - For church, school, college and university auditoriums and for theaters, general auditoriums, stadIUms and other simllar places of assembly, at least 1 parkIng space for every 10 seats provided in said building. A copy of the pertment sections of thIs Ordmance. mcluding the voting record, IS enclosed for your review. In 1960, Ordinance 491 amended this SectIon by addIng a provision regarding fixed nwnber of seats, which reads. Theaters. Dance Halls. Convention centers. Meeting Halls. and Places of Assemblv 1 space per 4 fixed seats, or 1 space per 80 square feet of floor area in places of assembly If no fixed seats. The reqwrement was changed agam from 1 space per 4 fixed seats to 1 space per 10 fixed seats per Ordinance 768 10 1968; however. It was changed back to 1 space per 4 fixed seats by Ordinance 1016 10 1975, and that requirement still remains in place today The applicable sectlOns are enclosed. 2. In response to your second questIOn, parkmg reqwrements are established to provide parking In proportion to the needs generated by varying types of land use Since the City allows theaters and cmemas, the City also reqUITes that parking be provided for the needs generated by these uses. and these needs are determined through the process described in the above paragraph.
