A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ~mHCA DECLARING ITS INTENTlO:l TO RECONSTRUCT
TENTH COURT BETWEEN OLYMPIC BOULEVARD AND 450 FEET
NORTHWESTERLY OF OLYMPIC BOULEVARD
WHEREAS. the Clty Council of the City of Santa Monica is

empowered by Sectlon 5870 et seq. of the Streets and Highways Code of
the State of California to reconstruct Tenth Court between Olympic
Boulevard and 450 feet northwesterly of Olympic Boulevard;
NOW. THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public interest requires and it ;s the
intention of the City Council of the City of Santa,Monica to order the
following work to be done. to wit: The reconstruction of Tenth Court
between Olympic Boulevard and 450 feet northwesterly of Olympic Boulevard
all in the City of Santa Monica. The estimated assessment cost of the
improvement is $34.50 per front foot.
SECTION 2. That said proposed work or improvement in the
opinion of the City Council of the City of Santa Monica is of more than
local or ordinary public benefit, and said Council hereby proposes that
the district in the City of Santa Monica to be benefited by said work or
improvement and to be assessed to pay the cost and expense thereof,
includes all of the property abutting Tenth Court between Olympic Boulevard
and 450 feet northwesterly of Olympic Court.

SECTION 3. Notlce ~ereby is given pursuant to said
Sectlon 5870 et seq. that on Ju1y 25. 1973. at the hour of 7:30 p.m.

situated at 1685 Main Street 1n said City. any and all pevsons having
any objections to the proposed work or i8provernent may appear before
the City Council and show cause why the said proposed work or improvement
should not be carried out in accordance with said Resolution of Intention. ~
SECTION 4. The Superintendent of Streets immediately shall
cause to be conspicuously posted along the line of said contemplated
improvement notice of the passage of this Resolutlon of Intention in the
manner and form prescribed by law.
The City Clerk hereby is dlrected to mail notices, in the manner
and form prescribed by law, of the adoption of this resolution to all
persons owning real property in the hereinbefore described assessment
district. whose names and addresses a?pear on the last equalized assessment
roll for city taxes or as known to the City Clerk.
SECTION 5. The City Clerk shall certify to the adoption of this
resolution and thenceforth and thereafter the same shall be in full force
and effect.

Alley Improvement, Tenth Court North of Olympic Boulevard
Introduction
This report recommends that the City Council authorize the Staff to proceed
with the alley reconstruction on Tenth Court north of Olympic Boulevard
under provisions of the 1911 Act in response to requests from property owners
adjacent to the subject alley.
Background
Representatives of the Salvation Army, the major property owner in the area
between Tenth Street and E1eventh Street north of Olympic Blvd., have
requested the City to reconstruct the alley in this area. The City Staff
has prepared a prelininary plan of improvement which calls for the alley
to be reconstructed of concrete pavement to withstand the extensive traffic
frOM large trucks and from forklift trucks which are used by the Salvatlon
Army and Bourget Brothers, as well as others, in this alley. The alley
presently is in the worst conditlon of any alley in Santa Monica due to the
heavy trucks and the forklift trucks.

It is proposed by Staff that the City pay 50 percent of the cost (approximately
$31,000) from existing budgeted maintenance funds and that the property
owners be assessed for the remainlng 50 percent of the cost ($31,000). A map
designating the property owners and a list of the proposed assessments is
attached.

The Staff has contacted the other major property owner. Bourget Bros.. regarding
thlS improvement. They have indicated that they will not oppose the project
and assessment if they can pay over a multi-year perlod.
Alternatives
1. The City can continue to patch the alley at nO additional cost to property
owners. The result of this wlll be a continuing poor alley surface condition
and a long-term malntenance expense. In order to malntain the alley in a
minimum condltion. it is currently necessary to patch the alley approximately
once every two weeks. This has not been done and there are severe chuckholes
existing in the alley.
2. Other combinations of fundlng, lncluding assessment funding, can be
established. It is not recommended that the City fund the project in its
entirety due to general fund limitations. Gas tax funds may not be used for
alley construction; they may be used only for streets which are 40 feet or
more in wldth.
Recommendations
It is recommended that the City Council authorize City Staff to proceed under
the provisions of the 1911 Act for this lmprovement with the City paying
one-half of the cost from available Maintenance Funds. Account 421-664.

This is in response to ,your request for an estimate of
cost for the reconstruction of the alley serving the Salvat'on
Amy between 10th and 11th Streets north of Ol)'lTq)1e Blvd. As
we discussed. this alley fs probably the worst in the Ci'tv and .
the poor condition ts due to the extremely heavy use by all of
the property owners, but especially Bourget Brothers and the
Salvation A~.
As we discussed. it hour recomnendation that this alley
be reconstructed in concrete due to the heavy truck and forkUft
use. If this is done, and if the COUncil agrees to fana an
assessment district, the costs to property owners would be as
shown on the attached sheet..
Please look this over and advise us if you wish to proceed.
