SR-0 (109) ORDIN]U~CE ~J.MBER 1686(CCS) (Clty Councll Serles) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF S&~TA MONICA ESTABLISHING INTERIM DEVELOPMENT STANDARDS FOR ?ORTIONS OF THE CITY LOCATED IN THE MI AND C5 DISTRICTS, NORTH OF THE SANTA MONICA FREEWAY AND EAST OF 19TH STREET PLACE ~~LEY THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. FIndlngs and Purpose. The Clty Councll flnds and declares: (a) At l~S March 16, :993 meetlng, the Cl~Y Councll approvea a TIot~on dlrectlng staff to study the C5 and Ml dlstrlct areas located north of the Santa MonIca Freeway and east of 19th Place alley I the n SL:udy area n), and to conduct envlronmental reVIew of an optlon whlch would rezone the area to a new zonlng desIgnatlon to De known as M1/RD. (b) ?enalEg completIon of ';:he study and re-zonlng ot these areas to a zonl~g desIgnatlon conSIstent wlth tie Clty Co~ncll's jlrect~on, ~o protect the publlC heal~h, safety, and wel=are, It 15 necessary to llmlt on an InterIm basls the maXImlli~ bUlldlr.g helght, floor area ratIO, and permltted uses for the study area. (c) On t1arch 16, 1993 the Cl ty Councll dIrec~ed staff to prepare an InterIm ordlnance to Implement the development standards proposed for the t.n IRD dlstrlct. Sub] ect to the provlslons of Sectlons 3 and 4 of thlS ordlnance, the Plannlng CommlSSlon and Cl ty staff are dlrected, after June 23, 1993, to dlsapprove all requests for the lssuance of bUlldlng permlts and tentatlve maps, tentatlve parcel maps, admlnlstratlve approval, development reVlew permlts, condltlonal use permlts, or any other Clty permlts for ~he constructlon, erectlon, converSlon, or mov:..ng of any structure located In the area deslgnated as the lnterlm ZOD1Dg study area on the map attached hereto as "Exhlblt A", unless the project compIles wlth the followlng development standards: (a) Permltted Uses. The followlng uses shall be permltted lf conducted Wl thln an enclosed bUlldlng (except T,N'here othe~wlse perIn tted: ) (1) Admlnlstratlve and executlve offlces WhlCh are accessory to a prlmary permltted use on the same slte and WhlCh do not exceea 50% of the gross floor area of sald prlmary permltted use. (2) Artlst StUd10S and art galler~es. (3) Automoblle repalr and automoblle palntlng faCllltles excep~ ~hose aDutt~ng any resldentlal dlstrlct and use. (h) Confectlonery and related products. (i) Cut stone and stone products. (J) Diecut paper and paperboard, and cardboard. (k) Electric components and accessories. (1) Electrlc lightlng and wiring equipment (m) Fabricated textile products. (n) Furniture and fixtures. (0) Glass products. (p) Jewelry, sllverware, and plated ware. (q) Luggage. (11) Other uses that are determlned by the Zonlng AdF.,lnlstrator to be slmllar to those llsted above. (d) Prohlblted Uses. The followlng uses shall be prohlblted: (1) Rooftop parklng on parcels dlrectly abuttlng, or separated by an alley from, a resldentlal dlstrlct. (21 P~y use not speclflcally authorlzed. There shall be no llmltat~on on the nlli~er of storles of any detached parklng structure so :ong as the helght does ~Ot exceed the nlli~er of feet permltted In the dlstrlct. (2) Maxlmlli~ Floor Area Ratlo. 1.0, except that for projects located on propertles deslgnated "speclal study zones" on the attached map, a maxlrnum floor area ratlo of .25 shall be permltted. (3) MlnlmUffi Lot Slze. 15,000 square feet. Each parcel shall ccnLaln a MlnlmUffi depth of ~50 feet and a mln~mum wldth of lOa 6 :eetr except that parcels eXlstlng on September 8, 1988 shall not be subJect to thlS requlrement. (4) F~ont Yard Setback. Landscaplng as requlred pursuant to the provlslons of Part 9.04.10.04 of the Santa MODlca Munlclpal Code. (5) Rear Yard Setback. SECTION 3. ApplIcabIlIty. Sub] ect to SectIon 4 of thIS OrdInance, the reqUIrements of SectIon 2 of thIS OrdInance shall 8 apply to all proJects developed on any parce~ ~n the area designated In-:.er:m zoning study area on the map attached as "Exhlbit A". SECTION 4. Exemptions. The following applicat~ons are exempt from the provisions of Section 2 of thiS Ordinance: (a) ~ny bUilding or structure for which a bUlldlng permit was issued on or before the effective date of thiS Ordinance. (b) Any proJect for WhiCh a vesting tentative map application was filed and deemed complete on or before the effective date of th:..s Ordinance. ic) Any proJect located on a property subJect to a Development Agreement as of the effectlve date of thiS Ordlnance. SECTION 5. ThiS Ordinance shall be of no further force and effec~ 45 days from adopt1on, unless prior to that date, after a duly noticed publiC hear1ng, the C1ty Council, by maJority vote, extends the i~~erlm ordinance as provided ln Section 9.04.20.:6.060 of the Santa ~on1ca MuniCipal Code. S~CT=ON 6. Any provisions of the Santa Monica MuniCipal Code or appena::ces thereto 1nconS1stent with the prov1 Slons of :.hlS Ordir.ance, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to effect the prov1s1ons of thiS Ordinance. SECTION 7. If any section, subsection, sentence, clause or phrase of th1S Ordinance 1S for any reason held to be 1nvalld or unconstl tutional by a dec1slon of any court of any competent Jurisdlctlon, such deCiSion shall not affect the validity of the 9 remalnlng port::..ons of thlS Ordlnance. The Cl ty Cauncll he:!:'eby declares that :t would have passed thlS Ordlnance, and each and eve:!:'y sectlon, subsec~lon, sentence, clause, or phrase not declared l~val:Q or unconstltutlonal wlthout regard to whether any portlon of ~he Ordlnance would be subsequently declared ::..nvalld or unconstltutlonal. SECTION 8. The Hayor shall slgn and the Cl ty Clerk shall attest to the passage of thlS Ordlnance. The Cl ty Clerk shall cause the same to be publlshed once In the offlclal newspaper Wl trun 15 days after 1 ts adoptlon. ThlS Ordlnance shall become effect:ve 30 days from lts adoptlon.
