City Attorney SUBJECT OrdInance Renaming Lmcoln Park Chrlstme Emerson Reed Park and Amending Santa MOnica MUnicipal Code Sections 4 08 091, 4 08 180, and 4 55 020 to Reflect the Name Change INTRODUCTION At Its meeting on October 28, 1997, the City Council Introduced for first reading an ordinance renaming Lincoln Park Christine Emerson Reed Park and amending vanous Sections of the MuniCipal Code to reflect that name change The ordinance IS now presented to the City Council for adoption RECOMMENDATION It IS respectfully recommended that the accompanYing ordinance be adopted PREPARED BY Marsha Jones Moutne, City Attorney 6C NOV 1 1 1997 !. f \atty\munr\laws\mJm\reed 2d City Council Meeting 11-11-97 Santa MOnica, California ORDINANCE NUMBER ~ (City Council Senes) AN ORDINANCE OF THE CrTY COUNCrL OF THE CITY OF SANTA MONICA RENAMING LINCOLN PARK CHRISTINE EMERSON REED PARK AND AMENDING SANTA MONICA MUNICIPAL CODE SECTIONS 408091,408 180 AND 4 55 020 TO REFLECT THE NAME CHANGE WHEREAS, Chnstlne Emerson Reed served as an esteemed member of the Santa MOnica City Council from 1975 to 1990, and as Mayor from 1984 to 1986, and WHEREAS, Chnstlne Emerson Reed represented the City's Interests on the Los Angeles County Transportation Commission and Metropolitan Water Dlstnct Board, and WHEREAS, Christine Emerson Reed first served the City as a Recreation and Parks CommissIoner and was an active supporter of the CIty'S parks and open spaces, and WHEREAS, the City Council deSires to honor Christine Emerson Reed for her service to the community, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY ORDAIN AS FOLLOWS SECTION 1 Lincoln Park located In the City of Santa MOnica IS hereby renamed Chnstlne Emerson Reed Park In honor of Councllmember, Mayor, and CIVIC leader Christine Emerson Reed 1 ~ c SECTION 2 Santa Momca Munrclpal Code Section 4 08 091 IS hereby amended to read as follows Section 4.08.091. Park Closure. (a) No person shall enter, remaIn or be present In any of the followIng CIty of Santa MOnica parks between the hours of eleven p m. and slxam (1 ) Ashland Park, (2) Beach Park #1, (3) Beach Park #4 (LIfeguard Headquarters), (4) Clover Park, (5) Crescent Bay Park, (6) Douglas Park, (7) HotchkIss Park, (8) Joslyn Park, (9) Chnstme Emerson Reed Park, (10) Los Amlgos Park, (11 ) Manne Park, (12) Memonal Park, (13) Ocean View Park, (14) Ozone Park, (15) Pacific Street Park, (16) Park Drive Park, 2 . -' (17) Schader Park, (18) Stewart Street Park, (19) Virginia Avenue Park (b) No person shall enter, remain or be present In Palisades Park between the hours of twelve midnight and fIve a m (c) This Section shall not apply to any public sidewalk Immediately adjacent to any public street or highway, or to any street or highway which traverses any park, Including the Santa Monica Municipal Pier access road or walkway and any portion of CalifornIa Avenue SECTION 3 Santa Monica Municipal Code Section 4 08 180 IS hereby amended to read as follows Section 4.08.180. Tennis courts. All persons, firms and corporations are hereby prohibited from uSing CIty controlled or owned tennrs courts for the purpose of professIonal teaching, coaching or Instruction of tennis, except at Christine Emerson Reed Park, and then only under a wntten concession agreement with the City of Santa MOnica SECTION 4 Santa MOnica Municipal Code Section 4 55 020 IS hereby amended to read as follows 3 Section 4.55.020. Definitions. As used In this Chapter, the following words and phrases shall have the following meamngs "Departmenf' shall mean the Department of Commumty and Cultural Services. "DIrector" shall mean the Director of the Department of Commumty and Cultural Services "Litter" means any abandoned, dIscarded substance IncludIng, but not limited to garbage, refuse, rubbIsh, abandoned and Inoperable household appliances, discarded packaging or containers, dIscarded bUlldmg, plumbing or construction matenal, unless pursuant to construction operations, lighted or non lighted cigarettes, cigars, matches or any flaming or smoldering matenal, and all other waste matter WhiCh, If thrown or deposited as prohibited herein, may be detnmental to public health, safety and welfare "Park" and "parksu shall mean and Include the followmg parks in the City Ashland (SunseUAshland Park) Park, Beach Park #1, Beach Park #4, Bernard Way linear Park, Clover Park, Crescent Bay Park, Douglas Park, Goose Egg Park, HotchkiSS (Mary HotchkiSS Park) Park, Joslyn Park, Chnstlne Emerson Reed Park, Manne Park, Memonal Park, Ocean View Park, Ozone Park, PaCifiC Street Park, Palisades Park, Park Dnve Park, Schader Park, South Beach Park, Stewart Street Park, Virginia Avenue Park and any City-owned landscaped open space In the CIVIC Center area 4 "Park facIlity" and "park facIlities" shall mean any bUilding, structure, recreatIonal facility, table, bench, fence, monument, equipment, apparatus, walkway or park property In any park "Park follage" shall mean any tree, hedge, bush, shrub, plant, flower, grass or foliage In any park SECTION 5 Any provIsion of the Santa MOnica MUniCipal Code or appendices thereto Inconsistent With the provIsions of this Ordinance, to the extent of such Inconsistencies and no further, IS hereby repealed or modified to that extent necessary to effect the provIsions of thiS Ordinance SECTION 6 If any section, subsectIon, sentence, clause, or phrase of thiS Ordinance IS for any reason held to be Invalid or unconstltutlonal by a deCISion of any court of competent JUriSdiction, such deCISion shall not affect the validity of the remaining portions of thiS Ordinance The City Council hereby declares that It would have passed thiS Ordinance and each and every section, subsectIon, sentence, clause, or phrase not declared Invalid or unconstitutional Without regard to whether any portIon of the ordinance would be subsequently declared invalid or unconstitutional 5 SECTION 7 The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance The City Clerk shall cause the same to be published once In the official newspaper wIthin 15 days after Its adoption.
