Subject: Second Modification to Agreement No. 8436 (CCS) with Smith Emery
Company for the Civic Center Parking Structure
Recommended Action
It is recommended that the City Council:
1. authorize the City Manager to negotiate and execute a Second Modification to
Agreement No. 8436 (CCS) with Smith Emery Company in an amount not to
exceed $50,000 for additional inspection services for the Civic Center Parking
Structure; and,
2. authorize the City Engineer to issue any necessary modifications to complete
additional work within budget authority.
Executive Summary
Construction of the Civic Center Parking Structure is nearly complete and will
accommodate the increasing demand for parking in the Civic Center area. The new
structure is located on City-owned land bounded by 4th Street on the east, Civic Center
Drive on the south, Avenida Mazatlan on the west and Olympic Drive on the north. The
structure will provide public parking for those utilizing the Public Safety Facility, City
Hall, the Courthouse and surrounding destinations.

Unknown soil conditions were revealed during the construction excavation and
foundation stages. Due to these unknown conditions, additional inspection services
utilized by Smith Emery Company, the inspection firm, depleted the project's budget
and budget contingency. In addition, the City added additional scope to the project to
include the installation of a new storm drain manhole. As a result, the current funds for
inspection services are insufficient. An increase in the amount of $50,000 to Agreement
No. 8436 (CCS) is required to complete these services. The total amount for these
services is $295,583.
Discussion
During the project excavation and foundation work, Smith Emery Company provided
inspection services in conjunction with ARB Construction. During the project
excavation, sand backfill was surrounding the existing one hundred twenty inch (120")
County Stormdrain running diagonally under the new parking structure. As a result of
this unforeseen condition, additional inspection services were required and had to be
committed to the project. On November 29, 2006, the First Modification was issued
allowing staff to utilize the contingency funds for the project. This work along with the
added scope to install a new storm drain manhole resulted in increased costs.
Additional funds for continuing inspection services through project completion are
therefore required.

Previous Council Actions
On January 11, 2005, Council awarded Professional Services Agreement, No. 8436
(CCS), to the Smith-Emery Company for Deputy Inspection and Materials testing.
Budget/Financial Impact
The contract amount to be awarded to Smith Emery Company for additional inspection
services is $50,000. Funds in the amount of $50,000 are available in account
C010562.589000, "Civic Center Parking Structure".
